The criminal justice process in the Philippines involves law enforcement apprehending suspected violators. Cases may be diverted at various stages if there is insufficient evidence. They proceed to prosecution if probable cause exists and to courts for trial. If convicted, offenders serve time in jail/prison or probation. Diversion can occur through parole, pardon or probation. The process involves pillars of law enforcement, prosecution, courts, corrections and community involvement.

This paper documents my being falsely arrested, prosecuted and convicted of Murder and Arson charges by the New York State Criminal Justice System. This paper outlines the factual and true-life events that took place, in my life, between August 2, 1974 and July 27, 1976, which set the course for the remainder of my life. I tell this story now, forty years later, only because it was suggested offhandedly by an acquaintance. Over the span of the 40-years since my so-called conviction I rejected the idea of publishing any report on this case up to now because society tends to believe the societal mores over anything the individual may have to say about his or her innocence concerning an arrest, prosecution and conviction by reprehensible methods.

Please re-examine the harsh and misplaced criticisms leveled by you against the Honolulu Police Department.

The report, which examines a 17-month period, shows that false allegations of rape and domestic violence are perhaps more rare than previously thought, and that in only a very small number of cases was it considered that there was sufficient evidence and that it was in the public interest to prosecute a person suspected of making a false allegation of rape or domestic violence.
