De thema’s die op de studiedag besproken zullen worden, worden bepaald op basis van de rechtspraak van de Raad van State uitgesproken tussen december 2014 en april 2015. Dit

Mental health has been in the news quite a bit lately. Dozens of U.S. states are currently suing Meta for contributing to the youth mental health crisis by inserting addictive features into their products, while the U.S. Surgeon General is touring the nation to bring awareness to the growing epidemic of loneliness and isolation. The country has endured periods of low national morale, such as in the 1970s when high inflation and the energy crisis worsened public sentiment following the Vietnam War. The current mood, however, feels different. Gallup recently reported that national mental health is at an all-time low, with few bright spots to lift spirits.
To better understand how Americans are feeling and their attitudes towards mental health in general, ThinkNow conducted a nationally representative quantitative survey of 1,500 respondents and found some interesting differences among ethnic, age and gender groups.
Technology
For example, 52% agree that technology and social media have a negative impact on mental health, but when broken out by race, 61% of Whites felt technology had a negative effect, and only 48% of Hispanics thought it did.
While technology has helped us keep in touch with friends and family in faraway places, it appears to have degraded our ability to connect in person. Staying connected online is a double-edged sword since the same news feed that brings us pictures of the grandkids and fluffy kittens also feeds us news about the wars in Israel and Ukraine, the dysfunction in Washington, the latest mass shooting and the climate crisis.
Hispanics may have a built-in defense against the isolation technology breeds, owing to their large, multigenerational households, strong social support systems, and tendency to use social media to stay connected with relatives abroad.
Age and Gender
When asked how individuals rate their mental health, men rate it higher than women by 11 percentage points, and Baby Boomers rank it highest at 83%, saying it’s good or excellent vs. 57% of Gen Z saying the same.
Gen Z spends the most amount of time on social media, so the notion that social media negatively affects mental health appears to be correlated. Unfortunately, Gen Z is also the generation that’s least comfortable discussing mental health concerns with healthcare professionals. Only 40% of them state they’re comfortable discussing their issues with a professional compared to 60% of Millennials and 65% of Boomers.
Race Affects Attitudes
As seen in previous research conducted by ThinkNow, Asian Americans lag other groups when it comes to awareness of mental health issues. Twenty-four percent of Asian Americans believe that having a mental health issue is a sign of weakness compared to the 16% average for all groups. Asians are also considerably less likely to be aware of mental health services in their communities (42% vs. 55%) and most likely to seek out information on social media (51% vs. 35%).

Actuele zaken is de nieuwsbrief waarin Roeland Gouw, Kennismanager
Bestuursrecht bij Balance, zijn visie geeft op recente bestuursrechtelijke
uitspraken.

1) Opschorting beslistermijn wegens vertraging indiener
Wat te doen als je als belanghebbende een niet-aangetekend verzonden besluit niet ontvangt,
waardoor je te laat bent met je bezwaarschrift? Als het bestuursorgaan de verzending
aannemelijk had gemaakt, gold lange tijd dat een belanghebbende op ‘niet ongeloofwaardige
wijze’ moest ontkennen dat zij het stuk had ontvangen. Dat was een onneembare hobbel.
Voor de vuist weg kan ik me één voorbeeld herinneren waarin dit een belanghebbende lukte
(een bedrijf met een eigen postadministratie).
Een nieuw criterium voor alle bestuursrechters
Op 10 mei 2011 sloot de Afdeling Bestuursrechtspraak zich aan bij de net iets andere
benadering van de Hoge Raad. ‘Indien het bestuursorgaan de verzending naar het juiste adres
aannemelijk heeft gemaakt, ligt het vervolgens op de weg van de geadresseerde voormeld
vermoeden te ontzenuwen. Hiertoe dient de geadresseerde feiten te stellen op grond waarvan
de ontvangst redelijkerwijs kan worden betwijfeld. Deze precisering van de benadering van
het bewijs van ontvangst van niet-aangetekend verzonden stukken sluit aan bij de
rechtspraak van de Hoge Raad.’
De mogelijkheid om het vermoeden van ontvangst van een stuk ‘niet ongeloofwaardig
ontkennen’ was daarmee vervangen door de mogelijkheid dit vermoeden te ontzenuwen.
Vraag is welk verschil dit in de praktijk maakt.
Toepassing geen verbetering
Op 10 april 2012 deed de rechtbank Zwolle-Lelystad een uitspraak die deed vermoeden dat
het nieuwe criterium de burger geen enkele winst had gebracht. De rechtbank stelde vast dat
het bestuursorgaan de verzending van een subsidieverlening aannemelijk had gemaakt.
Vervolgens was het aan belanghebbende om het vermoeden van verzending te ontzenuwen.
Belanghebbende stelde dat het denkbaar was dat het stuk zoek was geraakt bij de
postbezorging. Verder stelde zij dat het verweerder duidelijk kon zijn dat zij nooit zou
instemmen met het bewuste besluit. Hierbij wees zij erop dat zij, in reactie op een brief waarin
verweerder wijzigingen in de subsidiesystematiek had toegelicht, voorafgaand aan het
bestreden besluit per brief haar bedenkingen tegen deze wijzigingen naar voren had
2. gebracht. Als belanghebbende het besluit had ontvangen, dan had zij daar zeker meteen
bezwaar tegen gemaakt.
Het zal niemand verrassen dat de rechtbank de eerste stelling wegwuift: ‘De rechtbank stelt
vast dat eiseres niet aannemelijk heeft kunnen maken dat zich in de periode van verzending
van het primaire besluit dusdanige problemen hebben voorgedaan met de postbezorging dat
daaruit zou kunnen worden geconcludeerd dat het primaire besluit niet zal/kan zijn
aangekomen.’
De rechtbank overweegt het volgende over de tweede stelling: ‘Voor zover eiser (sic) heeft
willen stellen dat de termijnoverschrijding verschoonbaar moet worden geacht, nu het voor
verweerder zonneklaar was dat eiseres niet kon instemmen met het besluit van 21 juli 2011
kan zij daarin niet worden gevolgd.’
En daarmee kon belanghebbende het doen. Was de brief die zij voorafgaand aan het besluit
stuurde een feit op grond waarvan de ontvangst redelijkerwijs kon worden betwijfeld? De
rechtbank komt niet eens met een begin van een motivering op dit punt, maar blaft
belanghebbende met een halve regel af.
Of wel?
In een uitspraak van de Centrale Raad van Beroep van 26 juni 2012 is te zien hoe de Raad het
nieuwe criterium toepast. Belanghebbende stelt in die zaak een besluit niet te hebben
ontvangen en onderbouwt dat door erop te wijzen dat hij de met het besluit meegezonden
akte van schuldbekentenis niet heeft teruggestuurd. Daaraan kan dan de conclusie worden
verbonden dat het besluit hem niet heeft bereikt. Anders dan de Zwolse rechtbank gaat de
Raad gemotiveerd op de stelling in. Al maanden voordat belanghebbende (na ontvangst van
een ander besluit) bezwaar maakte, zat het bestreden besluit bij de stukken in weer een
andere procedure. Belanghebbende heeft vervolgens niet direct bezwaar gemaakt. Ook heeft
belanghebbende, voordat hij bezwaar maakte, in een hoorzitting over weer een ander besluit
(hoera voor de bijzondere bijstand) over het bestreden besluit gesproken. De Raad
concludeert hierop dat de stellingen van belanghebbende niet redelijkerwijs twijfel doen
ontstaan aan de ontvangst van het stuk.
Ontkennen genoeg?
In de twee uitspraken hierboven lijkt een groot verschil te zitten in het feitencomplex. Gaan
we soms toe naar een situatie waarin de rechter de belanghebbende die zich aantoonbaar
vastkletst uitgebreid gemotiveerd afserveert, terwijl een andere belanghebbende het zonder
motivering moet doen?
De uitspraak van de rechtbank Den Haag van 25 oktober 2012 zet de boel op scherp. In deze
uitspraak gaat de rechtbank uitgebreid in op de arresten van de Hoge Raad die de Afdeling in
de hierboven genoemde uitspraak van 10 mei 2011 aanhaalde. De rechtbank verwijst hierbij
naar een arrest van de belastingkamer van de Hoge Raad van 20 mei 2005 (BNB 2006/109;
LJN: AT5917): ‘Het Hof heeft, ervan uitgaande dat het bezwaarschrift niet tijdig is ingediend,
in verband met het bepaalde in artikel 6:11 Awb voorts geoordeeld dat de enkele stelling dat
de aanslag nooit is ontvangen, niet kan leiden tot het verschoonbaar achten van de
termijnoverschrijding. Zo algemeen verwoord vindt dat oordeel echter geen steun in het recht.
Een dergelijke stelling dient te worden beoordeeld op haar aannemelijkheid en afhankelijk van
die beoordeling kan wel of niet een omstandigheid als bedoeld in artikel 6:11 Awb aanwezig
worden geacht.’ Deze nuancering zet de toon.
3. Casus
De minister van Immigratie stelt de aanvraag van belanghebbende buiten behandeling omdat
deze de verschuldigde leges niet binnen de gestelde termijn heeft voldaan. De minister voert
aan dat hij belanghebbende via een acceptgirokaart in de gelegenheid heeft gesteld om binnen
vier weken de verschuldigde leges te voldoen. Op 30 november 2011 heeft de minister
belanghebbende met een aanmaning in de gelegenheid gesteld de verschuldigde leges binnen
een termijn van twee weken te voldoen, hetgeen evenmin tot betaling heeft geleid.
De rechtbank oordeelt dat de minister de verzending van de factuur en de herinneringsbrief
aannemelijk heeft gemaakt.
‘Naar het oordeel van de rechtbank is eiser er vervolgens in geslaagd om het vermoeden van
ontvangst te ontzenuwen. Ter zitting heeft eiser ten overstaan van de rechtbank stellig
verklaard dat hij de acceptgirokaart en de aanmaning niet heeft ontvangen, waarbij de
rechtbank geen aanwijzingen voor ongeloofwaardigheid van die verklaring zijn gebleken.
Verder heeft eiser ter zitting verklaard dat hij in de periode waarin de stukken zijn verstuurd
op het genoemde adres aanwezig is geweest en dat hij geen financiële problemen heeft gehad
waardoor hij de verschuldigde leges niet had kunnen betalen, welke gestelde omstandigheden
door verweerder niet zijn betwist. Verdere onderbouwing of bewijs kan van eiser in de door
hem gestelde situatie niet worden verlangd. Het is in deze situatie derhalve aan verweerder
geweest om de ontvangst door eiser aannemelijk te maken. De rechtbank is van oordeel dat
het door verweerder hiertoe gestelde, namelijk dat eerder door verweerder aan hetzelfde
adres van eiser verstuurde stukken wel zijn aangekomen, onvoldoende is.’
Dat is andere koek dan de rechtbank Zwolle! De rechtbank hanteert hiermee een wel heel
burgervriendelijke lijn. Wat had belanghebbende anders kunnen doen dan ontkennen. Niets?
Dan volstaat ontkenning- daarop komt het oordeel neer.
Vervolg
Ik ga er op voorhand vanuit dat de minister hoger beroep zal instellen. Dan wordt het nog
interessant- in de twee arresten van de Hoge Raad waarnaar de Afdeling verwees, zie ik niet
zo 1-2-3 de ruimte die de rechtbank daar kennelijk in ziet. Zie bijvoorbeeld de conclusie van
de AG bij het door de Afdeling aangehaalde arrest van 10 juli 2009: ‘Vervolgens moet de
geadresseerde omstandigheden aanvoeren op grond waarvan ontvangst of aanbieding
redelijkerwijs moet worden betwijfeld. Dat zou bijvoorbeeld kunnen als het stuk niet voorkomt
in een door de geadresseerde gevoerde registratie van ingekomen post. Maar zonder zo'n
systeem wordt het lastig.’ Heel anders ligt het in een arrest van 25 oktober 2002 waarnaar de
HR verwijst in een van de zaken die de Afdeling aanhaalt: ‘Opmerking verdient nog dat,
anders dan het Hof heeft geoordeeld, voor ontzenuwing van het vermoeden niet is vereist dat
belanghebbende aannemelijk maakt dat de ten name van C gerestitueerde bedragen hem niet
ten goede zijn gekomen; voldoende is dat op grond van hetgeen belanghebbende aanvoert,
redelijkerwijs moet worden betwijfeld of hij die bedragen heeft ontvangen. Nu de bewijslast
niet is omgekeerd, is immers het bewijsrisico blijven berusten bij de Inspecteur, hetgeen
inhoudt dat twijfel blijft werken ten gunste van belanghebbende.’
Als de Afdeling meegaat met de redenering van de rechtbank, kan de enkele ontkenning van
de ontvangst van een stuk vaak voldoende zijn om het vermoeden van ontvangst te
ontzenuwen. Beschikkingenfabrieken als het UWV kunnen zich niet of nauwelijks veroorloven
alles aangetekend te versturen. Acceptatie van het Haagse oordeel door de Afdeling kan er
4. dan toe leiden dat bestuursorganen de ontkenning van de ontvangst van een niet-
aangetekend stuk in veel zaken gaan accepteren. Waarmee we verlost zijn van veel
procedures om het procederen.
2) Alsnog gegevens in bezwaar- behandelen of niet?
Op grond van artikel 4:5 van de Awb kan het bestuursorgaan besluiten een aanvraag niet te
behandelen indien de verstrekte gegevens en bescheiden onvoldoende zijn voor de
beoordeling van de aanvraag of voor de voorbereiding van de beschikking. Hierbij geldt dat de
aanvrager de gelegenheid moet hebben gehad de aanvraag binnen een door het
bestuursorgaan gestelde termijn aan te vullen. In de praktijk van alledag miskennen
bestuursorganen bij het gebruik van deze bevoegdheid regelmatig de link met artikel 4:2 van
de Awb: het gaat om gegevens en bescheiden waarover de aanvrager redelijkerwijs de
beschikking kan krijgen. Een heldere uitspraak van 27 november 2012 van de Centrale Raad
toont wat er gebeurt als het bestuur artikel 4:2 miskent.
Casus
Belanghebbende dient een bijstandsaanvraag in bij het college van B&W van Gouda. Hierop
verzoekt het college aan belanghebbende om binnen tien werkdagen nadere gegevens in te
leveren, waaronder de opeenvolgende bankafschriften van de periode 5 januari 2009 tot 13
maart 2009. Het college deelt hierbij mee dat het de aanvraag niet in behandeling zal nemen
indien de gevraagde gegevens niet (volledig) binnen die termijn in zijn bezit zijn. Binnen de
hersteltermijn laat belanghebbende weten dat hij de bankafschriften op 6 april 2009 zal
nasturen. Op 20 april 2009 stuurt hij de stukken na. Vier dagen daarvoor heeft het college de
aanvraag echter buiten behandeling gesteld. Belanghebbende maakt bezwaar tegen dit
besluit. Het college verklaart het bezwaarschrift ongegrond: belanghebbende heeft de
gevraagde stukken buiten de gestelde termijn ingediend, het college hoefde er niet op bedacht
te zijn dat belanghebbende niet in staat was de stukken tijdig in te leveren, temeer omdat hij
geen verzoek tot uitstel van de termijn had ingediend. Belanghebbende tekent beroep aan
tegen deze beslissing.
Rechtbank
De Haagse rechtbank stelt belanghebbende in het gelijk. Ten tijde van de
buitenbehandelingstelling beschikte belanghebbende niet over de verlangde stukken. Hij kon
hier ook redelijkerwijs niet over beschikken. ‘De buiten behandelingstelling is daarom
gebaseerd op het verwijt dat betrokkene niet tijdig een bankafschrift heeft ingeleverd,
waarvan later is komen vast te staan dat het bankafschrift toen nog niet bestond. Onder die
omstandigheden kan niet worden gezegd dat betrokkene in verzuim is, zodat geen grond
bestaat voor hantering van de bevoegdheid om de aanvraag buiten behandeling te stellen en
het bestreden besluit, voor zover hier van belang, op een feitelijk en juridisch onjuiste
grondslag berust.’
Centrale Raad van Beroep
Het college gaat in hoger beroep en leunt daarbij op zijn beslissing op bezwaar: ook als een
belanghebbende niet over de gevraagde gegevens kan beschikken, kan een bestuursorgaan
de aanvraag toch buiten behandeling stellen als het van belanghebbende mocht verwachten
dat hij tijdig zou laten weten dat hij de gevraagde stukken niet heeft.
De stelling van het college is niet eens zo onaardig bedacht, en uit het oogpunt van efficiënte
inzet van middelen begrijpelijk. Ga er vanuit dat gemiddeld 1% van de primaire besluiten tot
5. een beroepszaak leidt- dan heb je die andere 99 buitenbehandelingstellingen maar vast
binnen en kun je best eens kijken of je tegen wet en jurisprudentie in ook nummer 100 in je
voordeel kunt beslissen. Het hoger beroep leidt echter niet tot succes.
‘Bij artikel 4:5 gaat het, gelet op artikel 4:2, tweede lid, van de Awb, om gegevens die voor de
beslissing op de aanvraag nodig zijn en waarover de aanvrager redelijkerwijs de beschikking
kan krijgen. Niet in geschil is dat de gevraagde gegevens voor de beslissing op de aanvraag
van betrokkene nodig zijn (…) en dat aanvulling niet binnen de aan betrokkene gegeven
termijn heeft plaatsgevonden.
5.3. In bezwaar is komen vast te staan dat betrokkene ten tijde van de aanvraag niet over de
gevraagde bankafschriften beschikte en daarover evenmin de beschikking kon krijgen omdat
die afschriften op dat moment nog niet bestonden. Betrokkene was, eveneens achteraf bezien,
feitelijk ook niet in staat het aan de aanvraag klevende gebrek te herstellen binnen de door
appellant geboden termijn. Dat betrokkene niet binnen de geboden termijn appellant op de
hoogte heeft gesteld van het feit dat hij niet (tijdig) kon beschikken over de gevraagde
bankafschriften en/of een verzoek tot uitstel van de termijn heeft ingediend, is daarom niet
van belang. Appellant had in de bezwaarfase dan ook moeten overgaan tot een inhoudelijke
behandeling van de aanvraag op basis van de op dat moment beschikbare gegevens.’
Toepassing in bezwaarschriftprocedure
De vlieger dat een belanghebbende die niet over de gevraagde gegevens beschikt maar om
uitstel moet vragen om buitenbehandelingstelling te voorkomen, gaat dus niet op. Nuttig is de
heldere overweging over het gevolg: de beslissing op bezwaar wordt vernietigd en in de
nieuwe bob zal het bestuursorgaan alsnog tot beoordeling van de aanvraag moeten overgaan
op basis van de bankafschriften die belanghebbende intussen had verstrekt.
Dit oordeel is conform de vaste jurisprudentie van de hoogste bestuursrechters. Deze is
tweeledig:
• het staat een bestuursorgaan na een buitenbehandelingstelling vrij om in bezwaar
alsnog verstrekte gegevens in de beoordeling te betrekken, tenzij het 4:5 ten onrechte
heeft toegepast;
• het inhoudelijk besluit dat het bestuursorgaan neemt als het in bezwaar alsnog de
gegevens meeneemt, is geen primair besluit maar onderdeel van de bob.
Zie bijvoorbeeld de uitspraak van de Afdeling van 16 juli 2008: ‘Hoewel het bestuur (…) niet is
gehouden ontbrekende gegevens die na het nemen van het primaire besluit alsnog zijn
overgelegd, bij voormelde heroverweging in aanmerking te nemen, staat dit het bestuur wel
vrij. Indien evenwel op onjuiste wijze toepassing is gegeven aan artikel 4:5 van de Awb, dient
het primaire besluit te worden herroepen en dient ex nunc, derhalve met meewegen van alle
alsnog overgelegde gegevens en bescheiden, inhoudelijk op de aanvraag te worden beslist.’
