2. M/s Madhup Agency V/s State of Rajasthan & Ors.
2014
10,710 kgs of plastic bags were seized by
Municipal Council, Bhilwara from the go-down of
the applicant. Manufacture of plastic carry bags had
been banned by the State Pollution Control Board.
However, in the present case, the seized plastic
bags did not come under the definition of banned
plastic carry bags, and hence were returned to the
applicant.

3. Mr. Dharmarajan v. The District Collector Office of
the Collector Office Coimbatore 2013
The applicants filed a complaint against respondent
establishing coir industry which caused noise and air pollution,
damaging the crops on the applicants fields. TNSPCB first
cancelled their licence and ordered closure and gave them 3
months to implement pollution control measures. Matter came
to the tribunal after they failed to do the same. The tribunal,
based on the report submitted by the Board held that
respondent had taken all measures to mitigate dust pollution
and direction was given to monitor the air pollution so as to
ensure that it did not occur again.

4. Yog Raj v. State of Himachal Pradesh & Ors. 2013
The petition was filed in relation to the damage caused to the
houses of the Applicants because of construction and other
activities carried out by the Project Proponent in the
Hydroelectric Project, District Kullu, Himachal Pradesh.
However, the tribunal did not find merits in their objections,
and provided limited relief to them, stating that respondents
were only liable to make repairs to the damage directly
caused by their activity.

5. P. Sasi v. The State of Kerala 2013
The petition had been filed against the nuisance, foul smell
and health hazard caused by release of wastewater from
vehicles carrying fish through NH 17. Tribunal upheld the
interim order passed directing police and transport officials to
prosecute drivers and other persons responsible for the
alleged pollution and implement the action plan given by
KSPCB.

6. Vanashakti Public Trust v. Maharashtra
Pollution Control Board Pune 2013
Case concerned with severe environmental ecological
damage due to illegal discharge of dangerous untreated
effluents, sewage and pollutants in Ulhas River in the Mumbai
Metropolitan Region. The tribunal based on polluters pay and
precautionary principle ordered the CPCB to ensure that
Maharashtra Pollution Control Board takes stringent action
against polluting industries along Ulhas river. Various CETP
and Corporations were directed to deposit specified amounts
for restitution and restoration.

7. P. Chathukutty v. The District Collector,
Waynad District 2014
The application was filed against the opening of new petroleum
outlets which was leading to cutting the trees and hill areas in
fragile wetlands. The respondents have submitted that the Acts
and Rules are being strictly followed and implemented and no
report of removal of hill to construct new petrol bunk. The
tribunal permitted to approve the petroleum outlets with the
condition that it will not be permitted to act against the laws
relating to forests, mountains etc.

8. Samatha Law Society v. Union of India 2013
Case was regarding the discharge of untreated effluents by
industries in a canal, causing pollution. The tribunal gave
directions to complete the process of installing Common
Effluent Treatment Plants in respondents as well as 150 other
small units operating in the area.
