A new mining law by the Indian government will set limits on radioactive content for private mining companies and define relevant leasing areas and concession periods. Recent changes have led to certain minerals being reclassified as atomic minerals, thus restricting private sector involvement. The case against Tamil Nadu's VV Minerals for illegal beach mining is claimed by its owner to be a competitive tactic rather than a legitimate concern.

A new mining law by the Centre will contain new rules
defining the limit of radioactive content beyond, which
private companies will not be allowed to mine. The
concession period and the area to be given out on lease
will also be defined by the same.

The department of atomic energy also regulates minerals
that are below the radio activity threshold to address
concerns relating to health.

Sand mineral mining was in the public sector for nearly
three decades. Certain minerals were de-listed from the
atomic mineral category too allow the entry of private
sector in the business from January 2007. The recent
changes did not follow the same trend and listed llmentie,
rutile, zircon, leucoxene in Part B of the first schedule
(atomic minerals).

Garnet mining was also not allowed by private companies
till the late 1980s after obtaining a no-objection certificate
from the department of atomic minerals. Garnet has
monazite content which is a radioactive mineral. But the
Centre allowed the mining of sand with less than one per

Tamil Nadu-based VV Mineral is India's largest garnet
miner and exporter. These minerals are used in ceramic and
higher technology items. A case filed against VV Minerals
for illegal beach mining and manufacturing and exporting
atomic minerals is back-firing on the accusers.
Vaikundarajan, the owner and Managing Director of VV
Minerals claimed that this was only a ploy by the
competitors and VV Minerals will come clean out of it.
