Hareram Uikey abovenamed plaintiff begs to state as follows –
1. That defendant no.2 was the original owner of the house no.16
,Subhas nagar , Indore measuring 2400 square ft.
2. On 18th October 2011 plaintiff purchase a shop pf northern side
measuring 230.62 square ft. and on 18th October 2011 defendant no.2
purchase remaining portion of the house. Plaintiff & defendant no.2
were the tenant of the defendant no. 1 before purchase said
portions of the main house.
3. That the cause of action arose on 27-07-2012 in the evening
defendant no.1 warn to plaintiff for not opening northern side two
shutters and tried to construct boundary wall .
4. Plaintiff tried to peacify without success then file the suit for
permanent injunction against defendant no.1, after notice defendant
no .1 submitted his written statement and defendant no.2 remain
absent .consequently defendant no.2 declared exparte .
