Kuluttajat, elinkeinonharjoittajat, mainontaan liittyviä kysymyksiä käsittelevät järjestöt ja viranomaiset voivat pyytää lausuntoja. Esim. kun aikaisempi vakiintunut ratkaisukäytäntö osoittaa, ettei tietyn tyyppinen mainonta ole hyvän markkinointitavan vastaista. Neuvosto voi antaa elinkeinonharjoittajan pyynnöstä myös ennakkolausuntoja (1 500 €).

15. Hyvää markkinointitapaa koskevat periaatteet 2. Mainos on hyvän markkinointitavan vastainen, jos siinä väitetään tai vihjataan, että toisen sukupuolen asema on sosiaalisesti, taloudellisesti tai kulturellisesti alempiarvoinen kuin toisen, tai jos mainoksessa ylläpidetään kaavamaista roolikäsitystä siitä, mikä on tyypillistä tai tunnusomaista naisille tai miehille tai heidän persoonallisuudelleen tai työskentelylleen.
