Dear Mayor Caldwell:
Thank you for nominating me to the Zoning Board of Appeals. I was honored that you chose me
for that important position and I looked forward to doing good job. However, in light of the opposition
to my nomination expressed by several month-to-month lessees of Continental Pacific LLC (“CP”), I feel
it is best that my name be withdrawn from consideration.
As the lawyer for CP, it is going to be my job to explain the facts relating to the Kahuku Village
project to councilmembers, the press and the public. Because the month-to-month lessees’ complaints
are now an issue in my ZBA candidacy’ there will inevitably be confusion about whether I am acting on
behalf of my own ZBA candidacy or on behalf of my client. I feel that this blurring of roles is not in the
interest of CP and I therefore feel I must ask that my name be withdrawn.
Thank you again for the confidence you showed in nominating me. I would be honored to serve
your administration at some time in the future.

‘Wrongly, think. As I testified before the Zoning and Planning Committee, the chances are extremely remote
that any issue regarding Kahuku Village would come before the ZBA, and if it did I would obviously be recused.
