L1 Blanket and How to Qualify.
L1 Blanket unlike the regular L1A visa requires a pre-qualification for companies to
intra-transfer their employees to the United States. Once the company is “pre-
qualified”, then the company can actually bring several L1 employees on the same
petition. This slide will cover -
 When and How Does a company Qualify for the L1 Blanket?
 What is required to be approved?
 What happens once the employer is approved or certified for the L1 blanket
certification.
 Where the L1 employee can obtain their visas to come to the United States.
 Options for Canadians whose company is qualified for L1 Blanket.
 Optional filing of Form I-129S with USCIS
In order to qualify for the L1 Blanket the company has to:
The petitioner and
each of the
qualifying
organizations are
engaged in
commercial trade or
services;
#1
The petitioner has an
office in the United
States which has been
doing business for one
year or more;
#2
The petitioner has
three or more
domestic and
foreign branches,
subsidiaries, and
affiliates; and
#3
In addition to the 3 conditions above - One additional
criteria among the 3 below should be present:
• Have obtained at least 10 L-1
approvals during the previous
12-month period;
• Have U.S. subsidiaries or
affiliates with combined
annual sales of at least $25
million; or
• Have a U.S. work force of at
least 1,000 employees.
ONCE THE L1 BLANKET IS
APPROVED THE EMPLOYEE NOW
NEEDS TO BE APPROVED
Although the L1 blanket simplifies the process for companies, their employee candidate do still
have to go the US consulate processing or an additional USCIS processing in order to qualify as
an L1 candidate.
THE L1 CANDIDATE MUST HAVE WORKED FOR THE FOREIGN COMPANY
FOR 1 YEAR IN THE PAST 3 YEARS JUST LIKE IN THE REGULAR L1. FOR
L1A CANDIDATES, THEY HAVE TO PROVE THEY WERE IN A MANAGERIAL
OR EXECUTIVE CAPACITY. AS FOR L1B, THE EMPLOYEE HAS TO
DEMONSTRATE HE/SHE HAS MET THE REQUIREMENTS OF A UNITED
STATES BACHELOR DEGREE OR US EQUIVALENT OF A BACHELOR’S
DEGREE AND WILL BE WORKING IN AN SPECIALTY OCCUPATION.
THE L1 EMPLOYEE CANDIDATE STILL HAVE TO PROVE
THAT THEY MEET THE REQUIREMENTS OF AN L1
EMPLOYEE.
How is the L1 Blanket employee supposed to apply?
In most cases, once the blanket petition has been approved, the employer need only complete
Form, I-129S,Nonimmigrant Petition Based on Blanket L Petition and send it to the employee
along with a copy of the blanket petition Approval Notice and other required evidence, so that the
employee may present it to a consular officer in connection with an application for an L-1 visa.
Other Options for Applicants
 If the prospective L-1 employee is visa-
exempt, the employer may file the Form I-
129S and supporting documentation with the
USCIS Service Center that approved the
blanket petition, instead of submitting the
form and supporting documentation directly
with CBP.
For Canadian Citizens:
He or she may present the completed
Form I-129S and supporting
documentation to a U.S. Customs and
Border Protection (CBP) Officer at certain
ports-of-entry on the United States-
Canada land border or at a United States
pre-clearance/pre-flight inspection
station in Canada, in connection with an
application for admission to the United
States in L-1 status.
Once satisfied, the CBP officer will
actually issue the visa stamp on the
passport for entry.
