Mental health has been in the news quite a bit lately. Dozens of U.S. states are currently suing Meta for contributing to the youth mental health crisis by inserting addictive features into their products, while the U.S. Surgeon General is touring the nation to bring awareness to the growing epidemic of loneliness and isolation. The country has endured periods of low national morale, such as in the 1970s when high inflation and the energy crisis worsened public sentiment following the Vietnam War. The current mood, however, feels different. Gallup recently reported that national mental health is at an all-time low, with few bright spots to lift spirits.
To better understand how Americans are feeling and their attitudes towards mental health in general, ThinkNow conducted a nationally representative quantitative survey of 1,500 respondents and found some interesting differences among ethnic, age and gender groups.
Technology
For example, 52% agree that technology and social media have a negative impact on mental health, but when broken out by race, 61% of Whites felt technology had a negative effect, and only 48% of Hispanics thought it did.
While technology has helped us keep in touch with friends and family in faraway places, it appears to have degraded our ability to connect in person. Staying connected online is a double-edged sword since the same news feed that brings us pictures of the grandkids and fluffy kittens also feeds us news about the wars in Israel and Ukraine, the dysfunction in Washington, the latest mass shooting and the climate crisis.
Hispanics may have a built-in defense against the isolation technology breeds, owing to their large, multigenerational households, strong social support systems, and tendency to use social media to stay connected with relatives abroad.
Age and Gender
When asked how individuals rate their mental health, men rate it higher than women by 11 percentage points, and Baby Boomers rank it highest at 83%, saying it’s good or excellent vs. 57% of Gen Z saying the same.
Gen Z spends the most amount of time on social media, so the notion that social media negatively affects mental health appears to be correlated. Unfortunately, Gen Z is also the generation that’s least comfortable discussing mental health concerns with healthcare professionals. Only 40% of them state they’re comfortable discussing their issues with a professional compared to 60% of Millennials and 65% of Boomers.
Race Affects Attitudes
As seen in previous research conducted by ThinkNow, Asian Americans lag other groups when it comes to awareness of mental health issues. Twenty-four percent of Asian Americans believe that having a mental health issue is a sign of weakness compared to the 16% average for all groups. Asians are also considerably less likely to be aware of mental health services in their communities (42% vs. 55%) and most likely to seek out information on social media (51% vs. 35%).

użytkowników w Polsce. Pominię-
cie tego kanału komunikacji w działaniach
właściciela apteki to poważny błąd wpły-
wający na główny cel biznesowy przedsię-
biorstwa. Nie chodzi tutaj o zamieszczanie
ofert na Facebooku (co jest zabronione
przez prawo farmaceutyczne), ale o wy-
pełnianie misji zawodu farmaceuty zgod-
nie z Kodeksem Etyki Aptekarza Rzeczypo-
spolitej Polskiej.
Serwis społecznościowy Facebook,
wraz z narzędziami reklamowymi, umoż-
liwia precyzyjne przygotowanie działań
marketingowych nawet przy niewielkich
budżetach reklamowych. Szczegółowa
segmentacja odbiorców i docieranie
z przekazem do grupy docelowej sprawia-
ją, że Facebook jest w chwili obecnej waż-
nym narzędziem marketingowym dla far-
macji ze względu na prostotę komunikacji
z pacjentem i wiarygodność przekazu.
Aspekty prawne wprowadzają wiele za-
mieszania w działania reklamowe aptek.
Dotychczasowe kary w większości przy-
padków odwoływały się do reklam trady-
cyjnych. Nie ma dokładnej interpretacji
prawnej dotyczącej mediów społeczno-
ściowych. Według prawników i Główne-
go Inspektoratu Farmaceutycznego two-
rzenie wartościowych treści przez apteki
na Facebooku nie jest łamaniem prawa
farmaceutycznego.

Według najnowszych danych serwisu
Statista.com na świecie jest ponad 2 mi-
liardy aktywnych kont na Facebooku1
.
Ta platforma internetowa zrewolucjo-
nizowała rynek mediów społecznościo-
wych i jest ważnym kanałem komunikacji
z klientem (pacjentem).
W polskiej wersji językowej portal
Facebook istnieje od maja 2008 roku2
.
W Polsce działa prawie 15 tysięcy aptek i punktów aptecznych, w tym 280 aptek prowadzi
sprzedaż wysyłkową. Zdecydowana większość nie ma swojej strony na Facebooku. Proble-
mem są ograniczenia w prawie farmaceutycznym (zgodnie z art. 94a) dotyczące zakazu
reklamy tych placówek. Sytuacja może wydawać się kuriozalna, bo przecież w offline widać
„reklamy” aptek, np. w postaci bezimiennych (nie zawierających danych apteki) gazetek
z ofertą handlową i promocjami. Niektóre apteki mogą tak robić, ponieważ posiadają rów-
nież drogerie w tym samym punkcie. Wtedy zakaz nie obowiązuje. Problemem może być
również nieznajomość lub znikoma wiedza z obszaru działań na Facebooku.

przeciętnie godzina każdego dnia4

lionów internautów przegląda informacje
na Facebooku za pomocą smartfonów5
.
Urządzenia mobilne w coraz większym
stopniu wypierają komputery stacjo-
narne. Według prognoz eMarketer
w 2020 roku liczba użytkowników
smartfonów ma przekroczyć 22 mln6
.
Zakaz reklamy aptek w prawie
farmaceutycznym
Według danych na 6 września, w Polsce
działały 13 524 apteki, w tym 280 placó-
wek, które prowadzą sprzedaż wysyłkową,
czyli apteki internetowe7
. Ile z tych aptek
prowadzi stronę na Facebooku? Ograni-
czenie prawne spowodowały, że farma-
ceuci boją się surowych kar nakładanych
przez GIF. Jest to jeden z głównych powo-
dów nieistnienia większości aptek w me-
diach społecznościowych.
Z początkiem 2012 r. wszedł w życie
całkowity zakaz reklamy aptek. Zgodnie
z art. 94a ust. 1 ustawy prawo farmaceu-
tyczne z dnia 6 września 2001 r. (Dz. U.
z 2008 r., nr 45, poz. 271, ze zm.), zabro-
niona jest reklama aptek oraz ich działal-
ności, przy czym ustawodawca wyraźnie
wskazał, że nie stanowi reklamy informa-
cja o lokalizacji i godzinach pracy apteki.
Zgodnie z art. 129b ust. 1 prawa farma-
ceutycznego naruszenie zakazu reklamy
aptek zagrożone jest karą administracyjną
w wysokości do 50.000 zł.
Do tej pory w kręgu zainteresowań In-
spektoratu farmaceutycznego znajdowa-
ły się działania reklamowe prowadzone
metodami tradycyjnymi i w małym stop-
niu na stronach internetowych aptek.
Media społecznościowe prawie w ogóle
nie były przedmiotem rozstrzygnięć.
Interpretacje prawne działań
reklamowych aptek
Naczelny Sąd Administracyjny przyjmuje,
że reklamą działalności apteki jest zamiar
przyciągnięcia potencjalnych klientów
do dokonania zakupu towarów sprzeda-
wanych w aptece, niezależnie od form
i metod jej prowadzenia oraz użytych
do jej realizacji środków, jeśli jej celem
jest zwiększenie sprzedaży produktów
leczniczych lub wyrobów medycznych
(wyrok NSA z dnia 19 listopada 2014 r.,
sygn. akt II GSK 1716/13). Definicja ta jest
bardzo szeroka8
.
Radca prawny Pan Tymoteusz Cieślicki
z kancelarii MGTC Legal w ten sposób od-
niósł się do zapisów w ustawie o prawie
farmaceutycznym dotyczących działań
aptek w Internecie i mediach społeczno-
ściowych:
…w mojej opinii dopuszczalne powinny
być działania content marketingowe, nie-
zorientowane bezpośrednio na sprzedaż
– tj. tworzenie przez aptekę interesują-
cych materiałów o tematyce farmaceu-
tycznej lub szerzej – związanej ze zdro-
wiem, np. artykułów, porad, infografik,
materiałów wideo, i zamieszczanie ich
bezpośrednio w mediach społecznościo-
wych lub też na własnej stronie interne-
towej wraz ze stosownymi linkami w me-
diach społecznościowych. Istotne jest to,
aby treści te nie dotyczyły apteki ani jej
produktów, a tym samym, aby nie mo-
gły zostać uznane za zachętę do zakupu.
Jeśli materiały tego typu będą zawarte
na stronie e-apteki to wydaje się, że za-
kazaną reklamą byłoby np. zamieszczanie
w bezpośrednim sąsiedztwie takich infor-
macji o produktach, których zastosowanie
odpowiada tematycznie treści materiału9
.
Pani mec. Paulina Kieszkowska-Knapik
w rozmowie z serwisem NaZdrowie.pl tak
zinterpretowała zapis w ustawie:
…apteka może podejmować każde działa-
nie informacyjne, które nie jest reklamą…
Nie zgadzam się z tymi, którzy interpre-
tują zakaz reklamy aptek wprowadzony
przez ustawę refundacyjną jako zezwo-
lenie wyłącznie na wskazanie lokalizacji
oraz godzin otwarcia apteki. To absurdal-
na interpretacja, kompletnie oderwana
od prawa pacjenta (konsumenta) do wie-
dzy o nazwie apteki, a przede wszystkim
o jej ofercie cenowej, zwłaszcza w zakre-
sie produktów nierefundowanych, których
ceny są zróżnicowane10
.
Z powyższych wypowiedzi wynika,
że według prawników działania mające
charakter edukacyjny nie stanowią naru-
szenia prawa farmaceutycznego. Mimo
wszystko informowanie o cenie w me-

diach społecznościowych jest dość ryzy-
kowne i na wszelki wypadek warto po-
minąć ten element przy tworzeniu treści
na Facebooka.
Według podmiotu kontrolującego,
czyli GIFu: „Reklamą działalności apteki
jest działanie polegające na zachęcaniu
potencjalnych klientów do dokonywania
zakupu usług farmaceutycznych w kon-
kretnej aptece lub punkcie aptecznym.
Każde działanie, skierowane do publicznej
wiadomości, niezależnie od sposobu i me-
tody jego przeprowadzenia oraz środków
użytych do jego realizacji, jeśli jego celem
jest zwiększenie sprzedaży produktów
leczniczych i wyrobów medycznych ofe-
rowanych w danej aptece”11
.
Główny Inspektorat Farmaceutyczny
uznaje informowanie przez apteki pacjen-
tów o profilaktyce zdrowia i chorobach.
Jednakże materiały nie mogą zawierać
oferty handlowej12
.
Działania w mediach społecznościo-
wych nie zostały sprecyzowane w aspek-
cie prawnym i nie ma również orzecznic-
twa sądów, co do reklamy aptek w tych
kanałach. GIF już zauważył to zjawisko
i powoli zabiera się do kontroli, a ryzyko
zapłaty wyższych kar jest znacznie więk-
sze właśnie w Internecie, ponieważ zależy
od okresu, w jakim te działania były pro-
wadzone. Dodatkowo fakt, że 95% spraw
w sądach administracyjnych zakończyło
się wygraną nadzoru może odstraszać
farmaceutów13
.
Rzecznik głównego inspektora farma-
ceutycznego, Pan Paweł Trzciński, odniósł
się do działań aptek w mediach społecz-
nościowych:
– W najbliższym czasie z urzędu przyj-
rzymy się działalności aptek w mediach
społecznościowych. Reklama jest rekla-
mą niezależnie od miejsca, w którym się
znajduje, a apteki mają ustawowy zakaz
jej stosowania… Jednocześnie uspoka-
jam, że nie mamy zastrzeżeń do tych, któ-
rzy wykorzystują media społecznościowe
do rzeczywistej opieki farmaceutycznej.
Jako łamanie prawa traktujemy jedynie
działalność zmierzającą do zwiększenia
obrotów apteki14
.
Nie ma jasnego orzecznictwa
w sprawie aptek na Facebooku. Jeden
z wyroków Łódzkiego WIFu (decyzja
Nr 4/REKLM/2016) nałożył karę na dzia-
łania apteki w serwisie społecznościo-
wym Facebook. W uzasadnieniu czytamy,
że na profilu apteki zostały przedsta-
wione produkty lecznicze i suplemen-
ty diety wraz z linkiem do strony www,
na której można zakupić oferowane pro-
dukty. Nałożona kara wyniosła 2 tysiące
złotych. Oczywiście w tym przypadku
właściciel apteki bezwzględnie naruszył
art. 94a ust.1.
Jest to jedyny wyrok, jaki został
nałożony na aptekę za jej działania
na Facebooku. Apteka mogłaby go unik-
nąć, gdyby przekazywała na profilu treści
związane z ochroną zdrowia, profilaktyką
i opieką farmaceutyczną, czyli wszystko
co nie jest widocznie powiązane z produk-
tami dostępnymi w jej ofercie.
Serwis Facebook również w swoim
regulaminie reklam uwzględnia apteki
stacjonarne, jak i internetowe: „Reklamy
nie mogą promować sprzedaży lekarstw
dostępnych na receptę. Reklamy aptek
internetowych, jak i działających poza
Internetem, są dozwolone wyłącznie
po uzyskaniu pisemnej zgody”15
.
Zapis w regulaminie Facebook jest
zgodny z polskim prawem farmaceutycz-
nym. W przypadku złamania regulaminu
strona apteki może zostać zawieszona
lub usunięta. Nie było jeszcze takiego
przypadku w Polsce, ale w innych bran-
żach Facebook potrafi zamykać strony ła-
miące regulamin, zazwyczaj na podstawie
zgłoszeń użytkowników lub podmiotów
konkurencyjnych.
Apteka może pozycjonować się
w Google, dzięki temu osiąga wyższe po-
zycje w wynikach wyszukiwania, co pro-
wadzi do zwiększenia liczby wizyt na stro-
nie i tym samym sprzedaży. Oferta apteki
również może być dostępna na porówny-
warce cenowej i promować się jako naj-
tańsza, poprzez ustawienie najniższej ceny
produktu ze swojego asortymentu. Bio-
rąc pod uwagę fakt, że Ceneo miesięcz-
nie notuje prawie 7 mln użytkowników16
to obecność oferty apteki w takim serwi-
sie można traktować jako formę reklamy.
Specjalistyczne doradztwo w zakresie
szeroko pojętej opieki zdrowotnej nale-
ży do misji zawodu farmaceuty. Kontakt
z pacjentem jest bardzo ważny z punktu
widzenia ochrony zdrowia. Farmaceuta
tuż po lekarzu jest osobą, która w naj-
większym stopniu wpływa na zachowanie
pacjenta, dlatego każda forma komunika-
cji merytorycznej powinna być możliwa
bez obaw o konsekwencje prawne.
