International responses to conflict and complex humanitarian emergencies are diverse and multifaceted. Different actors – among them non-government organisations (NGOs), the United Nations (UN) protection mandated organisations, UN peacekeeping forces, both military and police – all have a role to play to mitigate the impact of armed conflict on civilian populations.
Over the last 13 years a significant amount of work has been done to improve the international community’s response in relation to the protection of civilians (POC). This has been led by different actors – the UN Security Council, the Department of Peacekeeping Operations (DPKO) and the humanitarian community made up of UN humanitarian agencies, the International Committee of the Red Cross (ICRC), and NGOs – all working in the same complex humanitarian contexts.
Despite the development of POC, there is a perceived ‘disconnect’ between the understanding of different forms of protection, the different disciplines practising or working on the POC, and the different guidance and legal regimes imposing obligations on both state and non-state actors in the area of protection.
This paper is the first contribution to a broader research project that aims to determine whether the perceived disconnect between actors involved in protection work is real or anecdotal. By exploring the evolution of protection language and policy through the UN Security Council, DPKO and the humanitarian community, it is possible to develop an improved understanding of some of the reasons for distinct protection policies and definitions that exist between different actors. Some initial variations in the interpretation of POC are quick to emerge, giving rise to additional questions about how the distinctions can be better understood.
The EUI seminar focus on the legal framework in Europe regarding whistle-blowing, leaking confidential information, “illegal” newsgathering and protection of journalistic sources. In its Recommendation 1916 (2010) on the protection of whistle-blowers, on 29 April 2010, the Parliamentary Assembly of the Council of Europe, referring to its Resolution 1729 (2010) on the protection of whistle-blowers, has stressed the importance of whistle-blowing as a tool to increase accountability and strengthen the fight against corruption and mismanagement.

In recent decades, armed conflict has blighted the lives of millions of civilians. Serious violations of international humanitarian and human
rights law are common in many armed conflicts. In certain circumstances, some of these violations may even constitute genocide, war crimes or crimes against humanity.
In the past 20 years, Governments, rebels, politicians, diplomats, activists,
demonstrators and journalists have referred to international humanitarian
law and human rights in armed conflicts. They are regularly referred to
in United Nations Security Council resolutions, in United Nations Human
Rights Council discussions, in political pamphlets of opposition movements,
in reports of non-governmental organizations (NGOs), in the training of soldiers and in diplomatic discussions. International human rights law and international humanitarian law are now important parameters for many
military commanders, advised on the ground by lawyers. Finally, they
are often referred to by defence lawyers and prosecutors in international
and—to a still limited extent—domestic tribunals, and form the basis for
well-reasoned verdicts.
International human rights law and international humanitarian law share
the goal of preserving the dignity and humanity of all. Over the years, the
General Assembly, the Commission on Human Rights and, more recently,
the Human Rights Council have considered that, in armed conflict, parties to the conflict have legally binding obligations concerning the rights of
persons affected by the conflict. Although different in scope, international human rights law and international humanitarian law offer a series of protections to persons in armed conflict, whether civilians, persons who
are no longer participating directly in hostilities or active participants in the conflict. Indeed, as has been recognized, inter alia, by international and
regional courts, as well as by United Nations organs, treaty bodies and human rights special procedures, both bodies of law apply to situations of armed conflict and provide complementary and mutually reinforcing protection.

Lo scritto della Prof. Ida Caracciolo, contenente un'analisi giuridica del Trattato, fa parte di un volume pubblicato in occasione del quarantennale della stipula dell'Accordo in oggetto, inserito nella collana del CISR (Centro Italiano per lo Sviluppo della Ricerca) diretta dal Prof. G. de Vergottini.

In particolare, lo studio vuole accertare l’influenza che i Giudici di Strasburgo hanno avuto sulla concettualizzazione del principio del giusto processo in rapporto alla giustizia penale internazionale; inoltre intende appurare fino a che punto gli standard del giusto processo, validi per i giudici interni, lo siano anche per un giudice internazionale come la Corte penale.

3. The Series mainly consists of studies on International Humanitarian Law and
on the Law of Armed Conflict and it is sponsorised by the Center for the Higher
Defence Studies, which is the most important school for the advanced training
of the Italian Armed Forces and for the promotion of analysis on international
security in Italy. The Series aims at divulging not only scientific studies on Inter-
national Humanitarian Law and the Law of Armed Conflicts but also informative
volumes taking into account the more operative necessities of the Italian Armed
Forces. Therefore particular interest is given to traditional topics concerning the
