Introduction
The United Nations guiding principles UNGP on business and human rights is the
document containing instructions governing the United Nations States and UN-oriented
companies. It addresses and saw abuses relating to basic human rights and business operations.
This document lays out this is for determining the responsibility that corporate firms have
regarding any human rights violation (Bonnitcha & McCorquodale, 2017). This document
consists of two different concepts that organizations must take under consideration for further
review. Firstly, the country of possible risks at business and secondly, the guidelines required to
release a task (Bonnitcha & McCorquodale, 2017).
These concepts provide the basis that a state can use to conduct and supervise the actions
of corporate firms to avoid human rights violations. It provides States with a basis to exercise
authority against corporate involvement in human rights violations (Ruggie & Sherman 2017).
However, these concepts create a sense of skepticism regarding what point of time and if the
business should be compelled to solve human rights violations (Ruggie & Sherman 2017). The
possibilities and limitations of the United Nations guiding principles on business and human
rights in serving NGOs are evaluated, taking amnesty as an example.
Amnesty International is a UK-based non-governmental organization focused solely on
the enforcement of human rights and highlighting cases of violation of human rights. It was
founded by Peter Benenson and Eric Baker in 1961 and had its headquarters in the London
United Kingdom. Amnesty international is responsible for highlighting major violations of
human rights and has actively participated and partnered with the government to ensure more
efforts are put in ensuring the observance of human rights.
Discussion
According to the UNGP of business and human rights, any business, whether big or
small, is supposed to acclaim human rights (equityhumanrights.com, 2019). The UNGP
guidelines create the assumption that the main course of legal uncertainty in law enforcement is
the connection between human rights due diligence and corporate responsibility (Bueno &
Bright, 2020). Business firms should locate and evaluate the factors that negatively affect human
rights. They should also take measures upon the discovery by taking switchable actions to stop
the developing human rights impact. These actions vary according to whether the activities,
products, or services of the concerned business firms are the sole cause of the impact or the
operations partly contribute to the impact (Bueno & Bright, 2020).
There is always an ongoing debate referring to businesses and human rights (BHR) to
Mark the human rights disputes and aged by the business firms. According to the policy, large
multinational companies hold responsibility for their international activities and reduce the risks
of violating and infringing universal human rights (Wettstein et Al., 2019). Large MNCs are also
supposed to address human rights issues since the economic and constitutional power could
oppose the government bodies (Wettstein et Al., 2019). According to the human rights principle
for companies by amnesty international, the company should take responsibility for their
operations to promote and uphold human rights standard implementation and monitor their
human rights policies.
There is an argument regarding the role of business and human rights. Some schools of
thought believe that businesses should take responsibility for their activities and their impact on
human rights when another school of thought believes that business activity may influence
human rights violations. Still, it is not directly the responsibility of any international Business.
Despite these arguments, human rights have not played a distinct role in establishing the impact
of the benefits searches investments, and trade international businesses gain (Wettstein et Al.,
2019). Currently, business management has started to combine the aggressive governmental, and
social expect globally. The majority of MNCs and small business enterprises have disagreed that
the existing law provides lucidity and solvency for corporate human rights obligations
(Pietropaoli, 2020). These big and small enterprises have agreed that the law does not provide
legitimate convictions about which techniques are required to keep away legal risks for human
rights exploits (Pietropaoli, 2020). Some researchers still agree that in the free market economy,
the social duty of business is only to maximize profits for their shareholders (Deva, 2020).
Corporate social responsibilities (CSR) are now being used as a kid to hide the self-interest of
their actions (Deva, 2020). Direct, definite human rights duties are the fundamental public
responsibilities of public bodies (Wettstein et Al., 2019). The extension of human Rights
responsibility to global corporations serves as an addition to corporate duties into the public
domain bodies (Wettstein et Al., 2019).
The UNGP misconstrued on these three components: the obligatory commitment of the
state to protect vulnerable individuals from infringement of human rights by several business
enterprises, social duties of business firms to prove human rights, and proving an effective
solution for victims in human rights infringements (Simons & Handi, 2019). These guidelines
may not be congruous with the reality of the women affected by several business activities
searches for resource extraction (Simons & Handi, 2019). The guiding concept of excluding
women's way of knowing had promoted women in feminist diplomacy to review the intra-
household acts and attempt their domestic labor division. The UNGP provides worldwide, and
private structures that stick better are women. Extensive mining and oil gas projects' direct or
indirect impacts remain differentiated from men's (Simons & Handi, 2019). Several scholarly
articles have already mentioned violence against women, specifically sexual violence referring to
resource extraction (Simons & Handi, 2019).
An unexplainable gap referring to the acceptance of disabled people in the workplace is
compared to people without disabilities. Disabled people feel biased with lower job certainty,
less job pliability, pessimistic management views, and workfellow relations (Schur et al., 2017).
The statistics show around 34% of disabled people are employed in 2015 compared to 75% a
month rate of people without disabilities which depicts the human right violation for people
living with disabilities who are supposed to receive an allowance based on their disability (Schur
et al. 2017). People living with disabilities have aloha job security, and alone earning from their
salaries, they also do not have a high chance of raining employee benefits searches, health
insurance, and pension plans, amplifying the human rights violation against them (Schur et al.
2017).
We are even less likely to participate in corporate workshops or training and participate in
workplace decisions. There are strict orders to follow the UN guiding principles. Disable people
still feel biased and are more likely to get employed in part-time jobs or any such 9th standard
job without the privilege of and having flexible hours (Schur et al. 2017). Amnesty International
has asked the state parties to provide effective records for the rights of the disabled person to
education.
Corporate business impacts the lives of children in various direct and indirect ways.
Children are dependent on workers or might also be young workers themselves. Being a part of
the community, they come into contact with the private sector's business in their day-to-day life.
But business enterprises could adversely affect the lives of the children and negatively influence
children's rights (ihrb.org, 2018). There are several cases of child labor where children
prominently like a voice to share their experiences and r even really consulted in business
decisions. Amnesty international regularly highlight child victims of human rights such as
political killings and torture and adjust the government for juvenile justice for children in the
community family an armed conflict.
According to Schur et al. (2017), the indigenous people who suffer from discrimination
throughout the world are specifically oppressed and marginalized, and exploited. The UN
guiding principles state that any company should incorporate principles that ensure the upholding
of the human rights of indigenous people. The organizations need to prepare seminars and
workshops to educate the indigenous people on their organization practices on the indigenous
groups. These activities should be conducted in languages are the indigenous group can
understand and should also completely incorporate the impact of the companies’ actions on the
rights of the indigenous group. For an organization to be considered conducting due diligence in
upholding indigenous communities' human rights, it needs to involve the community in every
phase of implementing the organization's project.
The involvement of this community is in every stage and shows us the survival of the
organization by creating trust between the organization and these communities. The United
Nations guidelines for business and human rights also burden the government to ensure that the
rights of the indigenous people are respected. The government is expected to provide solutions in
cases where these communities claim exploitation. It is also tasked with enforcing policies set up
in the business sector, especially when the business enterprises create policies that are not
binding. The state is responsible for ensuring that people are aware of their rights and ensuring
that businesses are aware of the consequences of human rights violations and the victims of
human rights violations. The government has to lay a clear and versus an organization in
educating their personals on how to engage in dialogues to notice and report any form of human
Rights violation as early as possible to minimize the impact on the society.
Denying public support to organizations with a history of human rights issues is also
another forcing method. The state can punish organizations by not providing government support
for organizations that have been guilty of violating human rights. And sharing that registration
and policies are appropriately designed to punish human rights violations is legally enforcing a
company to operate with human rights in consideration. Amnesty International has been working
for human rights and focusing on prevention as the NGO called out for businesses to introspect
their workspace and methods.
Accountability helps businesses while eating rights to be held accountable by the state.
Remedies must be provided to the victims of abuse and possibly judicial support. Amnesty also
encourages the use of the law beyond borders to enforce the regulations, possibly if needed,
especially when they are not seriously considered. These authorities' and corporations' efforts can
help curb human rights violations in the business sector (amnesty.org, 2019).
Technology and business are an ever-growing culture in the modern world. Both are
positively independent. The advent of technology has informed the way of business around the
world. Technologies like artificial intelligence and robotics have significantly reduced the board
on organizations and have increased Prophets. The expansion of the internet has increased
business opportunities for all. But the internet has also made people aware of certain things they
were not aware of before. Internet expansion has led people to be aware of their choices and
rights. Human rights was not a well-known term around the globe before the internet.
Marginalized communities generally have limited access to the internet but have certainly
become aware of their rights. Technology has inspired human beings to access the year rights
fully. Social networks allow the activist to create communities and spread messages faster and in
more detail. Technology also severely impacts the future of employees in business as it is
replaced by it. The workers' rights we'll take it all in such cases. The increase in technological
advancement complicates jobs for many people increasing wages and increasing social
inequality (amnesty.org, 2019). According to amnesty.org, (2019), social workers have also given
people the power to highlight the injustices in various parts of the world. Using the press, they
help people to understand how far the rules of human Rights violence go.
There can be a change in the work environment by educating the Next Generation on the
harmful impacts of such acts of infringement of human rights. Amnesty international users’
technology to identify the distractions of Human Rights across the globe. It introduced the "toxic
Twitter" campaign, which is supported by machine learning services for understanding the extent
of abuse against women on Twitter (amnesty.org, 2019). Human rights are related to businesses
but not in a desirable manner. Throughout history, there have been violations of human rights in
industries.
A good example would be the human rights violation in the Philippines. Many industries
have not taken care of their employees and eating first the UN to issue "un guiding principles on
business and human rights" (ohchr.org, 2019). This suggested a lot of reforms at the workplace is
to enhance the state of human rights. From a broader perspective, the UN guidelines are
important and necessary for the point of time. But the failure of the guidelines to be legally
binding imposes a huge task on the States. States with prevalence in human rights violations
have to go through different methods and apply different measures according to the country. This
can cause hindrances in actually affecting the guidelines issued by the UN. Some countries do
not pay heed to these reforms and are more comfortable in business is continuing with their
practices. Many workforces needed to enforce this guideline properly, and some states feel much
better without them.
According to Wettstein et al. (2019), human rights are unconditional and equal for each
person in the world. It should hold irrespective of the domestic roles of foreign regulations.
Corporations must consider this as their responsibility and work to ensure these laws are taken
care of. The making runs by the state of the human rights and considers them a task too big to be
taken care of is incompetence. There are many countries where income inequality has an
increasing trend due to the mistreatment of the workers for the organizations to reap the benefits.
These situations are a cause of concern for people worldwide; ignoring the moral responsibility
to support victims is just as terrible as being the perpetrators.
According to Rivera (2019), human rights are now being mainstreamed in the global
corporate business world, making public policies essential in government functions and ensuring
the legal obligation of human Rights by legislation action official. The national action plan has
emerged as the first recommended step to implement the UNGP. Various countries are now using
the national action plans to fulfill their international commitments and run through them to stop
European commission has already proposed to develop action plans as part of regional policy
objectives (Rivera, 2019). The basic idea behind NAPs is the measures to fill the central and
legislative gaps through which corporate businesses influence human rights negatively.
The public policies must be defined clearly concerning politics, and policy for staff
politics refers to the potential that validates public strength. The policy indicates action as a base
of rational decisions. These policies are expanded upon to mark the specific issues faced by
different companies. Flexible oil companies have developed several policies and undergo certain
practices that ensure personal safety in or near the oil facilities (Rivera, 2019)
Conclusion
Based on the above information, there is enough ground to clearly understand how
communities, governments, and people get affected by the violation of human rights. The NGOs
trying to protect these rights have adverse effects for stop businesses that do not adhere to UNGP
her first serious legal consequences to hold them accountable. Sometimes these efforts do not
yield any fruit. There is an effect of technology in the growth of corporate businesses and human
duties. But it is me somehow always managed to be the perpetrator of human rights violation.
Amnesty International and other NGOs continue my work in holding people accountable and
improving the conditions of people for strawberries happened in his effort from all fronts to
come back to you. Still, there needs to be more awareness among people.

Global_Business_and_human_rights_essay.docx.pdf

  • 1. GLOBAL BUSINESS AND HUMAN RIGHTS ESSAY Name: Institution Affiliation: Course Name: Instructors Name: Date:
  • 2. Introduction The United Nations guiding principles UNGP on business and human rights is the document containing instructions governing the United Nations States and UN-oriented companies. It addresses and saw abuses relating to basic human rights and business operations. This document lays out this is for determining the responsibility that corporate firms have regarding any human rights violation (Bonnitcha & McCorquodale, 2017). This document consists of two different concepts that organizations must take under consideration for further review. Firstly, the country of possible risks at business and secondly, the guidelines required to release a task (Bonnitcha & McCorquodale, 2017). These concepts provide the basis that a state can use to conduct and supervise the actions of corporate firms to avoid human rights violations. It provides States with a basis to exercise authority against corporate involvement in human rights violations (Ruggie & Sherman 2017). However, these concepts create a sense of skepticism regarding what point of time and if the business should be compelled to solve human rights violations (Ruggie & Sherman 2017). The possibilities and limitations of the United Nations guiding principles on business and human rights in serving NGOs are evaluated, taking amnesty as an example. Amnesty International is a UK-based non-governmental organization focused solely on the enforcement of human rights and highlighting cases of violation of human rights. It was founded by Peter Benenson and Eric Baker in 1961 and had its headquarters in the London United Kingdom. Amnesty international is responsible for highlighting major violations of human rights and has actively participated and partnered with the government to ensure more efforts are put in ensuring the observance of human rights.
  • 3. Discussion According to the UNGP of business and human rights, any business, whether big or small, is supposed to acclaim human rights (equityhumanrights.com, 2019). The UNGP guidelines create the assumption that the main course of legal uncertainty in law enforcement is the connection between human rights due diligence and corporate responsibility (Bueno & Bright, 2020). Business firms should locate and evaluate the factors that negatively affect human rights. They should also take measures upon the discovery by taking switchable actions to stop the developing human rights impact. These actions vary according to whether the activities, products, or services of the concerned business firms are the sole cause of the impact or the operations partly contribute to the impact (Bueno & Bright, 2020). There is always an ongoing debate referring to businesses and human rights (BHR) to Mark the human rights disputes and aged by the business firms. According to the policy, large multinational companies hold responsibility for their international activities and reduce the risks of violating and infringing universal human rights (Wettstein et Al., 2019). Large MNCs are also supposed to address human rights issues since the economic and constitutional power could oppose the government bodies (Wettstein et Al., 2019). According to the human rights principle for companies by amnesty international, the company should take responsibility for their operations to promote and uphold human rights standard implementation and monitor their human rights policies. There is an argument regarding the role of business and human rights. Some schools of thought believe that businesses should take responsibility for their activities and their impact on human rights when another school of thought believes that business activity may influence human rights violations. Still, it is not directly the responsibility of any international Business.
  • 4. Despite these arguments, human rights have not played a distinct role in establishing the impact of the benefits searches investments, and trade international businesses gain (Wettstein et Al., 2019). Currently, business management has started to combine the aggressive governmental, and social expect globally. The majority of MNCs and small business enterprises have disagreed that the existing law provides lucidity and solvency for corporate human rights obligations (Pietropaoli, 2020). These big and small enterprises have agreed that the law does not provide legitimate convictions about which techniques are required to keep away legal risks for human rights exploits (Pietropaoli, 2020). Some researchers still agree that in the free market economy, the social duty of business is only to maximize profits for their shareholders (Deva, 2020). Corporate social responsibilities (CSR) are now being used as a kid to hide the self-interest of their actions (Deva, 2020). Direct, definite human rights duties are the fundamental public responsibilities of public bodies (Wettstein et Al., 2019). The extension of human Rights responsibility to global corporations serves as an addition to corporate duties into the public domain bodies (Wettstein et Al., 2019). The UNGP misconstrued on these three components: the obligatory commitment of the state to protect vulnerable individuals from infringement of human rights by several business enterprises, social duties of business firms to prove human rights, and proving an effective solution for victims in human rights infringements (Simons & Handi, 2019). These guidelines may not be congruous with the reality of the women affected by several business activities searches for resource extraction (Simons & Handi, 2019). The guiding concept of excluding women's way of knowing had promoted women in feminist diplomacy to review the intra- household acts and attempt their domestic labor division. The UNGP provides worldwide, and private structures that stick better are women. Extensive mining and oil gas projects' direct or
  • 5. indirect impacts remain differentiated from men's (Simons & Handi, 2019). Several scholarly articles have already mentioned violence against women, specifically sexual violence referring to resource extraction (Simons & Handi, 2019). An unexplainable gap referring to the acceptance of disabled people in the workplace is compared to people without disabilities. Disabled people feel biased with lower job certainty, less job pliability, pessimistic management views, and workfellow relations (Schur et al., 2017). The statistics show around 34% of disabled people are employed in 2015 compared to 75% a month rate of people without disabilities which depicts the human right violation for people living with disabilities who are supposed to receive an allowance based on their disability (Schur et al. 2017). People living with disabilities have aloha job security, and alone earning from their salaries, they also do not have a high chance of raining employee benefits searches, health insurance, and pension plans, amplifying the human rights violation against them (Schur et al. 2017). We are even less likely to participate in corporate workshops or training and participate in workplace decisions. There are strict orders to follow the UN guiding principles. Disable people still feel biased and are more likely to get employed in part-time jobs or any such 9th standard job without the privilege of and having flexible hours (Schur et al. 2017). Amnesty International has asked the state parties to provide effective records for the rights of the disabled person to education. Corporate business impacts the lives of children in various direct and indirect ways. Children are dependent on workers or might also be young workers themselves. Being a part of the community, they come into contact with the private sector's business in their day-to-day life. But business enterprises could adversely affect the lives of the children and negatively influence
  • 6. children's rights (ihrb.org, 2018). There are several cases of child labor where children prominently like a voice to share their experiences and r even really consulted in business decisions. Amnesty international regularly highlight child victims of human rights such as political killings and torture and adjust the government for juvenile justice for children in the community family an armed conflict. According to Schur et al. (2017), the indigenous people who suffer from discrimination throughout the world are specifically oppressed and marginalized, and exploited. The UN guiding principles state that any company should incorporate principles that ensure the upholding of the human rights of indigenous people. The organizations need to prepare seminars and workshops to educate the indigenous people on their organization practices on the indigenous groups. These activities should be conducted in languages are the indigenous group can understand and should also completely incorporate the impact of the companies’ actions on the rights of the indigenous group. For an organization to be considered conducting due diligence in upholding indigenous communities' human rights, it needs to involve the community in every phase of implementing the organization's project. The involvement of this community is in every stage and shows us the survival of the organization by creating trust between the organization and these communities. The United Nations guidelines for business and human rights also burden the government to ensure that the rights of the indigenous people are respected. The government is expected to provide solutions in cases where these communities claim exploitation. It is also tasked with enforcing policies set up in the business sector, especially when the business enterprises create policies that are not binding. The state is responsible for ensuring that people are aware of their rights and ensuring that businesses are aware of the consequences of human rights violations and the victims of
  • 7. human rights violations. The government has to lay a clear and versus an organization in educating their personals on how to engage in dialogues to notice and report any form of human Rights violation as early as possible to minimize the impact on the society. Denying public support to organizations with a history of human rights issues is also another forcing method. The state can punish organizations by not providing government support for organizations that have been guilty of violating human rights. And sharing that registration and policies are appropriately designed to punish human rights violations is legally enforcing a company to operate with human rights in consideration. Amnesty International has been working for human rights and focusing on prevention as the NGO called out for businesses to introspect their workspace and methods. Accountability helps businesses while eating rights to be held accountable by the state. Remedies must be provided to the victims of abuse and possibly judicial support. Amnesty also encourages the use of the law beyond borders to enforce the regulations, possibly if needed, especially when they are not seriously considered. These authorities' and corporations' efforts can help curb human rights violations in the business sector (amnesty.org, 2019). Technology and business are an ever-growing culture in the modern world. Both are positively independent. The advent of technology has informed the way of business around the world. Technologies like artificial intelligence and robotics have significantly reduced the board on organizations and have increased Prophets. The expansion of the internet has increased business opportunities for all. But the internet has also made people aware of certain things they were not aware of before. Internet expansion has led people to be aware of their choices and rights. Human rights was not a well-known term around the globe before the internet. Marginalized communities generally have limited access to the internet but have certainly
  • 8. become aware of their rights. Technology has inspired human beings to access the year rights fully. Social networks allow the activist to create communities and spread messages faster and in more detail. Technology also severely impacts the future of employees in business as it is replaced by it. The workers' rights we'll take it all in such cases. The increase in technological advancement complicates jobs for many people increasing wages and increasing social inequality (amnesty.org, 2019). According to amnesty.org, (2019), social workers have also given people the power to highlight the injustices in various parts of the world. Using the press, they help people to understand how far the rules of human Rights violence go. There can be a change in the work environment by educating the Next Generation on the harmful impacts of such acts of infringement of human rights. Amnesty international users’ technology to identify the distractions of Human Rights across the globe. It introduced the "toxic Twitter" campaign, which is supported by machine learning services for understanding the extent of abuse against women on Twitter (amnesty.org, 2019). Human rights are related to businesses but not in a desirable manner. Throughout history, there have been violations of human rights in industries. A good example would be the human rights violation in the Philippines. Many industries have not taken care of their employees and eating first the UN to issue "un guiding principles on business and human rights" (ohchr.org, 2019). This suggested a lot of reforms at the workplace is to enhance the state of human rights. From a broader perspective, the UN guidelines are important and necessary for the point of time. But the failure of the guidelines to be legally binding imposes a huge task on the States. States with prevalence in human rights violations have to go through different methods and apply different measures according to the country. This can cause hindrances in actually affecting the guidelines issued by the UN. Some countries do
  • 9. not pay heed to these reforms and are more comfortable in business is continuing with their practices. Many workforces needed to enforce this guideline properly, and some states feel much better without them. According to Wettstein et al. (2019), human rights are unconditional and equal for each person in the world. It should hold irrespective of the domestic roles of foreign regulations. Corporations must consider this as their responsibility and work to ensure these laws are taken care of. The making runs by the state of the human rights and considers them a task too big to be taken care of is incompetence. There are many countries where income inequality has an increasing trend due to the mistreatment of the workers for the organizations to reap the benefits. These situations are a cause of concern for people worldwide; ignoring the moral responsibility to support victims is just as terrible as being the perpetrators. According to Rivera (2019), human rights are now being mainstreamed in the global corporate business world, making public policies essential in government functions and ensuring the legal obligation of human Rights by legislation action official. The national action plan has emerged as the first recommended step to implement the UNGP. Various countries are now using the national action plans to fulfill their international commitments and run through them to stop European commission has already proposed to develop action plans as part of regional policy objectives (Rivera, 2019). The basic idea behind NAPs is the measures to fill the central and legislative gaps through which corporate businesses influence human rights negatively. The public policies must be defined clearly concerning politics, and policy for staff politics refers to the potential that validates public strength. The policy indicates action as a base of rational decisions. These policies are expanded upon to mark the specific issues faced by
  • 10. different companies. Flexible oil companies have developed several policies and undergo certain practices that ensure personal safety in or near the oil facilities (Rivera, 2019) Conclusion Based on the above information, there is enough ground to clearly understand how communities, governments, and people get affected by the violation of human rights. The NGOs trying to protect these rights have adverse effects for stop businesses that do not adhere to UNGP her first serious legal consequences to hold them accountable. Sometimes these efforts do not yield any fruit. There is an effect of technology in the growth of corporate businesses and human duties. But it is me somehow always managed to be the perpetrator of human rights violation.
