During a divorce, partners are expected to settle their finances by dividing their property and make adequate financial arrangement for their children, if they are still at home. This can be achieved in an amicable and understanding way, or can be resolved in the court with the help of a divorce solicitor.

One of the great misunderstandings is how assets in trusts are dealt with in the Family Court. Are they excluded or are they in?
Asset pools in these cases can be significant, so before you suggest a particular asset-holding structure for a client, it’s important to know what the answer is.
In this webinar for Accountants we look at some case examples and cover the important questions, such as:
- How is property settlement determined?
- What is “property” and what is a “financial resource”?
- What power does the Family Court have to deal with Trusts?
- What, if anything, can be done to remove a Trust from the Court’s reach?

The correct legal status of a relationship is important, it has serious consequences. For a de facto it can determine if someone has a financial entitlement or if they don’t.
On the 10th anniversary of the introduction of the law for de facto property settlements, we ask the question “What is a de facto relationship?”.
The reality is that it is not straight forward and most people don’t know if they are in a de facto relationship. It is important for an Accountant to be informed in this area, so your clients are “alert but not alarmed”.
This presentation was used for the Bridge the Gap CLE at Fordham Law School in January 2015. I co-presented with another family lawyer. My part of the presentation covers the jurisdictional differences between Supreme Court and Family Court, the different divorce paths in New York (e.g., contested divorce, uncontested divorce), Notice of Automatic Orders, matrimonial agreements (e.g, prenuptial agreements), grounds for an annulment and grounds for a divorce, equitable distribution, child support and spousal maintenance.
In times of separation, it's easy to become overwhelmed by the emotional stress and overlook what's required to properly apply for a divorce. In this slideshow the experienced Perth divorce lawyers at Havilah Legal outline what you need to know.

According to Skeeles and Cunningham from the Ohio State University Extension, estate planning ensures that the welfare of a loved one is secured even after his or her death. However, the majority of Americans do not have a plan or a will. Why? No one likes to think or talk about his or her own demise, and our loved ones don’t want to hear about this subject either. Another reason is that the majority of us do not fathom the idea of planning an estate.

Responsibilities of the office bearers while registering multi-state cooperat...Finlaw Consultancy Pvt Ltd
Introduction-
The process of register multi-state cooperative society in India is governed by the Multi-State Co-operative Societies Act, 2002. This process requires the office bearers to undertake several crucial responsibilities to ensure compliance with legal and regulatory frameworks. The key office bearers typically include the President, Secretary, and Treasurer, along with other elected members of the managing committee. Their responsibilities encompass administrative, legal, and financial duties essential for the successful registration and operation of the society.
In 2020, the Ministry of Home Affairs established a committee led by Prof. (Dr.) Ranbir Singh, former Vice Chancellor of National Law University (NLU), Delhi. This committee was tasked with reviewing the three codes of criminal law. The primary objective of the committee was to propose comprehensive reforms to the country’s criminal laws in a manner that is both principled and effective.
The committee’s focus was on ensuring the safety and security of individuals, communities, and the nation as a whole. Throughout its deliberations, the committee aimed to uphold constitutional values such as justice, dignity, and the intrinsic value of each individual. Their goal was to recommend amendments to the criminal laws that align with these values and priorities.
Subsequently, in February, the committee successfully submitted its recommendations regarding amendments to the criminal law. These recommendations are intended to serve as a foundation for enhancing the current legal framework, promoting safety and security, and upholding the constitutional principles of justice, dignity, and the inherent worth of every individual.
WINDING UP of COMPANY, Modes of DissolutionKHURRAMWALI
Winding up, also known as liquidation, refers to the legal and financial process of dissolving a company. It involves ceasing operations, selling assets, settling debts, and ultimately removing the company from the official business registry.
Here's a breakdown of the key aspects of winding up:
Reasons for Winding Up:
Insolvency: This is the most common reason, where the company cannot pay its debts. Creditors may initiate a compulsory winding up to recover their dues.
Voluntary Closure: The owners may decide to close the company due to reasons like reaching business goals, facing losses, or merging with another company.
Deadlock: If shareholders or directors cannot agree on how to run the company, a court may order a winding up.
Types of Winding Up:
Voluntary Winding Up: This is initiated by the company's shareholders through a resolution passed by a majority vote. There are two main types:
Members' Voluntary Winding Up: The company is solvent (has enough assets to pay off its debts) and shareholders will receive any remaining assets after debts are settled.
Creditors' Voluntary Winding Up: The company is insolvent and creditors will be prioritized in receiving payment from the sale of assets.
Compulsory Winding Up: This is initiated by a court order, typically at the request of creditors, government agencies, or even by the company itself if it's insolvent.
Process of Winding Up:
Appointment of Liquidator: A qualified professional is appointed to oversee the winding-up process. They are responsible for selling assets, paying off debts, and distributing any remaining funds.
Cease Trading: The company stops its regular business operations.
Notification of Creditors: Creditors are informed about the winding up and invited to submit their claims.
Sale of Assets: The company's assets are sold to generate cash to pay off creditors.
Payment of Debts: Creditors are paid according to a set order of priority, with secured creditors receiving payment before unsecured creditors.
Distribution to Shareholders: If there are any remaining funds after all debts are settled, they are distributed to shareholders according to their ownership stake.
Dissolution: Once all claims are settled and distributions made, the company is officially dissolved and removed from the business register.
Impact of Winding Up:
Employees: Employees will likely lose their jobs during the winding-up process.
Creditors: Creditors may not recover their debts in full, especially if the company is insolvent.
Shareholders: Shareholders may not receive any payout if the company's debts exceed its assets.
Winding up is a complex legal and financial process that can have significant consequences for all parties involved. It's important to seek professional legal and financial advice when considering winding up a company.
2. • When you get married, you commit to the connection of
two wholly separate lives
• You share your house, your car, your bank account
• For whatever reason, you decide to get divorced from your
spouse
• However, it’s not as easy as packing up your bags and leaving
• Your property and families have become enmeshed, and
most importantly - your finances
• If you live in New York, some recent changes in divorce law
might be helpful to you as you work your way through this
separation process
3. • In June, a bill passed the New York Assembly
and Senate in order to determine spousal
support (alimony), and are currently awaiting
Governor Cuomo’s approval
4. • There are two types of this support, or maintenance, in NewYork
• As specified by Divorcenet.com, the first is post-divorce
maintenance, which is awarded to the supported spouse after the
divorce action
• This support ends by the death of either spouse, the remarriage
of the supported spouse or if the supported spouse is habitually
living with someone
• The second type is temporary maintenance, which is paid while
the divorce case is pending in order to provide the supported
spouse with immediate financial need
• It ends when a final order of maintenance is made by a judge
5. • The upcoming changes in New York would
establish a two-track system for determining an
amount of tempor ar y post-divorce
maintenance
• The regulations of how spouses pay each
other
7. THE SECONDTRACK
• The spouse pays maintenance
• He/she receives child support from the other
party
8. • In the first track, the spouse paying
maintenance and child support would yield a
lower amount of child support
• In the second track, there is some flexibility
• The spouse may decide to pay only temporary
maintenance, with a current cap of $543,000
9. • The proposed changes would also require the court to
“consider and allocate, where appropriate” the
responsibility for each spouse to contribute to family
expenses while the case is pending
• Going through divorce isn’t easy
• However, the purpose of family law is to mediate some
of this emotional stress
• Hopefully the changes in New York will help more
families find more satisfaction in their lives post-divorce
