There is a large web of regulations that govern the import & export of fish & wildlife and the products made from them. Be careful, the penalties are stiff.
Fish and Wildlife Regulations - Are you subject to them?
1. ARE YOU SUBJECT TO US FISH &
WILDLIFE REGULATIONS?
Don’t make assumptions!
2. The Fish and Wildlife Service (F&W), an agency of the federal government,
operates with the intent of protecting wildlife.
F&W has specific designated
ports for import and export of
the goods under their
jurisdiction:
Anchorage, Atlanta, Baltimore,
Boston, Chicago, Dallas,
Honolulu, Houston,
Los Angeles, Louisville,
Memphis, Miami, New Orleans,
New York, Newark,
Portland, San Francisco, and
Seattle.
3. Not Just Fish and Wildlife to be Aware about.
There are other agencies to consider with
laws that protect Wildlife:
Lacey Act, Endangered Species Act, Migratory
Bird Treaty Act, Eagle Protection Act, Marine
Mammal Protection Act, African Elephant
Conservation Act, Rhinoceros and Tiger
Conservation Act, and Wild Bird Conservation
Act.
4. Importing and Exporting Fish and Wildlife
What is considered wildlife?
Mammals, birds, reptiles, amphibians, fish, insects,
crustaceans, arthropods, mollusks, and
coelenterates.
Any of the previous mentioned wildlife, whether living
or not living, are regulated, as well as products made
from them.
It also includes animals bred in captivity.
5. “Pearl Parties” - Did You Get Your License?
Have you come across someone opening oysters, revealing a pearl on a social
media live feed? Surprisingly, these so-called “pearl parties” are regulated by Fish
and Wildlife. Be Careful!!!
Did you know that most of these oysters originate in
a foreign country?
If they are not domestic, they are considered imports
and require a license. They must be declared to the
Fish & Wildlife service and are subject to inspection
as well as necessary import fees.
Oysters that are not declared are subject to enforcement action including seizure
and monetary penalties.
