Content & objective
Themis 5.0 technology is per se AI-driven ->
the technology needs to be designed in adherence to the ethical and
legal requirements of Trustworthy AI, applicable in the EU.
The first section of our contribution is dedicated to the identification
of the ethical and legal frameworks that Themis 5.0. technology
needs to take into consideration.
Then, the legal and ethical impact assessment of the technology will
be carried out in T1.4

• There is an agreement on the final text, but the legislative procedure is in the final stage ->
Publication of the official text will take place in Spring 2024, after the final vote of the EU
Parliament and endorsement of the Council
• The Commission will have to issue several Implementing Regulations and delegated acts
• The application will take place mainly within 2 years from the entry into force with some
exceptions, including prohibited AI systems in 6 months; Codes of practices in 9 months;
classifications of some high-risk AI systems and consequent obligations in 3 years

Content & objective
Themis 5.0. technology will provide the optimization of third-party AI systems'
specific trustworthiness requirements (i.e. fairness, accuracy, robustness),
whose understanding and implementation need to be legally and ethically
compliant.
The section aims to
• to provide philosophical (IPT), ethical and legal explanations
of fairness, accuracy, and robustness
• to clarify why they have ethical and legal relevance in Themis 5.0.

At the outset
• According to the current EU framework, Trustworthy AI
involves more dimensions and requirements than just fairness, robustness
and accuracy.
• Therefore, it is not completely accurate to refer to fair, robust & accurate AI
as the only elements of Trustworthy AI.

Fairness is not a mere computational problem -> Biases cannot “be fixed” by
algorithms if their roots are not investigated with the involvement of the
communities and individuals concerned.

• Trustworthiness requirements are not stand-alone -> they can work in synergy (e.g.
disclosure and information about the expected performance of an AI system enhance
both transparency and accuracy) or there can be conflicts (e.g. Perfectly privacy-
enhanced which are inaccurate) -> techniques to balance
• Trustworthiness requirements do not have a universal meaning -> the
contextual understanding of requirements is based on the context of use (e.g. fairness
in detecting disinformation is not the same as in port management) and values
prominent in a certain jurisdiction

  • 4. Content & objective Themis 5.0 technology is per se AI-driven -> the technology needs to be designed in adherence to the ethical and legal requirements of Trustworthy AI, applicable in the EU. The first section of our contribution is dedicated to the identification of the ethical and legal frameworks that Themis 5.0. technology needs to take into consideration. The section aims to • to provide philosophical (IPT), ethical and legal explanations of fairness, accuracy, and robustness • to clarify why they have ethical and legal relevance in Themis 5.0.

ETHICAL AND LEGAL RELEVANCE OF FAIRNESS, ROBUSTNESS AND ACCURACY Fairness is not a mere computational problem -> Biases cannot “be fixed” by algorithms if their roots are not investigated with the involvement of the communities and individuals concerned.   1. The ethical dimension of fairness is broader than the legal one. While the legal dimension is mainly concerned with equality and non-discrimination, the ethical concept embraces also the societal perspective, taking into consideration social justice instances addressing systemic oppressions, which are less addressed by the legal dimension (Hoffmann, 2019). In particular, fairness entails the substantive (equality before the law, non-discrimination and avoidance of biases, equal and just distribution of opportunities and cost, proportionality between means and ends) and the procedural dimension (redress against AI-enabled or assisted decisions, accountability of the system and its human operators, explicability of the decision-making process followed by the AI system, participatory design of the AI system). Both substantive and procedural fairness entail an individual dimension (e.g. equality before the law and non-discrimination, redress against decisions) and a societal/group dimension (e.g. equal and just distribution of opportunities and costs, participatory design of the AI system).
  2. In the health domain fairness plays a crucial role, as it is of utmost importance to ensure that the AI system does not discriminate the patients, in the design of the model, in the collection of datasets used by the model and in the use made by the model. In the media domain, the principle of proportionality, which falls under the fairness principle, gains prominence, since it is particularly relevant to ensure that the detection of disinformation practices does not impair the freedom of expression. Instead, in the transportation domain, as port management, the principle of fairness plays a minor role, since the AI system has likely negligible implications in terms of discrimination and equality. Similar specifications apply to the other principles, as the technical robustness of an AI system employed for port management entails safety considerations of a completely different scale than those considered in cancer detection. While an AI system used for disinformation detection likely does not entail relevant considerations in terms of technical robustness but has significant implications in terms of societal robustness, ensuring democratic knowledge circulation and evolution
