This document provides a checklist of financial documents needed for a divorce proceeding. It lists tax documents, bank statements, retirement accounts, employment benefits, investments, real estate documents, business documents (if applicable), insurance policies, vehicle titles, wills and trusts, debts, and monthly bills. The goal is to collect current statements and documentation of all joint and individual financial assets, liabilities, income and expenses for both spouses.

DIVORCE DOCUMENT CHECKLIST
Taxes & Income
Personal federal and state income tax returns.
Federal and state income tax returns for any business which you or
your spouse owns, together with all of the accompanying schedules.
W-2 Forms (for you and for your spouse)
1099 forms (for you and your spouse).
Current year-to-date pay stubs for you and your spouse.
All statements of any debt you and/or your spouse owes to the IRS
Bank records
Checking account statement(s) for any account held in your name,
your spouse’s name, or both of your names.
Savings account statement(s) for any account held in your name,
your spouse’s name, or both of your names.
Money market account statement(s) held in your name, your
spouse’s name, or both of your names.
Records relating to any safe deposit boxes you or your spouse has
(e.g. statement showing the name of the bank where the safe deposit
box is located and the name of the owner of the box).
Retirement Accounts
Statements showing the value of your pension plan, IRA account(s),
Roth IRA accounts and/or 401K or 403(b) plan(s).

2. Statements showing the value of your spouse’s pension plan, IRA
account(s), Roth IRA accounts and/or 401K or 403(b) plan(s).
Statements showing the value of any deferred compensation plan
you or your spouse has.
Social Security statements showing the amount of benefits you or
your spouse has accumulated. (These normally come out once per
year. If you don’t have these, don’t worry about it. But, if you do have
them, keep them.)
Work-related Benefits
Written employment contracts that you or your spouse has.
Document(s) regarding any stock, stock options, ESOPS, or
employee benefits held in your name, your spouse’s name, or both of
your names.
Any employee handbooks or other documents that outline the benefits
that you or your spouse will receive from your employment.
Investments
Investment account statement(s) for any account held in your
name, your spouse’s name, or both of your names.
Individual stock certificates you or your spouse may hold.
Statements for any certificates of deposit (CDs) which you or your
spouse own, whether individually or jointly.
Real Estate Documents
Any appraisals you may have for your home. (Hint: if you have
refinanced your mortgage within the past few years, there is probably
an appraisal in your refinance documents.)
Any appraisals you have for any vacation home or investment property
you own.

3. Mortgage statements showing your account number, the total amount
due and your monthly payment.
Statements from any home equity loan or any line of credit on your
home.
Mortgage statements for any other mortgage on any property you,
your spouse, or both of you own.
Documentation showing the annual amount due for your property
taxes, as well as any unpaid property tax bills.
Business Documents (If you or your spouse owns a business)
Checking account statement(s) for any account held by the
business.
Savings account statement(s) for any account held by the business
Money market account statement(s) held by the business.
Profit and loss statements, balance sheets and budgets generated
by the business within the past 3 years.
Corporate documents from the business, including the Articles of
Incorporation, Bylaws, Stock Ledgers, Buy/Sell Agreements,
Shareholders’ Reports, and Minutes from Board of Directors’ Meetings.
Insurance
Life insurance policies that insure you, your spouse, or your children.
(The most important part of this is the declarations page which shows
the amount of the death benefit and the named beneficiaries.)
Documentation you can find regarding life insurance provided to
you or your spouse from your respective employers.
Disability insurance policies covering you or your spouse.
Current health insurance policy(ies), including medical, dental and
optical coverage. Again, the most important part of this will be the

4. statement of coverage and benefits. (You don’t need 3 years of these
documents. You just need documentation of your current coverage.)
Current automobile insurance policy(ies) for you, your spouse and
your children. (You don’t need 3 years of these documents. You just
need documentation of your current coverage.)
Vehicles
All motor vehicle titles held in your name or jointly with your spouse.
All leases for any vehicles you or your spouse may have.
Titles to all boats, motorcycles or other vehicles you or your spouse
own.
Wills & Trusts
Current copies of your Will and your spouse’s Will.
Copies of all trust documents for trusts in which you or your spouse is
the Trustee or a beneficiary.
Debts
All credit card statements for every credit card you or your spouse has,
whether individually or jointly.
All statements showing the current amount due on any student loans
for you or your spouse.
All statements or documentation showing the amount due on any
personal loans that either you or your spouse has.
Documentation of all of your monthly bills. (NOTE: You do not need 3
years worth of household bills! You do need a list showing all of your
monthly bills, and representative copies of those bills so that you could
prove what your expenses are. If you are past due on ANY bill, you
need current copies of that bill showing the total amount you owe.
