Cybersquatting is registering, selling, or using a domain name with the intent to profit from another entity's trademark. Dennis Toeppen was one of the earliest cybersquatters, registering domains like delta.com and neiman-marcus.com. To check if a domain name you want is being cybersquatted, see where the domain takes you - if it leads to advertisements related to your trademark or says the domain is for sale, it may be a squatted domain. You can also contact the domain registrant to understand their use before taking further action. Sometimes paying a cybersquatter is the most cost effective solution versus legal proceedings.

Timeshares often represent money-saving purchases for frequent travelers. But be warned they may prove costly if you don’t know how to detect an absolute scam.
According to the National Timeshare Owners Association nearly 8 million Americans own timeshares, making the thriving industry ripe for con artists.
Companies lure potential customers with free stays at a timeshare in exchange for the client's agreeing to simply sit through a timeshare presentation, but problems may arise once you agree to buy the property.
Timeshare scams range from hidden booking or maintenance fees to more extreme cases, such as companies suddenly going out of business once they secure your hefty deposit, leaving you without a timeshare.
Follow our tips for buying to avoid timeshare scams
1. Leave the room if the sales pitch becomes too aggressive.
2. Talk with other owners, particularly if you are staying at the timeshare resort where you are considering purchasing property.
3. Allow yourself the opportunity to consider the offer, do not sign a contract or any documents at the presentation. Review the contract and documents with a lawyer.
4. Visit the Better Business Bureau website (bbb.org) to check for complaints against the timeshare company.
5. If you decide to sign a contract at the time of the presentation, get a copy immediately, do not accept promises for them to mail or email you a copy at a later date.

The problem with their claim is that you can not trademark a generic descriptive term. UDRP decisions weigh heavily towards the complainant. They do not have the ultimate authority over domains names. Its useless to even use them as an authority. District Court baby. A real judge in a real court of law.
DOMAIN NAME AND CYBER SQUATTING
Cybersquatting (also known as domain squatting), according to the United States federal law known as the Anticybersquatting Consumer Protection Act, is registering, trafficking in, or using an Internet domain name with bad faith intent to profit from the goodwill of a trademark belonging to someone else. The cybersquatter then offers to sell the domain to the person or company who owns a trademark contained within the name at an inflated price.
The term is derived from "squatting", which is the act of occupying an abandoned or unoccupied space or building that the squatter does not own, rent, or otherwise have permission to use.

- 2. What is it? Cybersquatting is registering, selling or using a domain name with the intent of profiting from the goodwill of someone else’s trademark.

- 5. How do you know if the domain Name you want is being used By a cybersquatter?
- 6. Check where the domain Name takes you. If the domain takes you to a functioning website that is comprised primarily of advertisements for products or services related to your trademark, you may be a victim or cyber squatting. If your search does not take you to a functioning website, but instead it takes you to a site stating “this domain name for sale” or “under construction” or “can’t find server” the likelihood increases that you’re dealing with a cybersquatter.
- 7. Contact the domain name registrant. Before jumping to any conclusions, contact the person who the domain is registered to. Find out whether there is a reasonable explanation for he use of the domain name, or if the registrant is willing to sell you the name at a price that you are willing to pay.
- 8. Pay… if it makes sense. Sometimes, paying the cybersquatter is the best choice. It may end up being much cheaper and quicker than filing a lawsuit or initiating any type of hearing.
