This presentation, which was made at the American College of Trial Lawyers' New England Regional Meeting, highlights the trial and the appellate court's role in managing complex, high profile civil and criminal cases.
Radically Open Cultural Heritage Data on the WebJon Voss
The document discusses how cultural heritage institutions like libraries, archives, and museums are making their data openly accessible on the web through linked open data. It introduces some of the key concepts behind linked open data including using triples with subjects, predicates, and objects to describe entities in a machine-readable way. The document also discusses some of the legal tools like Creative Commons licenses that are being used to share content openly and enable better collaboration between these cultural institutions.
This document appears to be a portfolio or resume for Jessica Joan Lindenau-Leon containing summaries of 3 design or construction projects she worked on. The first was an orange rubber wall system for a Hollywood studio at Woodbury University. The second was a wooden puzzle box built in a poplar woodshop. The third was for a music retail store partner in Hollywood for which construction documents were created. Contact information is provided at the end.
OER provide both benefits and challenges for faculty and students. Some key benefits are that OER allow students to access free or low-cost alternatives to traditional textbooks, interact with content in dynamic ways, and ensure all students have access to course materials. However, there are also challenges such as the time-consuming process of finding, modifying, and implementing OER; complications in discoverability due to varying metadata; and the need for faculty to thoroughly evaluate and get support for using OER.
Pre-Issuance (Third-Party) Submissions - More DetailedKlemchuk LLP
Third parties can submit patents and publications for consideration during patent examination under the pre-issuance submission process. Submissions can be made electronically or on paper before the first office action or within 6 months of publication. The PTO will review submissions for compliance before notifying the applicant. Examples show submissions leading examiners to issue rejections or notices being sent to applicants. While submissions may help limit competitor patent scope, disadvantages include retaliation or broad patents still issuing. Best practices include timely monitoring of filings and high-quality, focused prior art submissions.

This document provides tips to avoid common mistakes in PowerPoint presentation design. It identifies the top 5 mistakes as including putting too much information on slides, not using enough visuals, using poor quality or unreadable visuals, having messy slides with poor spacing and alignment, and not properly preparing and practicing the presentation. The document encourages presenters to use fewer words per slide, high quality images and charts, consistent formatting, and to spend significant time crafting an engaging narrative and rehearsing their presentation. It emphasizes that an attractive design is not as important as being an effective storyteller.

This document is a submission by Rosemary De Caires for a judicial review in 2009. It summarizes her arguments that the Public Guardian and Trustee (PGT) overstepped its authority in the York matter. Specifically, the PGT had no right to access information through the Ontario Disability Support Program and acted arbitrarily and against privacy laws. The document also outlines the various court dates and motions over the past year related to the York case. Rosemary believes that finally wrapping up the case would be a major breakthrough for all parties involved.
Tyler, a homebuilder, failed to comply with orders to install proper septic and well systems. When Tyler violated a court order by selling units, he and his attorney Petty were held in contempt. Tyler and Petty now want to seal these records, arguing it will harm their reputations. However, courts found humiliation and reputation harm alone do not satisfy the "good cause" standard to seal records. As the violations involved public health, the matter was of strong public interest, so the motion to seal will likely be denied.

Deep inside the Joseph P. Kinneary U.S. Courthouse in Columbus, carpenters, electricians and audiovisual engineers are modernizing the federal courtrooms with new technology to make trials more efficient. Two courtrooms have been completed so far and a third will be done in May as part of a $3 million project over two years. The upgrades include computer displays for exhibits, videoconferencing capabilities, and touchscreen controls, allowing documents and testimony to be presented digitally instead of hauling in paper binders. The judge says these technologies save time and improve accessibility compared to prior temporary systems.
The Patents County Court Small Claims TrackJane Lambert
On 1 Oct 2012 CPR Part 63 was amended to create a new small claims track for the Patents County Court. This presentation explains why these rule changes are important and show how they may be operated.
1. The document provides an overview of the UK legal system, including the civil courts, criminal courts, legal profession, and judiciary.
2. It discusses the county courts, which were established in 1846 and handle civil cases involving claims up to a certain monetary amount, as well as certain family and licensing matters.
3. The document also briefly outlines the structure and jurisdiction of the higher courts, including the High Court, Court of Appeal, and House of Lords.
Justice wide open - communities and courtswilliam perrin
This document discusses issues with transparency and access to information regarding local courts in the UK. It notes that basic information about daily court listings and case results are not available online, making it difficult for the public and journalists to follow what is happening in their local magistrates court. The document proposes a "Courts Transparency Charter" that would establish citizens' administrative rights to have timely court listings published, including names of all participants, as well as publishing case results online, while still protecting privacy and preventing contempt of court. It argues there is a need to resolve conflicts between open justice traditions and modern data protection and privacy laws and practices.
The document summarizes research conducted on whether citizens in the community of Naggo Head are aware of acts that constitute the tort of private nuisance. Surveys were conducted asking residents questions about private nuisance. The findings showed that while most residents were familiar with the concept of private nuisance, many were unaware of its specific elements and the legal remedies available. The researchers concluded more education is needed for citizens on private nuisance laws and respecting neighbors. They recommended residents educate themselves on private nuisance.
Court Orders Proposed Claim Constructions to be Written in Plain EnglishPatton Boggs LLP
The court ordered the parties in the patent infringement case Apple Inc. v. Motorola, Inc. to submit their proposed claim constructions in plain English understandable to jurors without scientific or technical backgrounds. Judge Posner was concerned that many of the proposed constructions were unintelligible to jurors. He wants to avoid wasting trial time by having experts explain opaque terms, and instead wants constructions written in ordinary language a jury can comprehend. This highlights the challenge in patent cases of being scientifically precise while making complex issues understandable to laypeople on the jury. It remains to be seen how the parties will comply with the order to use simple language.
Chapter 2 - The Resolution of Private DisputesUAF_BA330
The document discusses the US judicial system and resolution of private disputes through the courts. It describes the differences between state and federal court systems, as well as civil and criminal jurisdiction. The stages of civil litigation are outlined, including pre-trial procedures like discovery and motions, and the trial process involving jury selection, witness examination, and closing arguments.

This document discusses approaches to sending and responding to patent-related cease and desist (C&D) letters. It describes the "classic" approach of sending non-assertive letters offering to discuss licensing without creating reasonable apprehension of a lawsuit. However, this gave patentees wide latitude. The Supreme Court's Medimmune decision changed this by allowing licensees to seek declaratory judgment without terminating licenses. As a result, patentees must now carefully consider whether and how to send C&D letters to avoid declaratory judgment actions. Upon receiving a C&D letter, alleged infringers should investigate, potentially engage counsel, limit involvement to prevent willfulness findings, and respond to the letter.

Lifting the Corporate Veil. Power Point Presentationseri bangash
"Lifting the Corporate Veil" is a legal concept that refers to the judicial act of disregarding the separate legal personality of a corporation or limited liability company (LLC). Normally, a corporation is considered a legal entity separate from its shareholders or members, meaning that the personal assets of shareholders or members are protected from the liabilities of the corporation. However, there are certain situations where courts may decide to "pierce" or "lift" the corporate veil, holding shareholders or members personally liable for the debts or actions of the corporation.
Here are some common scenarios in which courts might lift the corporate veil:
Fraud or Illegality: If shareholders or members use the corporate structure to perpetrate fraud, evade legal obligations, or engage in illegal activities, courts may disregard the corporate entity and hold those individuals personally liable.
Undercapitalization: If a corporation is formed with insufficient capital to conduct its intended business and meet its foreseeable liabilities, and this lack of capitalization results in harm to creditors or other parties, courts may lift the corporate veil to hold shareholders or members liable.
Failure to Observe Corporate Formalities: Corporations and LLCs are required to observe certain formalities, such as holding regular meetings, maintaining separate financial records, and avoiding commingling of personal and corporate assets. If these formalities are not observed and the corporate structure is used as a mere façade, courts may disregard the corporate entity.
Alter Ego: If there is such a unity of interest and ownership between the corporation and its shareholders or members that the separate personalities of the corporation and the individuals no longer exist, courts may treat the corporation as the alter ego of its owners and hold them personally liable.
Group Enterprises: In some cases, where multiple corporations are closely related or form part of a single economic unit, courts may pierce the corporate veil to achieve equity, particularly if one corporation's actions harm creditors or other stakeholders and the corporate structure is being used to shield culpable parties from liability.

2. TWO CASES AS A PARADIGM
The Yellow Kittens Case
The Lead Paint Case
3. THE LEAD PAINT CASE
“In this landmark lawsuit, filed in 1999, the then Attorney
General, on behalf of the State of Rhode Island (the state),
filed suit against various former lead pigment
manufacturers and the Lead Industries Association (LIA), a
national trade association of lead producers formed in
1928.”
4. THE LEAD PAINT CASE
“After the first trial resulted in a mistrial, a second trial
commenced; that second trial, spanning four months,
became the longest civil jury trial in the state's history.
This monumental lawsuit marked the first time in the
United States that a trial resulted in a verdict that
imposed liability on lead pigment manufacturers for
creating a public nuisance.”
5. THE YELLOW KITTENS CASE
Three men, including a public official who owned a
restaurant/lounge in New Shoreham (Block Island) were
charged with sexually assaulting a woman staff member
after closing hours on a weekend after much heavy
drinking. There were several counts, including one for
oral sex.
6. FLEXIBILITY
• Complex, high profile cases do not always fit the mold.
• They often require flexibility and creativity on the part
of the Court and counsel.
9. FLEXIBILITY IN
YELLOW KITTENS CASE
• Bifurcation of trial.
• Submission of pre-trial motions and memos – resolve
significant issues of law before trial.
• Decision on pre-trial motions before trial and issuance
of decisions each morning before the court session.
• Written preliminary jury instructions, final jury
instructions.
11. COMMUNICATION IN
LEAD PAINT CASE
• Emails permitted between law clerk and counsel.
• Periodic status meetings with counsel.
• Open discussion about the Court’s expectations and
opportunity for counsel to ask questions of the Court.
12. COMMUNICATION IN
YELLOW KITTENS CASE
• Established expectations of counsel from the outset.
• Frequent status meetings with counsel.
13. STAFFING
• Complex, high profile cases often have special staffing
needs, which can be difficult for a judiciary that has
limited resources.
14. STAFFING IN
LEAD PAINT CASE
• Court became aware that one obstacle to the docketing
of the appeals was that the stenographer, who was
assigned to a court calendar, was struggling to find time to
complete the transcripts. The Court managed that issue
by taking the stenographer off her daily court calendar,
which allowed her to devote all of her time to completing
the transcripts.
16. STAFFING IN
YELLOW KITTENS CASE
• Uniformity of staff: same clerk, same law clerk, same
stenographer for both trials.
• Extended morning/evening hours of staff to
accommodate last minute motions and other matters.
17. TECHNOLOGY
• The Judiciary is slow to adopt technology.
• Complex, high profile cases present an opportunity for
the Court to pilot technology in new and different ways.
19. TECHNOLOGY IN
LEAD PAINT CASE
HEADLINE: High court OKs Webcast of paint case
BYLINE: By Peter B. Lord, Journal Environment
Writer
BODY:
The Rhode Island Supreme Court, in an
unprecedented move, plans to Webcast hearings
scheduled for May 15 on an appeal of the state s
high profile lead-paint case against three major
corporations.
20. TECHNOLOGY IN
LEAD PAINT CASE
• The Rhode Island Supreme Court generally does not
televise its proceedings. In a few select cases, the Court
had allowed a single pool camera to transmit images to an
overflow room or to a group of TV stations. The Lead Paint
case was the first time the Court used its own camera to
broadcast the arguments on the web.
21. TECHNOLOGY IN
LEAD PAINT CASE
“Chief Justice Frank J. Williams decided to allow the
Webcast because of the strong nationwide interest in the
case, according to courts spokesman Craig Berke.
There was widespread interest from attorneys all over the
country who would otherwise have to attend if we
couldn’t make this available, Berke said. There has been a
lot of interest from attorneys, legal publications, brokers
and investment companies.”
22. TECHNOLOGY IN
LEAD PAINT CASE
• Nearly 400 people viewed the webcast on the day of the
argument.
23. TECHNOLOGY IN
YELLOW KITTENS CASE
• Court allowed a single reporter access to allow for
transparency.
• Court controlled the flow of information.
24. TIMELINESS
• Complex, high profile cases, like the fictional chancery
case of Jarndyce and Jarndyce that Charles Dickens
describes in Bleak House, have the potential to “drone
on.”
• There is a delicate balance between affording litigants
and their counsel sufficient time to adequately brief and
prepare their cases and ensuring the “just, speedy, and
inexpensive determination of every action” as required by
Rule 1.
25. TIMELINESS IN
LEAD PAINT CASE
• Initial conference with the parties – December 17, 2007
• Briefing concluded by – April 16, 2008
