response, POM Wonderful is suing Coca-Cola
under the Lanham Act, which permits
companies to pursue legal action against
competitors who unfairly alter the market by
selling products that are misrepresented in
some way. Coca-Cola, however, contends
that the juice label complies with FDA
requirements. The Supreme Court must
determine whether an FDA-compliant label
can be considered false advertising.
