It is a fact that plastics waste constitutes a significant portion of the total municipal solid waste (MSW) generated in India. Plastics are non-biodegradable and remains on earth for thousands of years. The burning of plastics waste under uncontrolled conditions lead to generation of different hazardous air pollutants (HAPs), depending upon the type of polymers and additives used. However, the end-of-life plastics can be recycled into a second life application but after every thermal treatment/recycling deterioration in quality of recycled plastic products. Thus, plastic waste can be recycled only 3-4 times. The visibility of huge quantity of plastic waste has been perceived as a serious problem and made plastics a target in the management of solid waste. Further, some of the plastic waste like thermoset plastic waste can’t be remoulded / recycled and may cause environmental issues.

BILL SUMMARY
Object & Reasons:
• The Bill seeks to establish Real Estate Regulatory Authorities (RERAs) at the state
level for the regulation and development of the real estate sector.
• Aims to: (a) ensure consumer protection, and (b) standardise business practices and
transactions in the real estate sector.
PARTICULARS DETAILS
Applicability Whole of India except the State of Jammu and Kashmir
Promoter Defined • A person who constructs or causes to be constructed an
independent building or a building consisting of apartments, or
converts an existing building or a part thereof into apartments, for
the purpose of selling all or some of the apartments to other persons
and includes his assignees and also includes a buyer who
purchases in bulk for resale; or
• A person who develops a colony for the purpose of selling to other
persons all or some of the plots, whether with or without structures
thereon; or
• Any development authority or any other public body; or
• An apex State level co-operative housing finance society and a
primary co-operative housing society which constructs apartments or
buildings for its Members or in respect of the allottees of such
apartments or buildings; or
• Any other person who acts himself as a builder, colonizer,
contractor, developer, estate developer or by any other name or
claims to be acting as the holder of a power of attorney from the
owner of the land on which the building or apartment is constructed
or colony is developed for sale; or
• Such other person who constructs any building or apartment for
sale to the general public.
Deemed Promoter If the person who constructs or converts a building into apartments or
develops a colony for sale and the persons who sells apartments or plots
are different persons, both of them shall be deemed to be the promoters;

It means any person, who negotiates or acts on behalf of one person
in a transaction of transfer of his plot, apartment or building, as the case
may be, in a real estate project, by way of sale, with another person or
transfer of plot, apartment or building, as the case may be, of any other
person to him and receives remuneration or fees or any other charges
for his services whether as a commission or otherwise and includes a
person who introduces prospective buyers and sellers to each
other for negotiation for sale or purchase of plot, apartment or building,
as the case may be, and includes property dealers, brokers,

Real Estate Project
defined
‘‘real estate project’’ means the development of a building or a building
consisting of apartments, or converting an existing building or a part
thereof into apartments, or the development of a colony into plots or
apartments, as the case may be, for the purpose of selling all or some of
the said apartments or plots or buildings and includes the development
works thereof;
Commercial & residential
real estate
Both Commercial and residential projects are covered under the Bill

Regulation for real
estate agents
(Mandatory Registration)
No real estate agent shall facilitate the sale or purchase of or act on
behalf of any person to facilitate the sale or purchase of any plot,
apartment or building, as the case may be, in a real estate project or part
of it, being the part of the real estate project registered under section 3,
being sold by the promoter in any planning area, without obtaining
registration under this section.
Unfair Practice unfair practice means a practice which, for the purpose of promoting the
sale or development of any real estate project adopts any unfair method
or unfair or deceptive practice including any of the following practices,
namely:—
(A) the practice of making any statement, whether orally or writing or by
visible representation which,—
(i) falsely represents that the services are of a particular standard
orgrade;
(ii) represents that the promoter has approval or affiliation which
such promoter does not have;
(iii) makes a false or misleading representation concerning the
services;
(B) the promoter permits the publication of any advertisement or
prospectus whether in any newspaper or otherwise of services that are
not intended to be offered.
Regulation for Promoter
(Mandatory Registration)
Every promoter shall make an application to the Authority for
registration of the real estate project
Escrow Account Fifty per cent of the amounts realised for the real estate project from
the allottees, from time to time, shall be deposited in a separate account
to be maintained in a scheduled bank within a period of fifteen days of its
realisation to cover the cost of construction and shall be used only for
that purpose.
Effect of revocation of
registration of promoter
for a project
He/she shall be debarred from accessing its website in relation to that
project
specify his/her name in the list of defaulters on its website
inform the other Real Estate Regulatory Authorities in other States and
Union territories about such cancellation;
(b) may recommend to the competent authority to facilitate the balance
of the development works to be carried out in accordance with the
instructions of the competent authority;
Appeal in case of
revocation
A remedy of appeal has been provided to the promoter in this matter
since the competent authority shall not conduct the work as per its
instructions before the expiry of the time of appeal.
Duties of Real State
Agents
• not facilitate the sale or purchase of any plot, apartment or building,
as the case may be, in a real estate project or part of it, being sold by

3. the promoter in any planning area, which is not registered with the
Authority;
• maintain and preserve such books of account, records and
documents as may be prescribed;
• not involve himself in any unfair trade practices,
• facilitate the possession of all documents, as the allottee is entitled
to, at the time of booking of any plot, apartment or building, as the
case may be;
Functions and duties of
the promoter
The promoter must
• make information about the project such as updates on the
construction of buildings available to the allottee
• compensate the allottee on any damages incurred as a result of false
advertising; and
• not accept more than 10% of the total cost of the building without
entering into a written agreement with the allottee. If the promoter is
unable to give possession of the building to the allottee he or she is
liable to return the entire amount given to him by the allottee with
interest.
Rights and Duties of
Allottees
Right to obtain stage-wise time schedule of project;
• Claim possession as per promoter declaration;
• Refund with interest and compensation for default by the promoter;
• Allottees to make payments and fulfil responsibilities as per
agreement;
Real Estate Regulatory
Authority (RERA)
RERAs must be established by the appropriate governments. Two or
more state governments can establish a RERA jointly, and conversely, a
state can have more than one RERA. Each authority will consist of a
chairperson and two or more full time members. Key functions of the
RERA include (a) rendering advice to the appropriate government on the
development of the real estate sector and (b) maintaining and publishing
records relating to real estate projects on its website. The RERA might
conduct an inquiry into the affairs of, issue directions to, and penalise
any (a) promoter, defined as any person or public authority concerned
with the development of land for the purpose of selling, (b) allottee,
defined as a person who is allotted, or purchases the building, plot or
apartment or (c) real estate agent if required. It may refer the case to the
Competition Commission of India.
Central Advisory Council
(CAC):
The CAC will be chaired by the head of the Ministry of the central
government dealing with housing and will consist of members from other
concerned ministries, state governments and private members. It will
advise the central government on matters concerning the implementation
of the Act, especially relating to consumer protection, and policy matters.
Offences, penalties and
adjudication
The Bill outlines various penalties for non- compliance with the
provisions of the Act. Penalties for a promoter are up to 10% of the total
cost of the real estate project and penalties for allottees are up to 10% of
the total cost of the apartment, for various offences. Adjudicating officers
shall determine compensation to allottees.
Finance, accounts,
audits and reports
The RERA may receive funds from the central and state governments. A
‘Real Estate Fund’ shall be created to collect these funds. The
Comptroller and Auditor General shall audit the accounts of the RERA
and the RERA shall publish an annual report detailing its activities
Real Estate Appellate
Tribunal
A tribunal, consisting of a chairperson and two members, shall be
established to settle disputes related to the provisions in the Act. It shall
have the powers of a civil court.
