The Convention on the Rights of the Child is the first legally binding international instrument to incorporate the full range of human rights—civil, cultural, economic, political and social rights. In 1989, world leaders decided that children needed a special convention just for them because people under 18 years old often need special care and protection that adults do not. The leaders also wanted to make sure that the world recognized that children have human rights too.

2. Artículo 1 del Título Preliminar del Código del Niño y Adolescente
ARTÍCULO 1- del código del
niño y del adolescente.
ANALISIS DOCTRINA JURISPRUDENCIA
- Se considera niño a todo ser
humano desde su concepción
hasta cumplir los doce años de
edad y adolescente desde los doce
hasta cumplir los dieciocho años de
edad.
El Estado protege al concebido
para todo lo que le favorece. Si
existiera duda acerca de la edad de
una persona, se le considerará niño
o adolescente mientras no se
pruebe lo contrario.
1. Por lo tanto en lo que respecta al código
del niño y del adolescente podemos decir que
el estado o las entidades correspondientes
tienen la obligación de proteger al menor o al
adolescente hasta que este pueda cumplir su
mayoría de edad o hasta que pueda madurar
psicológicamente y físicamente.
2. Sin duda los derechos del niño y
adolescentes es importante conocerlos y
aplicarlos ya que el niño disfrutará de todos
los derechos enunciados en esta Declaración
y estos derechos serán reconocidos a todos
los niños sin excepción alguna ni distinción o
discriminación por motivos de raza, color,
sexo, idioma, religión, origen nacional o
social, posición económica, nacimiento u otra
condición hasta que cumpla la mayoría de
edad y que debemos velar y cumplir por el
bienestar de los niños y adolescentes.
La doctrina de la Protección
Integral se funda básicamente en
la Convención sobre los Derechos
del Niño de 1989, que reconoce
los derechos del niño, como una
categoría específica dentro de los
derechos humanos, a decir del
profesor Miguel Cillero. La
Convención sobre los Derechos
del Niño es un instrumento de
derechos humanos que concibe
al niño, no como objeto de
derechos, sino como sujeto de
derecho, lo que desde ya fue un
avance y permite que varios
países de Latinoamérica se
encuentren reformulando sus
legislaciones.
-El presente Código reconoce
que la obligación de atención al
niño y al adolescente se
extiende a la madre y a la
familia del mismo.
-Desde el 24 de diciembre de
1992 se recogió en un solo
instrumento jurídico, la
legislación especial para
custodiar los derechos de los
niños y adolescentes, en el
Código del Niño y del
Adolescente.
