SOLICITĂ
Adoptarea, în lectura a II–a a proiectului de lege nr. 301 pentru modificarea și completarea unor acte legislative cu amendamentele menționate în prezentul apel, luând în considerare recomandările făcute pe marginea acestuia de organizațiile naționale în cadrul consultărilor publice din octombrie 2019 și a organizațiilor internaționale.

Organizațiile societății civile solicită fracțiunilor parlamentare să accepte amendamentele la
Proiectul de lege nr. 301 cu privire la sancționarea faptelor motivate de ură și prejudecată
11 februarie 2020
Pe data de 8 decembrie 2016, Parlamentul Republicii Moldova a aprobat, în prima lectură, proiectul
de lege nr. 301 (varianta comasată cu proiectul nr. 277 din 20.06.2016) pentru modificarea și
completarea unor acte legislative privind reglementarea infracțiunilor motivate de prejudecată.
Proiectul de lege nr. 301 reprezintă un set de amendamente legislative ale Codului penal și Codului
contravențional, care se referă în primul rând la definirea motivelor de prejudecată, revizuirea
infracțiunilor de bază și a agravantelor care vizează faptele motivate de ură și prejudecată.
Ulterior, acest proiect de lege a fost remis Ministerului Justiției pentru revizuire. Iar, pe data de 22
octombrie 2019, au fost organizate consultări publice cu reprezentanții societății civile, membrii
comisiilor parlamentare (Comisia pentru Drepturile Omului și Relații Interetnice, Comisia Juridică,
Numiri și Imunități) și reprezentanții Ministerului Justiției.
În cadrul acestei consultări, Asociația Promo-LEX și Centrul de Resurse Juridice din Moldova au
prezentat o opiniei cu privire la proiectul de lege prin care recomandă:
1. Excluderea alin. (2) din articolul 346 al Codului Penal, din versiunea actualizată a
proiectului.
2. Completarea Codului Contravențional la categoria contravențiilor ce atentează la
drepturile politice, de muncă şi la alte drepturi constituționale ale persoanei fizice
cu următoarea prevedere:
Articolul 701. Instigarea la ură, discriminare sau violență
Instigarea la ură, discriminare sau violență, adică răspândirea în public și mass-media a
mesajelor în formă scrisă, desen sau imagine, îndemnurilor, amenințărilor și informațiilor
motivate de prejudecată, față de o persoană sau un grup de persoane, dacă fapta nu
reprezintă o infracțiune,
se sancționează cu amendă de la 20 la 40 de unități convenționale sau cu muncă
neremunerată în folosul comunității de la 20 la 40 de ore.
3. Completarea articolului 400, Cod Contravențional, cu includerea responsabilității de
sancționare a faptelor stabilite de norma propusă (articolul 701) în competența
poliției. Astfel, a se completa articolul 400, alineatul 1 după cum urmează: După fraza
”(1) Contravențiile prevăzute la art.47, art.481 alin.(5), art.49, 50, 52, 54”, sintagma ”69-
71” se substituie cu sintagma ”69, 70, 701, 71”.
În urma consultării publice, amendamentele la proiectul de lege nr. 301 urmau să fie prezentate și
discutate în cadrul comisiilor și fracțiunilor parlamentare pentru atingerea unui consens general.
Comisia Juridică, Numiri și Imunități va examina acest proiect de lege la 11 februarie 2020 pentru
votarea în lectura a doua. Din păcate, aceste amendamente nu au fost introduse în proiectul de lege
care urmează a fi examinat de Comisia Juridică la 11 februarie 2020.
2. În acest sens, mai multe organizații ale societății civile reiterează importanța acceptării
amendamentelor formulate de organizațiile neguvernamentale pentru aplicarea cât mai eficientă a
viitoarelor prevederi din Codul Penal și Codul Contravențional.
Astfel, în contextul introducerii pe agenda parlamentară a proiectului de lege nr. 301, organizațiile

Adoptarea, în lectura a II–a a proiectului de lege nr. 301 pentru modificarea și completarea unor
acte legislative cu amendamentele menționate în prezentul apel, luând în considerare
