Et kvasi-medlemskap i EU? der EFTA-statene balanserer mellom fordelene av full markedsadgang og den suverenitet man (uformelt) oppgir.
En asymmetrisk og dynamisk beslutningsstruktur 1. Ved avtalens inngåelse forpliktet EFTA-statene seg til å inkorporere det eksisterende EU-regelverk i sine nasjonale lovverk. 2. EU har den formelle initiativretten til nye EØS-regler, ved at nye EU-regler automatisk blir forslag til nye EØS-regler. 3. Men EFTA-landene har ingen formelle rettigheter til å påvirke EUs prosesser. Visse påvirkningsmuligheter gjennom: a. EFTA-eksperters deltakelse i de forberedende komitéene b. Fortløpende kontakter forut for EU-vedtak i EØS-komitéen 4. Ettersom EFTA ikke er en overnasjonal organisasjon må medlemslandene forhandle fram et felles standpunkt i EFTA-komitéen. 5.Når de nye forslagene behandles i EØS-komitéen har EU og EFTA én stemme hver og Komitéen kan bare si ja eller nei (ikke endre) til forslagene. 6. Et nei fra EFTA vil kunne lede til at EU sier opp de berørte delene av avtalen, eller over tid hele avtalen. Ved et ja forplikter så den enkelte EFTA-stat seg til å vedta de nye reglene, som lover eller forskrifter Nasjonal iverksetting ” Ensartethet" bestemmelsen skal fortolkes og praktiseres likt i alle land - og tolkes på samme måte som de EF-bestemmelsene den er kopiert fra. Forrang Dersom en EØS-regel kommer i motstrid til norsk lov skal EØS-regelen gå foran. Overvåkning På EFTA-siden kontrolleres iverksettingen av et spesielt overvåkningsorgan (ESA), som igjen innbringer saken for EFTA-domstolen. Den kan pålegge statene å endre praksis. Reservasjonsretten innebærer ikke mer enn at én av partene - dvs. EFTA eller EU- kan reservere seg i en periode på to ganger seks måneder dersom partene ikke er enige om hvordan en rettsakt skal integreres i EØS-avtalen. Etter tolv måneder åpnes det for mottiltak - dvs. at annen nærliggende lovgivning suspenderes frem til en løsning finnes på hvordan rettsakten kan bli del av EØS-avtalen. Omfanget av den suspenderte lovgivningen bestemmes av partene i EØS-komitéen, i praksis Europakommisjonen - fordi EU har adskillig større økonomisk og politisk tyngde enn de tre små EFTA-statene. Dette kom klart til uttrykk da den islandske utenriksminister- i dag statsminister - Halldor Ásgrimsson på EFTA-landenes ministermøte i 1999 uttalte at å bruke reservasjonsretten var ensbetydende med MAD- Mutually Assured Destruction. I land som til daglig tvinges tilå kompromisse på politisk følsomme og økonomisk vanskelige områder blir de norske innvendinger sett på som nok et krav om særbehandling. Særbehandling for et av de rikeste landene i verden som ikke vil delta i felles anstrengelser forå hjelpe andre land til å oppnå vår egen levestandard.
