Electronic Disclosure – a review of the law and a few practical tips
                        Tuesday, 24 May 2011 5.30pm – 6.30pm

                                           1 Hour CPD

WHO SHOULD ATTEND?

All professionals who use electronic disclosure and discovery in litigation cases

THE PROGRAMME

It is now estimated that at least 90% of all communication is done electronically. Although the rules of
disclosure in litigation have not dramatically changed over the past 15 years, the way in which
documents are searched for, catalogued, preserved and disclosed has changed dramatically, with
many solicitors unsure of the power of computers and how to unleash their potential. This talk will look
at key important issues in electronic discovery and will cover some of the following topics:

    1. The meaning of a “document” under the CPR 31.
    2. The duty of search for relevant documents.
    3. The type of document and the evidence it can reveal.
    4. Preserving documents.
    5. The costs of searching. Listing and how to do it economically.

THE SPEAKER

Elizabeth Ward runs a boutique practice in Chapel Allerton Leeds. Before starting Virtuoso Legal she
worked for a number of national firms and prior to that she was a biochemist working in the
pharmaceutical industry. Liz’s practice covers intellectual property and information technology. She
assists a number of companies exploiting and defending their intellectual capital. Liz also routinely
deals with the laws of confidence and helps people precipitate evidence from hard drives and servers.
Her expertise includes being a Supervising Solicitor and working for Claimants and Defendants who
are the subject of search orders. Liz routinely looks at electronic disclosure and can provide a few
practical pointers for those less familiar with IT systems.
