1. 2G Case: Delhi Court Exempts Anil Ambani from
Appearing as Witness Today
Reliance ADAG chairman Anil Ambani was on Thursday exempted by a Delhi court
from appearing in person before it on Friday as a witness in the 2G spectrum allocation
trial.
“Anil D Ambani has been summoned and served for tomorrow, but a request has been
received from him through Sanjay Subarna on account of paucity of time as summons
was served upon him only on 23.07.2013 and he has requested that he may be
summoned in later half of August 2013. Allowed,” said Special CBI judge OP Saini.
The court did not set a date for the next hearing. Lawyers representing Ambani had
moved the trial court after the Supreme Court refused to give an urgent hearing to
Reliance Telecom's plea and moved it instead to Monday. Justice GS Singhvi said that
he would hear it only on Monday, when he was sitting with Justice KS Radhakrishnan,
the other judge who’s part of the bench monitoring the 2G case in the top court. “We
will hear it on Monday,” said Justice Singhvi.
In the Supreme Court, RTL's legal counsel Mukul Rohatgi was denied an early hearing
of its plea that sought to stymie the Central Bureau of Investigation’s plea to summon
Ambani and his wife, Tina Ambani, along with 11 others as prosecution witnesses.
The court had dismissed the lawyer's contentions that CBI's plea “suffers from the vice
of delay”, saying the process of examination of prosecution witnesses is still
underway.
RTL had challenged the order of special court summoning the couple as prosecution
witnesses on CBI's plea that their testimony would throw light on ADAG's companies’
alleged investment of over Rs. 990 crore in Swan Telecom. RTL is one of the three
companies accused of obtaining airwaves despite being ineligible. The CBI alleged in
its chargesheet that the company used an ineligible firm, Swan Telecom, as a front to
get mobile permits and spectrum. Three of the company’s senior executives — Gautam
Doshi, Surendra Pipara and Hari Nair — are accused in the case, along with 11 others,
for alleged fraud. Swan Telecom is also facing trial in the case along with its
promoters, Shahid Balwa and Vinod Goenka.
