Ariyah
Fikih – 5th Grade
Borrowing in jurisprudential terms is called ariyah.
That is, members allow others to take advantage in a
legitimate manner without changes to the goods and
returned to their owners.
Borrowing is a natural part of the life of society.
But arbitrarily without coupled with responsibility. We
must keep the feelings of others and maintain the
condition of the borrowed items, so helping elements
remain intact and do not give rise to disputes.
‫وا‬ُ‫ن‬َ‫او‬َ‫ع‬َ‫ت‬َ‫و‬
َ‫ت‬ ‫ال‬َ‫و‬ ‫ى‬َ‫و‬ْ‫ق‬َّ‫ت‬‫ال‬َ‫و‬ ِِّ
‫ر‬ِ‫ب‬ْ‫ل‬‫ا‬ ‫ى‬َ‫ل‬َ‫ع‬
ِِ ْْ‫اثإ‬ ‫ى‬َ‫ل‬َ‫ع‬ ‫وا‬ُ‫ن‬َ‫او‬َ‫ع‬
ُ‫ع‬ْ‫ل‬‫ا‬َ‫و‬
ِ‫ان‬َ‫و‬ْ‫د‬
“And please help you in (doing) goodness and piety, and do
mutual assistance in sin and enmity “
(Q.S. al-Maidah/5:2).
The law of borrowing
• The original law of borrowing is be permitted. For
example, to borrow money to pay for study.
• Obligation, means borrowing undertaken an urgent
need and if the borrowing will cause great losses and
damage. For example borrowed gloves to close the
genitals and otherwise would borrow nude.
• Haram, means that borrowing is done for
disobedience
The Pillars of Borrowing, are :
People who lend (mu’ir)
• Baligh or adult
• Sensible
• Not waster
• Not forced
People who borrow (musta’ir)
• Baligh or adult
• Sensible
• Not mubadzir ( wasters).
Objects on loan (musta’ar)
• Can be utilized
• Benefits still exist at the time of consent
qabul
• Benefits owned by the people who lend. It
means that borrowing should not and do
not have the right to lend borrowed items
to others.Ijab qabul
• Clear and easily understood by both
parties
• Continuous between consent and qabul
The Obligation of Borrowers
Between the lender and the borrower must always
preserve the rights and obligations of the borrowing
Rights and obligations of lenders :
• Submit items borrowed, willingly and
voluntarily
• Objects on loan are fixed and benefit of
halal member
• No element of riba.
Rights and obligations of the borrower
• Maintaining the borrowed items with full of
responsibility
• Return the borrowed items on time and
intact
• If the costs to be borne by the borrower.
During the borrowed item is on the borrower,
the responsibility is fully belongs to him
CRITICAL THINKING
Why should we avoid debts
for goods or money and
pawns?
When we have debt, there
is no certainty when we
should be able to return it
and there is also no
guarantee of the age when
we are due to pay, that age
is no longer there.
Borrowing goods at
anytime has a high risk
because the goods we
use must have a
shrinkage value that
will harm the owner,
use this life by staying
away from debt,
borrowing and
pawnshops.
•at a much lower price than if we sell
the goods ourselves, consequently in the
process. pawning goods, the owner of
the goods will be very disadvantaged.
Pawning the goods will also become usury, the
goods that we deposit as collateral to arrive
at a predetermined time limit, if the goods
are not able to pay off then the goods will be
auctioned,
