PREPARATION
The viva-voce of the 17th
BJS is knocking at the door. I am sharing some tips for this
exam. Firstly, you have to be patient for doing better in viva. You will definitely be
asked some unknown or uncommon questions. This is very much normal. So, do not over
think about this. The criteria for passing the viva is not to answer all the questions
correctly. This is not possible at all. You have to say “Sorry, I do not remember the
answer at this moment” in terms of some questions. Take it as normal.

Secondly, you have to know about the question zone from which question may be asked. The
common questions zones are- the Code of Civil Procedure(CPC), 1908; the Code of Criminal
Procedure, 1898; the Penal Code,1860; the Evidence Act,1872; Constitution; the Specific Relief
Act(SR),1877; the Transfer of Property Act,1882; the Contract Act, 1872; the State Acquisition
and Tenancy Act, 1950; the Non-agriculture Tenancy Act, 1949; the Niri-o-Sishu Nirjaton Domon
Ain, 2000; the Sishu Ain,2013; Muslim Law of Succession and Hindu Law of Succession etc. Try
to know more details about these laws and make your own notes.

You can use the books, notes and questions from which you took your preliminary preparation in this regard. This
is an effective method. Try to write down the similar types of questions in a note book. This is very helpful. Don’t
be nervous. This is a viva only. You can definitely do better in this as you have completed the major portion of
your journey of BJS exam. Take it seriously without being panic. Simple and unique method is that you have to
use your everyday morning for taking preparation for viva. Your brain can store more information in a very short
period then. Try to avoid the bad habit of going to bed in the late night. This is not good at all specially in this
time. There exit inter-relations among the different laws. Try to read the following example.

“Section: 09 of the CPC: The Courts shall (subject to the provisions herein contained) have jurisdiction to try all suits of a civil nature
excepting suits of which their cognizance is either expressly or impliedly barred.
Explanation.-A suit in which the right to property or to an office is contested is a suit of a civil nature, notwithstanding that such right may
depend entirely on the decision of questions as to religious rites or ceremonies.”
In this section which courts (name of the courts/forum) will try a civil suit, this information has not been mentioned.

In Section 3 of the Civil Courts Act, 1887 (“Classes of Civil Courts”) this information has been mentioned.
“3. There shall be following classes of Civil Courts, namely:-

(c) the Court of the Joint District Judge;
(d) the Court of the Senior Assistant Judge; and
(e) the Court of the Assistant Judge.”

suit, this information has not been mentioned.
In Sections 18, 19, 20 and 21 of the Civil Courts Act, 1887 this information has been

been mentioned in Sections 15,16,17,18,19,20,21,22,24,24,24A of the CPC, 1908.

Suppose, ‘A’ is entitled to the possession of 15 acres of land and ‘B’ dispossessed ‘A’ from this 15 acres of land without
due process of law. In this context ‘A’ may recover his land in the manner prescribed by the Code of Civil Procedure,
1898. (Reference: Section 08 of the SR Act, 1877). Suppose the price of this land is 17 lacks. Then you have to go to the
Senior Assistant Judge Court. (Reference: Section 19 of the Civil Courts Act, 1887 and Section 15 of the CPC, 1908.)
But this these laws the limitation period of this kind of suit has not been mentioned. It has been mentioned in the
Limitation Act, 1908.
Try to find out this type of information and make your own notes. This will help you to understand the laws more
effectively.

controlling capacity, anger management limit, critical situation

website to know about the things you have to carry with you in the viva voce. You
have to know about the exact time and date of your viva.
