• In 2016, the Florida Legislature appropriated $275,000 to the Palm Beach
County State Attorney’s Office to:
• “Conduct a study aimed to strengthen investigation and prosecution of
criminal and regulatory violations within the substance abuse treatment
industry” and
• “Identify statutory clarifications and enhancements to existing law to
ensure that communities remain safe and individuals with substance use
disorders are protected.”

• At the same time, we empaneled a Grand Jury, which issued a
Special Presentment on December 8, 2016 entitled “Report on
the Proliferation of Fraud and Abuse in Florida’s Addiction
Treatment Industry.”

Information from the Drugs Identified in Deceased Persons by Florida Medical Examiners Report shows a steady increase in the number of deaths in which oxycodone was identified as the primary cause of death from 2003 to 2010. In 2011, we see the first decrease-almost 18%. Since 2011 the number of deaths continues to decrease substantially and in 2015 deaths were reduced by 63% (62.7%) from their peak in 2010.
So we’ve talked about outcomes related to pain management clinics, prescribers, dispensers and patients since implementation of legislation aimed at curbing prescription drug abuse and diversion. I’d like now to talk about the department’s activities related to an emerging issue: complaints from patients with prescriptions for pain treatment who are facing challenges with having their prescriptions filled. The department is concerned and in addition to exploring its statutory authority to address the issue, we have had extensive and open dialogue with key stakeholders: Physicians, leaders in corporate pharmacies, Pharmacists who work in chain and independent settings, and Wholesaler distributors. Two common themes have emerged. First, the system for delivering needed medications to Florida patients has been eroded by a lack of trust and confidence; and second, there is no one single entity in the system that can provide the solution. We are proud to announce that the Florida Board of Pharmacy has brought pharmacists, physicians, consumers and wholesalers to the table to identify solutions and ways to strengthen collaboration and education and to shore up confidence in the system.
