THE ADVOCATES ACT, 1961

2. In India, the law relating to the Advocates is the Advocates
Act, 1961 introduced and thought up by Ashoke Kumar Sen,
the then law minister of India, which is a law passed by the
Parliament and is administered and enforced by the Bar
Council of India. Under the Act, the Bar Council of India is
the supreme regulatory body to regulate the legal profession
in India and also to ensure the compliance of the laws and
maintenance of professional standards by the legal
profession in the country. For this purpose, the Bar Council
of India is authorized to pass regulations and make orders in
individual cases and also generally.

3. An advocate is an officer of the court and with that privilege
responsibility must follow in its wake. His primary allegiance is to the
court and it is no part of the professional duties of an advocate to act
merely as a mouthpiece of his client. A member of the bar should use
best efforts to restrain and prevent his client from resorting to any
unfair or sharp practice.-AIR 1979 NOG 96.

(a) To admit persons as advocates on its roll
(b) to prepare and maintain such roll
(c) to entertain and determine cases of misconduct against advocates on its roll
(d) to safeguard the rights, privileges and interests of advocates on its roll
(e) to promote and support law reform
(f) to manage and invest the funds of the Bar Council
(g) to provide for the election of its members
(h) to perform all other functions conferred on it by or under this Act

5. (a) He is a citizen of India: Provided that subject to the other
provisions contained in this Act, a national of any other
country may be admitted as an advocate on a State roll, if
citizens of India, duly qualified, are permitted to practice law
in that other country;
(b) He has completed the age of twenty-one years
(c) He has obtained a degree in law from any University
recognized by Bar Council of India
(d) He has Paid The enrolment fee to the State Bar Council.
