The offer embodied in this quotation shall remain in effect for 90 days from the date shown above, and is
subject to approval of credit. Deliveries quoted are subject to prior sale. The purchaser agrees to save this
company harmless for infringement of any letter of patents, copyrights, trademarks, and trade names which
may arise thru the filling of the order of the purchaser by this company. Any deviation of quantity, quality or
specification from the purchaser’s order must be brought to the attention of this company within 15 days
receipt of material.
Nicomatic products are warranted to be free from defects in material and workmanship for a period of 12
months from the date of shipment provided they are used according to Nicomatic’s recommended usage .
Nicomatic’s liability is limited to repair of, refund or purchase price paid for, or replacement in kind at
Nicomatic’s sole option. Except as stated above, Nicomatic makes no warranties with respect to Nicomatic
products or their quality and hereby expressly disclaims all other warranties of any kind, whether express ,
implied or statutory, including but not limited to the implied warranties of merchantability and of fitness for a
particular purpose (and any warranty of non-infringement).
Under no circumstances shall Nicomatic be liable for any special, indirect, incidental or consequential
damages of any kind or nature whatsoever arising out of or in any way related to its products or the use or
inability to use its products, including, without limitation, lost profits, lost goodwill, and whether arising out of
breach of warranty, breach of contract, tort (including negligence), strict liability or otherwise, even if
advised of the possibility of such damage or if such damage could have been reasonably foreseen.
Responsibility of this company shall cease upon delivery to and receipt by common carrier. This company
shall not be held responsible or liable for any loss, damage, detention or delay caused by fire, strike, civil or
military authority, or by insurrection or riot, or by any other cause which is unavoidable or beyond its
reasonable control. All tools, dies, and fixtures made by this company are to remain our property, after
completion of order, unless otherwise specified. Any change in material, quantity, specifications, or
tolerances might affect the price quoted above.
