  2. 2.  There is no statutory entitlement to be paid while out of work due to illness However provision can be made in the contract of employment The employer is obliged to provide this information under the Terms of Employment(Information) Act, 1994
  3. 3.  The employee may qualify for illness benefit from the Department of Social Protection If contract of employment provides for sick pay then the employer will expect any sick benefit to be paid over to her
  4. 4.  The contract of employment should also provide clear rules and procedures surrounding absence due to sickness This should cover the provision of a medical certificate It may also provide for the employee to be seen by the company doctor
  5. 5.  Many think that it is not possible to terminate the contract of employment while the employee is out sick This is not true: it is possible but needs to be handled carefully (take professional advice if you are the employer)
