Mark Davis has been charged with Driving While Intoxicated (DWI) for reckless driving, speeding, four counts of felony assault, and one count of involuntary manslaughter as the result of a crash that occurred on a night out with his friends. Mark has been out on bail and pleaded not guilty when he was arraigned. The Judge set a date for Mark's trial and his defense team has been working to collect information about the technology used by the Highway Patrol to reconstruct the crash.
District Attorney O'Malley offered Mark a plea bargain, but Mark chose to take his chances at trial. Mark's attorney, Mr. Chen Long, advised Mark that accepting the plea offer was completely up to Mark, although Mr. Long advised against accepting it because the defense planned to highlight mistakes made by law enforcement during the investigation that could create reasonable doubt in the minds of the jurors.
The trial begins and during the voir dire of potential jurors, several individuals are excused because they have previous knowledge of Mark's case from the media. Two individuals stated that they could not be impartial because they had loved ones killed in alcohol related crashes as well. Eventually, two men and ten women were seated in Mark's trial.
District Attorney O'Malley presented the State's case clearly and concisely depicting a night on the town full of heavy drinking, which ultimately resulted in Mark's actions causing the death of one individual and injuring four others. Highway Patrolman Green explained to the jury that he immediately suspected alcohol when he arrived on scene because Mark appeared to be intoxicated when they spoke. Following the Judge ruling that it was admissible and not prejudicial, Sergeant Rodney Monroe, from the Highway Patrol Reconstruction Team presented their reconstruction complete with a high-tech computer animated reenactment of the crash. Kayin is an eight-year-old boy in the third grade. His teacher, Mr. Bledsoe, has been very concerned about his problems with reading. He also has difficulty socially, and seems withdrawn, with few, if any, friends. Kayin avoids eye contact with most people, but this is more pronounced with adults. He also becomes very frustrated at times, crying and ripping up his work.
Kayin has been enrolled in the same school since kindergarten. However, Mr. Bledsoe knows that his family is originally from Nigeria and they return every summer to visit family. Although Kayin’s parents speak English fairly fluently, they have a pronounced African accent. Mr. Bledsoe remembers learning that it is an act of respect to avoid eye contact with adults in some cultures, but he cannot remember whether this is true of Nigerian culture.
Mr. Bledsoe has been hesitant to raise the possibility of a disability because he does not know how much of Kayin’s struggles can be attributed to growing up in a bicultural and bilingual home or to Kayin’s own personality.

Professionals must work with families to understand cultural and linguistic characteristics specific to each child. This is critical in determining whether a child’s experiences are typical of someone coming from a different background as opposed to a true disability. These issues can be complex as exceptionalities are seen across cultures as well.
Review the following scenario:
Kayin is an eight-year-old boy in the third grade. His teacher, Mr. Bledsoe, has been very concerned about his problems with reading. He also has difficulty socially, and seems withdrawn, with few, if any, friends. Kayin avoids eye contact with most people, but this is more pronounced with adults. He also becomes very frustrated at times, crying and ripping up his work.
Kayin has been enrolled in the same school since kindergarten. However, Mr. Bledsoe knows that his family is originally from Nigeria and they return every summer to visit family. Although Kayin’s parents speak English fairly fluently, they have a pronounced African accent. Mr. Bledsoe remembers learning that it is an act of respect to avoid eye contact with adults in some cultures, but he cannot remember whether this is true of Nigerian culture.
Mr. Bledsoe has been hesitant to raise the possibility of a disability because he does not know how much of Kayin’s struggles can be attributed to growing up in a bicultural and bilingual home or to Kayin’s own personality.

Owen Monie was the sole incorporator of Swimper, Inc., a corporation designed to operate a swimming pool in Tampa that was open 12 months a year. The business was incorporated according to Florida law in January 2013, with Monie as the sole director and shareholder. Owen contributed $95,000 of starting capital, which was just enough to purchase the property, resurface and repair the current pool, finance initial advertising, and leave a reserve of $10,000. The corporation had no liability insurance. On March 15, the pool opened for business. Over the next few months, the corporation operated with a profit. In July, Monie took a two-week vacation in Belize and used a check from the company bank account to purchase his airline ticket. In September, Monie decided to have the pool deck replaced. Because business had slowed and the corporation's bank account did not have sufficient funds, Monie wrote a personal check to cover the work. Monie feared he would not make enough money through the winter to turn a profit, so he decided to take a part-time job selling real estate. Monie used the swimming pool's office phone to make his calls and made a substantial profit. On February 15, a child with a mild learning disability drowned in the pool. The parents brought a suit for wrongful death against Swimper, Inc. and against Monie in his individual capacity as owner. At the time of the suit, the corporation had the $10,000 reserve and less than $1,500 in its bank account. Because of these limited funds, the child's parents hoped to recover most of their damages directly from Monie.

Consider and discuss how the phenomena of prosocial behavior and pure altruism relate to each other and how they differ from each other. Pure altruism is a specific kind of prosocial behavior where your sole motivation is to help a person in need without seeking benefit for yourself. It is often viewed as a truly selfless form of behavior. Provide an example each of prosocial behavior and pure altruism.
