9. Distracted Driving …is the act of driving whilst
engaged in other activities such as;

talking on the phone or to a passenger
eating
reading
looking after children
or anything else that takes the driver’s attention
away from the road.
10. CU80 Offence Code
‘Breach of requirements as to control of the
vehicle, mobile telephone etc.’
As from 20 December 2012
• ’Driver not being in position to have proper control’
• ‘Driver not being in position to have full view’
previously included in MS60 (miscellaneous offences) were
incorporated into offence code CU80, which had previously been
used to identify mobile telephone offences only.
All three offences are specified under section 41D of the Road
Traffic Act 1988 and incur the same level of penalty.
