XI. INTRODUCTION
“Drag racing", when referring to motor vehicle/motorcycle speed
contests done within a controlled and regulated environment and adhering to
safety standards, is not illegal when sanctioned. In the Philippines, there are
automobile clubs and other sports associations which sponsor legitimate
drag racing events in various race circuits.
However, when conducted in public streets, highways and other,
thorough fares without permits and without regard to the safety of:
motorists, spectators and innocent third parties, drag racing becomes a
punishable act.
Many drag racing activities in the past have been reported, and
continue to be reported, especially in certain "hotspots" like Mindanao
Avenue in Quezon City, Diosdado Macapagal Avenue in Pasay City and other
major avenues in urban areas which are wide and with sparse vehicular
traffic for the conduct of unauthorized races. In some instances, these
activities resulted harm to persons involved in the race or not, and unduly

puts at risk motorists who pass through the roads. Based on the traffic
incident statistics report along the road, it recorded 1,416 accidents from
2005 to June, 2011.
Under Republic Act No. 4136 ("RA4136"), otherwise known as the
Land Transportation and Traffic Code, engaging in drag racing constitutes
either a speeding or a reckless driving violation. Section 35 (a) of the law
provides that:
Any person driving a motor vehicle on a highway shall drive the same
at a careful and prudent speed, not greater nor less than is reasonable and
proper, having due regard for the traffic, the width of the highway, and of
any other condition then and there existing; and no person shall drive any
motor vehicle upon a highway at such a speed as to endanger the life, limb
and property of any person, nor at a speed greater than will permit him to
bring the vehicle to a stop within the assured clear distance ahead.
The Metro Manila Development Authority ("MMDA") has issued
Regulation No. 11-003 series of 2011, fixing the speed limit for all types of
vehicles traversing the Macapagal Boulevard at 60 kph. Pursuant to this, the
MMDAissued guidelines harmonizing the said regulation with the ordinances
of Pasay and Parañaque.

Diosdado Macapagal Boulevard is a modern eight-lane road parallel
to Roxas Boulevard running from CCP Complex, Pasay City to Marina
Subdivision, Parañaque City, both in Metro Manila. It was named after
former President Diosdado Macapagal. It is located in the reclamation areas.
This road has 3 major bridges, crossing the 'channels', of which the largest
is the Libertad Channel, where the Libertad Water Pumping Station is
situated. Thanks to intersection reconfiguring around EDSA to relieve traffic,
Macapagal Boulevard is now often used to access the SM Mall of Asia to the
north and Cavite to the south. It is also the main major road in Reclamation
Area.

ALL TYPES OF VEHICLES WHETHER PUBLIC OR PRIVATE INCLUDING
MOTORCYCLES TRAVERSING DIOSDADO MACAPAGAL AVENUE, LOCATED IN
THE CITIES OF PASAY AND PARANAQUE
WHEREAS, the Metropolitan Manila Council has enacted MMDA Regulation
No. 11-003, Series of 2011 wherein the maximum speed limit for all vehicles
traversing DiosdadoMacapagal Avenue was set at sixty (60) kilometers per
hour;
WHEREAS, there is a need to issue guidelines in the imposition of penalties

mandated in the above-mentioned MMDA Regulation and the traffic
ordinances of the cities of Pasay and Paranaque;
WHEREAS, the traffic ordinances of the cities of Pasay and Paranaque
contains similar provisions for speed limits, illegal drag racing/speed
contests, reckless driving, and the corresponding penalties therefore;
NOW, THEREFORE, the following guidelines concerning the imposition of
fines and penalties in implementation of MMDA Regulation No. 11-003,
Series of 2011
Section 1. The maximum speed limit for all motor vehicles traversing
Diosdado Macapagal Avenue shall be sixty (60) km/hr.
Section 2. Depending of the nature and circumstances of each case,
violators of the above maximum speed limit requirement shall be cited either
for:
a. Violation of Section 30 (Speed Limits) of the Paranaque City Traffic
Code, Ordinance No. 05-04 Series of 2004 and Section 30 of the
Traffic Management Code of Pasay City, Ordinance No. 2916 S. 2004,
as amended; which similarly provide that :
"Section 30. Speed Limits.
a. No person shall drive a vehicle at a speed exceeding the design
limits for the street as indicated by numerals on signs set up
along the road.
b. The foregoing provisions of this section shall not apply to the
driver of an emergency vehicle.
c. Nothing in this section shall be construed to justify the diver of a
vehicle driving at a speed which

i. may constitute driving carelessly, recklessly or at a speed
or in a manner which is dangerous to the public having

Main Purpose
Due to many drag racing activities that have been reported, the Metro
Manila Development Authority ("MMDA") has issued Regulation No. 11-003
series of 2011, fixing the speed limit for all types of vehicles traversing the
Macapagal Avenue at 60 kph. The main purpose of it is to prevent the
hazards inherent in drag racing or over speeding of some motorists. The
harm caused by drag racing range from physical injuries and property
damage in case of crashes, damage to roads due to the excessive wear and
tear induced by burning rubber. Other forms of collateral harm include noise
pollution, vandalism and littering. Crimes associated with alcohol are also
likely to arise, since many race contestants and spectators consume it within
the vicinity of drag racing events.
XV. CONCLUSION
Implication
A number of violators were caught by MMDA since the start of the
implementation of this policy. Below is a photo of the first batch of
Macapagal Avenue speed-limit violators.

Based on the photos, the speed guns are positioned at the side of the
road as the photos are taken at street level, allowing the operator to zoom in
on the car's license plate to photograph it as proof. The operator is also able
to photograph the vehicle's rear.
The implementation of this policy eradicated or lessens the high rate of
vehicular accidents caused by illegal drag racing in the area and pedestrian
accidents. This also improved the flow of traffic along Diosdado Macapagal
Avenue.
Opinion
The 60 kph speed limit at DiosdadoMacapagal Avenue implemented by
MMDA is a good and very necessary policy. It helps lessen the possible no.
of car accidents on the road and will promote the smooth flow of traffic in
the given area. It also inculcates discipline to all drivers. The safety of the
commuters and the pedestrians is also observed. Road rage caused by
generally aggressive driving is also minimized and prevented.

Suggestion/ Recommendation
Possible recommendation is to have law enforcers to be always on
duty to maintain and regulate properly the implementation of the said policy.
Additional speed limit signs with the corresponding penalty must also be
placed at the said location to properly inform and remind the motorists of
the policy implemented along the area. A higher penalty for drag racers
must be implemented to minimize or even totally eradicate illegal drag
racing. It is suggested that traffic booth will be placed at the end of the road
so that ticket will be issued to the violator. Lastly, if there is a set maximum
speed limit, it is suggested to also have a minimum speed limit that will help
lessen the traffic jam.
