Compliance to be done by Bulk Consumer under E-waste management rules, 2016
1. ’Bulk Consumer' means bulk users of electrical
and electronic equipment such as:
v Central Government or;
v State Government Departments;
v Public Sector Undertakings;
v Banks, Educational Institutions;
v Multinational Organisations;
v International Agencies;
v Partnership and;
v Public or Private Companies that are
registered under the Factories Act, 1948 (63
of 1948) and the Companies Act, 2013 (18
of 2013) and health care facilities which
have turnover of more than one crore or
have more than twenty employees

‘Consumer’ means any person using
electrical and electronic equipment
excludingthe bulk consumers.{Rule 2(h)}
’E-waste' means electrical and electronic
equipment, whole or in part discarded as
waste by the consumer or bulk consumer
as well as rejects from manufacturing,
refurbishmentandrepair processes;

2. Responsibilities
Compliance
v Consumer/ Bulk Consumer shall ensure that e-waste is
channelised through proper manner as prescribed under
the rules.
v Consumer/ Bulk Consumer shall ensure that such end-
of-life electrical and electronic equipment are not
admixed with e-waste containing radioactive material
as covered under the provisions of the Atomic Energy
Act, 1962 (33 of 1962) and rules made there under.
v Bulk Consumers shall maintain records of e-
waste generated by them in Form-2.
v Bulk consumers file annual returns in Form-3, to the
Board on or before the 30th
day of June following the
financial year.
In case of the bulk consumer with multiple offices in a
State, one annual return combining information from all
the offices shall be filed to Board on or before the 30th
day of June following the financial year.

3. Procedure for storage of e-waste
§ Every Manufacturer, Producer, Bulk Consumer, Collection Centre,
Dealer, Refurbisher, Dismantler and Recycler may store the e-waste for a
period not exceeding 180 days.
§ Provided the Board may extend the said period up to 365 days in case
the waste needs to be specifically stored for development of a process
for its recycling or reuse.

4. Penalties
Whoever fails to comply with or contravenes
any of the provisions shall be punishable with:
• Imprisonment for a term which may extend
to 5 years with fine which may extend to 1
lakh rupees, or with both;
• In case the failure or contravention
continues, with additional fine which may
extend to Rs. 5,000 for every day.
If the failure or contravention continues beyond
a period of 1 year after the date of conviction,
the offender shall be punishable with
imprisonment for a term which may extend to 7
years.
