Your duty of disclosure requires you to tell us everything you
know which is relevant to our decision to insure you and the
terms and conditions on which we insure you. A matter is
relevant if you know it is relevant, or a reasonable person
in the circumstances would know it is relevant.
You don’t have to tell us things which reduce the risk, are
common knowledge, we already know, in the ordinary
course of our business we ought to know, or we indicate
we don’t want to know.
Who does the duty apply to and when does it apply?
The duty of disclosure applies to each insured. It applies
before we accept your contract, and it also applies whenever
we renew, vary or reinstate a contract of insurance.
What happens if you fail in your duty? If you don’t tell us ev-
erything you know that is relevant, we may refuse or reduce
a claim, cancel your policy, or in some cases treat your policy
as never having operated. If you are in doubt it is better to
give us the information than take the risk of failing in your
duty of disclosure.
