Intellectual property (IP) refers to creations of the
mind, such as inventions; literary and artistic
works; designs; and symbols, names and images
used in commerce. IP is protected in law by, FOR
EXAMPLE, Patents, Trademarks, Copyrights, which
enable people to earn recognition from what they
invent or create.

Definition of IPR :-
• The exclusive right given by law for a certain term of years to an author,

(1)ટ્રેડમાર્ક શું છે ?
મૂળ રીતે ટ્રેડમાર્ક એર્ “બ્રાન્ડ” ર્ે “લોગો” છે જેનો ઉપયોગ
તમે તમારા પ્રતતસ્પર્ધીઓથી (competitors)જદી ઓળખ
ઊભી ર્રવા માટે ર્રવામાું આવે છે. ટ્રેડમાર્કનું તમે
રજીસ્ટ્રેશન ર્રાવી શર્ોછો જેનાથી તમે તમારા હરીફોથી
લોગો રજીસ્ટ્રેશન ર્રાવેલ હોઈ તેનો ઉપયોગ ના ર્રવાનો
હક્ક (પ્રતતબુંર્ધ) મેળવી શર્ો છો. જે ના ઉપયોગની સરક્ષા

(III) COPYRIGHTS:: કૉપીરઈટ :- આ ર્ાયદો તવસ્તૃત રીતે સાહહત્ય સર્જન, જેવાુંર્ે નવલર્થા,ર્તવતા, નાટર્, તનબુંર્ધ,
તવવેચન વગેરે માટે, સુંગીતબર્ધ રચનાઓ, ધૂન, ર્ોરીઓગ્રાફી વગેરે અને ચચત્ર અને તશલ્પસ્થાપ્ત્યને રક્ષણ
આપતો હોય છે. જેમાું સાહહત્ય નવસર્જન ને 50 વર્ક અથવા તેના મૃત્ય બેમાું થી જે પ્રથમ હોય તેને ગણતરીમાું
લેવાય છે જો ક્રુતત “તખ્ખખ્ખલશ” થી નોર્ધાયેલ હોયતો 70 વર્ક સર્ધી હક્ક મળતા હોય છે. તેવું બીજી રચનાઓ
માટે પણ હોય છે.

Governed by the Copyright Act 1957. Valid from 21 January 1958. Introduced civil and criminal
remedies against infringement. Term of copyright depends on nature of work/owner of copyright
and whether the work has been published.

• (iv) Design:
• Design means only the features of shape,
configuration, pattern or ornament applied to
any article in any industrial process or means
whether manual, mechanical, chemical,
separate or combined, which is the finished
form appeal to end or judged solely by the eye.
By registration under the designs act, the
features are protected as design.

• Genetic information’s can also be used to cure a disease,
for example using the technology of gene therapy with a
specific gene vector. The direct use of proteins as therapy is
well established, and these products may be patented,
though we should note, in general, that medical procedures
have not been patented for ethical and practical reasons.

• (V) Industrial Property:
• Industrial property includes inventions (process,
products, apparatus); industrial designs (shapes &
ornamentation); and Marks and Trade names to
distinguish goods. Recently, the scope of industrial
property has been expanded to include among others,
the protection of distinctive geographical indications
(in particular appellation of origin), plant varieties and
the layout designs (topographies) or integrated
circuits as well as the repression of unfair competition,
including the protection of trade secrets.

Importance in Indian Scenario:
A US patent granted for use of turmeric powder
(hLdr) as a wound healing agent to the University of
Mississippi, Medical Centre, US, has been revoked
following objections by the Council of Scientific
and Indian Research (CSIR), New Delhi.

• Now patents have already been granted for food
stuffs like idli, dosa, vada, churan, pickle, halwa and
pizza topping. The Indian patents Act 1970 stresses
that any patentable commodity must possess
novelty. Apparently, the Chennai Patent office
believes that South Indian delicacies like “medu
vadai”. “rava-uppuma”, “badam halwa”, “rice idli”,
“rice pongal”, and even Green Peas Masala are
novel process. Patent rights for these popular
preparations were granted to the Dasaprakash hotel
chain in 1973.

The Mumbai office of the Patents has granted one Dilip
Shantaram Dahanunkar, a process patent for the
preparation of tomato rasam and a custard chilli jam
spread used as a pizza topping. The same person has
been given a patent for an improved process for
preparation of vitaminised sweet and sour lemon pickle
rice and a process for manufacturing banana sauce.
The purpose of patenting common products seems to
improve their marketability rather than to protect
“inventions”. Accordingly, inventors blindly exploit legal
loopholes to patent age-old products.

According to Calcutta based patent and trademark attorney, D.P.
Ahuja and company the Patents Act, 1970 states that a patent can
be given for a novel article or a process even if it results in an old
product.
On 30 September 1997, the European Patent Office (EPO)
delivered a favourable interim judgment on the challenge of a
European patent on the fungicide effects of neem oil (Patent No.
436 257 BY) owned by W.R. Grace & Co. The opposition division
of the EPO issued a provisional statement on the basis of the
European Patent convention (EPO) and delivered favourable
interim judgment on opposition to Neem Patent, in favour of Dr.
Vandana Shiva, Ms. Magda Alvoet (MP of the European
parliament) and other NGOs of Neem campaign.

(ii) Geographical Indicators:
Basmati is the suitable example which allows a
country to register all products whose quality,
reputation or other characteristics are essentially
attributable to their geographical regions.

(iii) Industrial Designs:
India’s industrial design law dates back to 1911. It badly
needs to be updated.
(iv) Layout/Designs of Integrated Circuits:
India has a role to play in world’s electronic market. The
protection of integrated circuits is crucial to the
development of the electronic industry. This is essential so
that efficiency and the capability of each circuit is
maintained.

(v) Trade secrets: ટ્રેડ સ કરેટ્ :-
આ ર્ાયદા અંતગકત ર્ુંપની પોતાની વસ્તની ઉત્પાદન
પ્રહિયા ર્ે તેની ફોમ્યકલાને રજીસ્ટર ર્રાવે તો તે પ્રહિયા ર્ે
ફોમ્યકલા બીજી ર્ોઈ ર્ુંપની ઉપયોગ ર્રી શર્ે નહીં તેનું
રક્ષણ આપે છે. આ પેટેણ્ટ સામાન્યરીતે 10થી 20 વર્ક
માટે હોય છે પરુંત આ ર્ાયદા હેઠળ ર્ુંપનીના તસર્ેરેટ્સ
જાહેર થાય તો પણ રક્ષણ મળી રહેછે, આનું ઉત્તમ
ઉદાહરણ ર્ોર્ાર્ોલાએ પોતાના તસર્રેટ્સ નો હક્ક મેળવ્યો
હતો તેમ દશાકવી શર્ાય..

Need of IPR
“Monetary profit is the most important, in most cases, the only motive
behind man’s relentless toil, inventiveness and ingenuity”.
(IPR ની જરૂદરયાત) :- શંશોધન કે નિા અસિસ્કારના માનિીના પ્રેરણાસ્રોત
ખા કારીને નફો કે આિક હોય છે, માનવી પોતાની જીવનની આવર્ ર્ે સુંપતત ર્ે
સમય (વર્ો) આ માટે જ ખચી નાખે ત્યારે તેની નવા તવચારને રક્ષણ ના મળે તો
આ પ્રવૃતત ર્રેજ નહીં માટે સરર્ાર તેવા ર્યો માટે પ્રોત્સાહન અને રક્ષણ આપવા
આવા ર્ાયદાઓ બનાવતી હોય છે. જેમર્ે બાઓટેર્નોલોજી ના તવર્ાસથી
ર્ાયદાર્ીય નવી શોર્ધને નક્કી ર્રવી એર્ પડર્ાર પણ છે પણ તેની શોર્ધને નોર્ધણી
ર્રાવીને રક્ષણ મેળવીને માનતસર્ શાુંતત અનભવી શર્ે છે. બીજા હરીફ આજ
શોર્ધનો ઉપયોગ ર્રી શર્તા નથી. ગેરરીતત પરવર્ના ઉપયોગને અટર્ાવી શર્ાય
છે અને તેનું ર્ાયદાર્ીય રક્ષણ મેળવી શર્ાય છે. દતનયા આવી શોર્ધના સુંશોર્ધર્ોને
રક્ષણ આપીને ઉપયોગ,માહહતીપૂણક અને બૌતર્ધર્ સુંપતતર્ાયક માટે અવર્ાશ પૂરો પાડે
છે. બૌતર્ધર્ સુંપતતર્ાયકના માચલર્ોને નવા નવા તવચારો અને સુંશોર્ધનોને પ્રોત્સાહન
અને તેને સતત ચાલ રાખવામા સહાયર્ પરવાર થાય છે.

Farmers’ Rights (Sec 39)
Farmers’ Rights Has same privilege as a breeder of a variety
. A farmers’ variety is entitled for registration if declaration has
been made that the initial variety has been lawfully obtained Can
save, use, sow, resow, exchange, share or sell his farm
produce including seed of a protected variety
. The farmer as such cannot sell branded seeds of a protected
variety
. A farmer can claim damages if the seed of the protected variety
does not give the yield as stated by the breeder.

બૌતર્ધર્ નવસર્જનો અને અતવસ્ર્ારના પહરણામોને નવા ગ્રાહર્ો પૂરા પડે છે.
બૌતર્ધર્ નવસર્જનો અને અતવસ્ર્ારની ટેર્ક્નોલોજીને વૈતિર્ સ્તર પર પ્રચાર અને
પ્રસાર પરો પડે છે.
Problems from IPR: (IPR ના પ્રશ્નો):- તેનાથી ઇજારાશાહીને પ્રોત્ ાહન મળે
છે. બૌતર્ધર્ સુંપતતના હક્કો મેળવવા માટે અનેર્ રીતે પ્રયાસો ર્રતાું હોય છે. તેની
જૈસિક, ભૌગોલલક અને આસથિક અ માનતા પેિા થાય છે. તેની જીિન ધોરણપર
અસિકસ ત અને સિકસ ત િે શોમાં સિપરીત અ ર થતી હોય છે. (ગરીબી,
બેકરી ભૂખમરો etc. )

Issues to think about: - Higher life forms cannot be patented as not
inventions, Many of the arguments raised against patenting of higher life
forms apply to the PBRA.
Beyond that, the PBRA (and its equivalent statutes in other developed
countries) could become a vehicle for denying people in less developed
countries and native communities access to some plants. In some developing
countries, some plants serve medicinal purposes. Private sector driven
international norm setting Non transparent and non participatory
international law making Trade in pirated and counterfeited goods threatens
health, safety and security of consumers worldwide particularly in poor
countries.

CONCLUSION:-
IPR માનવ જીવન ર્ધોરણને પ્રભાતવત ર્રતું હોય છે. તેનાથી
ભેદભાવ ઊભાથય છે અને સામાજજર્ અને આતથિર્ સમસ્યાઓ પણ
સજાકતી હોવા છતાું તવર્ાસ અને સુંશોર્ધનોને પ્રોત્સાહનો માટે WTO
દ્વારા સવકસમતતથી નક્કી થયેલો ર્ાયદો દરેર્ દેશે અમલ ર્રવો જ
જોઈએ અને તે થાય છે પણ ર્ેટલીર્ વાર અલ્પતવક્ક્સત દેશોની
જનીપરુંપરાગત શોર્ધોર્ે રૂઢીઓ આ ર્ાયદાના રક્ષણ થી વુંચચત
રહી જાય તેવું બને છે જેમર્ે ભારત બાસમતી ચોખા, હળર્ધર,
લીમડો વગેરે જણાવી શર્ાય.
