and toxins
In reviewing this list, please note that it is by no means exhaustive. The EPA (Environmental Protection Agency)
has a list of hundreds of harmful chemicals and toxic substances…
10. Work related asthma occurs across professions
but the greatest incidence is seen among operators,
fabricators, and laborers from solvents, cleaning
materials, polymers, mineral dust, and hydrocarbons.
Benzene a component of products derived from
coal and petroleum and found in gasoline and other
fuels. Benzene is used in the manufacture of plastics,
detergents, pesticides, and other chemicals. Benzene
is considered 11. cancer causing. Benzene causes
harmful effects on the bone marrow-12. AML/acute
myelomonocytic leukemia and can cause a decrease
in red blood cells leading to anemia. It can also
cause excessive bleeding and can affect the immune
system and has been linked to these diseases-- 13.
non-Hodgkin’s lymphoma (NHL), 14. Hodgkin’s
disease, and 15. multiple myeloma. Breathing very
high levels of benzene can result in death. (#11-15)
It is important to seek the advice of knowledgeable

Asbestos may cause 1. pleural plaque (non-
cancerous scarring of lung lining); 2. asbestosis, a

obstructing air passages; and 4. mesothelioma (found

and 6. dermatitis. Dangerous pesticides have been
associated with 7. Parkinson’s disease and 8. brain
damage. (#5-8)
9. Pneumoconiosis is a serious lung disease caused
by the inhalation of dust from asbestos, coal, cotton,
and textiles. Pneumoconiosis has different names
depending on the type of dust that causes the illness.

Social Security disability is no cakewalk. Here’s what
you need to know for starters…

about obtaining Social
Security disability
If you have a disease or disability that prevents you
from working, you may be eligible for Social Security
disability benefits, if you have worked long enough
and paid enough into Social Security. Under the law,
workers can begin receiving disability benefits once
they have been out of work for at least five months but
there are ifs, and obstacles.
1.	 Employees must have worked at least five
years within the last 10 years before becoming
disabled.
2.	 Social Security Disability applies only to long-term
medical conditions, lasting at least a year and that
prevents a person from performing gainful work.
3.	 Social Security Administration calculates your
monthly disability benefits based on your average
earnings before you became disabled.
4.	 You may have a clear-cut case of disability but
because of the number of applications every year
and the inefficiency of the system, there’s currently
about a two-year backlog.
5.	 After filing an application for Social Security
Disability benefits, the wait is about three to six
months to find out if your application has been
approved or denied. For most applicants (two-
thirds), the request is denied.
6.	 After an initial claim is denied, you have 60 days
to appeal the decision. If you miss this deadline,
you must start over and file a new application for
benefits, further delaying your payments.
7.	 For your first appeal, an employee of the Social
Security Administration reviews your application
which usually takes six to nine months. Denials are
pretty common at this level, so most people have
to make a second appeal and request a hearing
with an administrative law judge. Again, you have
only 60 days to file an appeal for a hearing, and it
may be a year or more before you are assigned a
hearing date.
8.	 At the hearing, you (and your attorney, if you
hire one, recommended) will be able to present
evidence about your medical condition, work
history, and disability to a judge. The judge who
presides over your case will decide whether to
grant you Social Security benefits.
9.	 Attorneys who represent disabled workers are only
allowed to collect a fee that is equal to 25 percent
of the disabled person’s past-due benefits. The
maximum attorney fee in Social Security cases is
$5,300.

Under the law, workers can begin receiving disability benefits once they have been out of work for at least five months but there are ifs, and obstacles. 1. Employees must have worked at least five years within the last 10 years before becoming disabled. 2. Social Security Disability applies only to long-term medical conditions, lasting at least a year and that prevents a person from performing gainful work. 3. Social Security Administration calculates your monthly disability benefits based on your average earnings before you became disabled. 4. You may have a clear-cut case of disability but because of the number of applications every year and the inefficiency of the system, there’s currently about a two-year backlog. 5. After filing an application for Social Security Disability benefits, the wait is about three to six months to find out if your application has been approved or denied. For most applicants (two- thirds), the request is denied. 6. After an initial claim is denied, you have 60 days to appeal the decision. If you miss this deadline, you must start over and file a new application for benefits, further delaying your payments. 7. For your first appeal, an employee of the Social Security Administration reviews your application which usually takes six to nine months. Denials are pretty common at this level, so most people have to make a second appeal and request a hearing with an administrative law judge.
