Procedural rules are designed to protect the innocent
In our country any person accused of a crime no
matter how bad the crime he is accused of is
innocent until proven guilty
Prosecutors are not allowed to introduce illegally
obtained evidence at a trial
3. These amendments guarantees us that
police, prosecutors, judges and juries will follow
fair procedures when dealing with people accused
of crimes.
They also protect the period of time between arrest
and trial in three ways…
During the arrest and trial of a person is where the
both sides gather evidence, witnesses are
interview, and trial strategies are made
The defendant must also decide whether to enter
into a plea agreement which is pleading guilty to a
lesser crime
4. • Government prosecutors have many choices about whether to charge
an individual with a crime and which crime or crimes to charge them
with
• The fifth amendment requires an indictment which is a formal
statement of charges, so that the defendant knows how to prepare a
defense
• A grand jury is a special panel of jurors who listen to the evidence
that the government prosecutors have obtained and decide wheter or
not the government has a strong enough case to proceed with the trial
5. Bail
Bail refers to the sum of money that a court
requires a defendant to deposit with the
court
Permitting criminal defendants to be
released on bail and free before trial helps
them prepare their defense and avoid
punishing innocent suspects
Bail is excessive when it is higher than an
amount that is reasonable
6. Counsel
The sixth amendment guarantees criminal
defendants the assistance of counsel for their
defense
The right to counsel includes having a lawyer
present during police interrogation, while
preparing for trial, and during the trial
