Request of Faustino Mancha Jr. of Fauman Construction, applicant, representing Cipriano
Espino, owner, for the significance review of the existing main structure located at 103
Elmview E in order to demolish 100% of the existing residence and accessory structures.

BACKGROUND INFORMATION
The property is zoned SF-A and is located on the northeast corner of the intersection of Elmview
E. and Broadway.
POLICY ANALYSIS
Staff found no historical or architectural significance of the structures.
The case was reviewed at the February 22nd
special meeting of the Architectural Review Board
(ARB). ARB found no significance to the existing structure and recommended approval of the
demolition.
FISCAL IMPACT
No projected fiscal impact from this project has been calculated.

In accordance with order of the Office of the Governor issued March 16, 2020, where he temporary
suspended certain provisions of the Texas Open Meetings Act, take notice that a regular meeting scheduled
at 5:30 p.m. on Tuesday, February 16, 2021 will be conducted by telephone conference in order to
advance the public health goal of limiting face-to-face meetings (also called “social distancing”), to slow
the spread of the Coronavirus (COVID-19), to consider and act upon any lawful subjects which may come
before it. There will be no public access to Alamo Heights Council Chamber.

Request of Faustino Mancha Jr of Fauman Construction, applicant, representing Cipriano Espino, owner,
for the significance review of the existing main structure located at 103 Elmview E in order to demolish
100% of the existing single-family residence and accessory structure(s) under Demolition Review
Ordinance No. 1860 (April 12, 2010).
Chapter 5 of Code of Ordinances (Buildings and Building Regulations) requires City Council to consider the
ARB’s recommendation for all demolition/final design review applications. Please check the ARB posted
results on the City’s website after the ARB meeting to confirm any future meeting dates.

Are there any plans to post on the city website for the demolition request for 103 E Elmview? Has the
owner shared what they intend to do with the property?
I have one request before they begin demolition. I would ask that the owner treat the structure
thoroughly for rodents, particularly rats as I have seen them running around the yard, I am not worried
about the raccoons, skunks, and other critters I have seen running in and out, but It would be helpful to
us neighbors that live around it if they could kill the rats before they disturb the structure. This application
period would probably be a good time to do that.

Subject: Case 831F – 103 E. Elmview
Members of the ARB:
I am traveling for work and unable to appear before you but want (1) to provide
comments on the Subject Case, and (2) request a design consideration in the interest of
public safety.
With respect to the requested demolition, my wife and I support the request. The
structure and accessory structure (garage) have been poorly maintained over the years. If I
were the owner, I too would want to start over.
With respect to the ARB’s compatibility review of any replacement structures (which
I understand will be conducted at a future date), I want to convey notice to ARB and
applicant of our request to replace and modify the existing chain-link fence on the property
that borders both the Broadway right-of-way and the fence that borders the alley. Further
and most importantly, all landscaping should be kept behind the fence, within the rear yard.
The current situation at the property creates an on-going public safety hazard for
cars/trucks attempting to exit the alley on to Broadway. Please refer to Exhibit A (attached
hereto) for photos that demonstrate this point.

Photo 2 – The fence by the garage, along the alley, is repeatedly damaged by service
vehicles and requires replacement.
Photo 3 – The shrub that grows outside the “Broadway-side” rear yard fence constantly grow
into the right-of-way (“ROW”), impairing clear vision for those exiting the alley.
These shrubs are now almost 6 feet tall and extend 2 feet into the ROW. However,
this situation never goes away. (It is not clear whether this technically violates
Section 16-7 of the City of Alamo Heights codes.)

significant number of cars that exit from the alley, which cannot view down
Broadway. Unfortunately, Section 16-71 of the City of Alamo Heights Code
regarding Clear Vision does not grant relief for this situation, as alleys and
driveways have reduced sight distance (5’) compared to 35’ required at streets
(see diagram, below).
The primary means by which to rectify this situation is to simply mandate that all
landscaping at 103 E. Elmview be permanently removed from the ROW and that future
landscaping be placed behind any fence (property line).
We respectfully request that this be noted for the record and imposed by the City and/or
ARB.
