2006 Administrative Decision on Venezuela

Administrative Decision
Based on the recommendation from the Working Group on Monitoring regarding
credible indications of significant non-compliance with the KPCS requirements by
Venezuela, Plenary decides that additional verification measures should be undertaken.
In accordance with Section VI, paragraphs 13 to 15 of the KPCS, and Section III,
Paragraph (a) of the Administrative Decision on Implementation of Peer Review in the
KPCS (ADPR), Plenary therefore decides to send urgently a review mission to the
Republic of Venezuela, which should take place preferably by 15 December 2006, and
requests the Chair to obtain the necessary consent.
As set out in Section VI, Article 14 of the KPCS, "Review missions are to be conducted
in an analytical, expert and impartial manner with the consent of the Participant
concerned". The terms of reference for review missions are set out in Annex II of the
ADPR.
Venezuela is invited to report to the Chair as soon as feasible in advance of the review
missionon its implementationof the minimum requirements of the KPCS.

Recommendation from the Kimberley Process Working Group on
Monitoring to the Chair of the Kimberley Process
The Working Group has been invited by the Chair of the Kimberley Process to
consider the abovementioned documents with regard to Section III of the
Administrative Decision on the Implementation of Peer Review in the KPCS
(ADPR).
The information received by the Working Group notably includes:
- Venezuela’s statistical reports which raise questions regarding actual
exports.
- A report by the KP Observer, Partnership Africa Canada, indicating inter
alia that there are specific weaknesses in Venezuela’s internal and border
controls.
The Working Group on Monitoring has come to the conclusion that the
information it has reviewed could constitute credible indications of significant
non-compliance with the minimum requirements of the Kimberley Process
Certification Scheme (KPCS). In accordance with Section VI, paragraph 13 of
the KPCS, the Working Group on Monitoring concludes that additional
verification measures would be appropriate.
In accordance with the provisions of Section III of the ADPR, the Working
Group therefore recommends to the Chair of the Kimberley Process that he
recommend to Plenary the sending of a review mission of the Kimberley
Process to Venezuela without delay.
