1. What is GDPR and why outside EU companies should comply with it
The new General Data Protection Regulation, published on May 25, 2016, went into force on May 25, 2018.
The General Data Protection Regulation (GDPR) standardizes data protection law across all 28 EU countries and imposes strict
new rules on controlling and processing personally identifiable information... and heavy penalties for non-compliance.
It also extends the protection of personal data and data protection rights.
The following requirements are particularly noteworthy among the novelties introduced and enforced from May 25, 2018:
· Data handling must be unambiguous. GDPR says“silence, pre-ticked boxes or inactivity should not constitute consent”.
· GDPR applies to all organizations holding and processing personal data of people in the EU, regardless of geographic
location of the Organization. Many organisations outside the EU are unaware that the EU GDPR regulation applies to them
as well.
·The nature of the consent required to satisfy the condition for processing sensitive personal data must be“explicit”.
Explicit Consent must be obtained in a way that leaves no room for misinterpretation.
· Consent must also be verifiable, in other words, the business must be able to prove that it obtained the individual’s consent.
GDPR is designed to:
· Ensure the right of people in the EU to a“Private Life”
· Put“full control”of Personal Information“at the hands of the legitimate owner: the End User”
· Emphasize the importance of Personal Data control, protection and security
GDPR applies to:
· In the European Union, to all Public and Private Organizations
· In the rest of theWorld, to any Organization processing or controlling any Personal Data from
any person in the EU, to whom the Organization might target products or services, regardless of the
location of the Organization… except non-commercial Government Activities.
· In the USA, many organizations are becoming both Privacy Shield and GDPR compliant to be“safe”
“The GDPR not only applies to organisations located within the EU but also to organisations
located outside of the EU. It applies to all companies processing and holding the personal data
of data subjects residing in the European Union, regardless of the company’s location.”
