Lordship's Companion Justices of the Supreme
Court of India. The Humble petition of the
Petitioner abovenamed.
MOST RESPECFULLY SHOWETH:
1. That the present miscellaneous petition
criminal under Article 32 of the Constitution of India
is being filed to enforce the Rights under Article 21 of
the Constitution of India along with/tagged with Writ
Petition (Criminal) No…………..of 2017(D.NO. 2188), D.NO.
17748/SCI/PIL(E)/2017, D.NO. 16043/SCI/PIL(E)/2018 M.A.
NO. 84/2017 in Writ Petition (Criminal) D.NO. 3913 of
2017, Writ Petition (Criminal) 136 of 2016 and Writ
Petition (Civil) 90 of 2016; whereby all petitions have
been either dismissed violating Order XXXVIII of Supreme
Court Rules, 2013 without any speaking order or Lodged
abusing power under Order XV Rule 5 of the Supreme Court
Rules, 2013 which led to petitioner No.02 Smt. Asha
Rani Devi to succumb to planned judicial murder on
11.11.2017 at New Delhi and forced petitioner No.01 Shri
Om Prakash to become underground and delay in
registration of Writ Petition (Criminal)No….. of
2017(D.NO. 2188) would cause another planned judicial
murder of petitioner No.01 Shri Om Prakash.
2. That the petitioner no.02 Smt. Asha Rani
Devi approached this Hon’ble Court with Writ Petition
(Criminal) 136 of 2016 under Article 32 of Constitution
16. of India to enforce Article 21 of the Constitution of
India, however she is being denied access to justice by
the Registrar on the one hand, violating set rules,
practice, procedures of this Hon’ble Court and
suppressing records in the office report; on the other
hand, two judges bench dismissed the petition on
21.10.2016 imposing liberty upon the petitioners to
approach High Court evading Order XXXVIII of Supreme
Court Rule, 2013; which has resulted in planned judicial
murder of petitioner no.02 on 11.11.2017 at New Delhi.
3. That the petitioner no.01 Shri Om Prakash
son of Petitioner no.02 Smt. Asha Rani Devi could not
perform the last rituals of his mother Petitioner no.02
at her own house at Sonaili, Katihar, Bihar due to
existence of N.B.W dated 08.09.2011 u/s 83 Cr.Pc. in
non-maintainable, false and frivolous 498A Criminal Case
Complaint (P) No. 5591 of 2013 at SDJM, Court No.16 at
Begusarai Court Bihar. Postmortem report, police
statement, police report and death certificate of Smt.
Asha Rani Devi herein petitioner no.02 have been filed
online with Bihar Police-CGRC vide Token No.
201804230020 and 201804170001.
4. That the petitioner no.01 is the only
survivor left in his family now.
5. That the present Miscellaneous Petition
17. Criminal is being filed seeking registration of W.P.
(Crl.)…….. of 2017 (D.NO. 2188) and independent
inquiry/investigation into the circumstances surrounding
the death of Late Smt. Asha Rani Devi herein petitioner
no.02 by a Commission of inquiry constituted by this
Hon’ble Court.
6. The factual matrix of the present
Miscellaneous Petition Criminal is as under:
7. That shocking details emerged from emergency
medical sheet of AIIMS at New Delhi which was collected
by the petitioner no.01 secretly due to suspicious
activity of the duty officer in the night shift on
9/11/2017 (who happened to be Bihari) at New Emergency
Medicine Ward, AIIMS at New Delhi, police statement
dated 11/11/2017 by the son of petitioner no.02, police
report dated 11/11/2017, recap of events dated 9/11 by
the son of petitioner no.02, death of petitioner no.02
was not natural.
8. In spite of that there is delightful/pernicious
silence from all authorities on this issue which
has created serious doubt in the mind of the
public at large about safety and security of
petitioner no.01 who is only survivor left in his family
now.
18. 9. That disturbing questions emerged about Smt. Asha
Rani Devi’s death viz. about the procedure followed
after her death , when it was handed over to her
son herein petitioner no.01. Petitioner No.1 claims
that he asked for an F.I.R and an enquiry commission to
probe Smt. Asha Rani Devi’s’ death, however, none was
ever set up.
10. That petitioner no.02 Smt. Asha Rani Devi’s death
was suspicious -the fact that 100 was dialed for medico
legal case – a Panchanama should have been prepared,
and a medico legal case would have been filed. As
per legal procedure, the police department is
expected to collect and seal all the personal
belongings of the deceased, list them all in a panchnama
and hand them over to the family as they are petitioner
no.01 in this case. Petitioner no.01 was not given any
copy of a panchnama.
11. That the police refused to record the statement of
son of petitioner no.02 Smt. Asha Rani Devi on
11/11/2017 because son of petitioner no.02 wanted to
record the statement that Rtd. Justice S.B. Sinha of
Supreme Court of India and Shri Praveen Kumar from
Indian Defense Account Service both have murdered his
mother in a planned manner. Petitioners have filed more
than 10 criminal as well as civil cases against the
lobby/relatives of Rtd. Justice S.B. Sinha and Shri
Praveen Kumar since 2012 to 2017 before Supreme Court of
19. India. However, police did not record this statement of
son of petitioner no.02 Smt. Asha Rani Devi on
11/11/2017. Finally, son of Smt. Asha Rani Devi
petitioner no.02 has recorded this statement on his own
handwriting after the statement recorded by police on
11/11/2017. This document has also been collected by the
petitioner no.01 due to suspicious attitude/activity of
the police on 11/11/2017.
12. That the copy of police report (Ittellamat report)
which has been handed over to petitioner no.01 by the
police has also not recorded the name of Rtd. Justice
S.B. Sinha of Supreme Court of India and Shri Praveen
Kumar from Indian Defense Account Service. However, the
petitioner no.01 has recorded the name of both dialing
over 100 and PCR both on 11/11/2017.
13. That the petitioner no.01, questions: who was
tracking the petitioners over mobile on 9/11? Why
screening of emergency wrote “No O2 bed available
referred to SJH/Other Govt. Hospital”, the moment
petitioner entered into screening of emergency on 9/11?
Why doctors changed their mind at 14:00pm and allowed
access to emergency on 9/11? Under whose instructions
oxygen bed became available all of sudden at 15:00pm on
9/11? Under whose instructions oxygen bed became
unavailable all of sudden at 23:00pm on 9/11? Why duty
officer in the night shift on 9/11 (who happened to be
Bihari) at new emergency medicine ward, AIIM at New
20. Delhi forced the petitioners to sign LAMA when the
petitioner refused to shift to Safdarjung Hospital, New
Delhi at midnight on 9/11? What medication was
administered to her at AIIMS Hospital not disclosed by
AIIMS authority as on date? Why emergency medical sheet
not handed over to the petitioners by duty officer in
the night shift on 9/11? Under which circumstances
emergency medical sheet was collected by the petitioner
can be ascertained from the CCTV footage of 9/11 night?
Why COPD case being forced to sign LAMA and sent back
home at midnight with 47000 WBC
count, pO2 68.1 mmhg & pCo2 67.4 mmhg without x-ray
done? Why LAMA being accepted by the duty officer in the
night shift on 9/11 while petitioner no.01 refused to
shift to Safdarjung Hospital, New Delhi in writing and
not given his original sign under pressure while
petitioner no.02 was unable to sign LAMA? Why petitioner
no.02 was not shifted to Geriatrics wards of AIIMS at
New Delhi while she was a senior citizen? Was there no
bed available whether in private ward or in general ward
or in Geriatrics wards of AIIMS at New Delhi on 9/11 to
save the life of a senior citizen whereas beds become
available 24X7 for VIPs at AIIMS at New Delhi? Why
police has not recorded the statement according to the
petitioner no.01? Why police did not register F.I.R
while Petitioner No.1 made allegations that there is
foul play in the death of petitioner no.02 by the nexus
of judges and doctors at AIIMS at New Delhi? Why
panchnama not done by police? Why medico legal case not
21. filed by Delhi Police? Why panchnama not handed over to
petitioner no.01 by Delhi Police?
14. That the above noted 18 questions of petitioner no.01
remained unanswered.
15. That Department of Justice, Government of
India forwarded the grievances of petitioners to the
Supreme Court of India on 16.11.2016 for appropriate
action. True copy of email letter dated 16.11.2016 by
Department of Justice; Government of India to Supreme
Court of India is annexed herein as Annexure P-1 (Page
from 55 to 55).
16. That the petitioner no.02 anticipated
apprehension of her planned judicial murder by the nexus
of Rtd. Justice S.B. Sinha of Supreme Court of India and
Shri Praveen Kumar from Indian Defense Account Service
therefore registered online complaint with Prime
Minister Office at the website of CPGRAMS vide
registration no. PMOPG/E/2016/0599866 on 22.12.2016.

17. That the petitioner no.02 anticipated
apprehension of her planned judicial murder by the nexus

Shri Praveen Kumar from Indian Defense Account Service
therefore also registered an online complaint with
President of India at the website of Rashtrapati Bhawan
vide registration no. PRSEC/E/2016/16154 on 30.12.2016.

with a prayer for urgent action against corrupt organs
of judiciary so that she could visit her own house at
Sonaili, Katihar, Bihar in the eve of Durga Puja.

not registered F.I.R against it as of now. Petitioner
has also registered case dialing 100 with Delhi Police

28. 33. That the petitioner no.01 approached

petitioners’ rented house at New Delhi without any
search warrant in retaliation of CJM, SDJM case as the
date of hearing fixed on 18.10.2017 at SDJM Court no.16,
Begusarai, Bihar. Commissioner of Police, Delhi
acknowledged the complaint on 03.11.2017 vide
D.NO.22241/E-mail and D.NO.22273/E-mail dated
20.10.2017. True copy of acknowledgement letter dated

dated 20.10.2017 by Commissioner of Police, Delhi is

34. That the petitioner no.01 again approached
Government of NCT of Delhi through online complaint and
filed complaint vide registration no. GNCTD/E/2017/07831
dated 08.11.2017 against criminal trespass by Delhi

dated 08.11.2017 is annexed herein as Annexure P-19

35. That the petitioner no.02 approached State
Bank of India Branch code 17633, Dwarka Sector-08,
Bagdola, New Delhi on 07.11.2017 to submit her “Life
Certificate” for continuation of family pension
maintained by Branch code 3127, ADB, Sonaili Bazar,
29. Katihar Bihar. However, “Life Certificate” for family
pension is not being uploaded on 07.11.2017 by the
Branch code 3127, ADB, Sonaili Bazar, Katihar Bihar.
Hence, the death was declared by the branch in advance.
Petitioner no.02 filed online complaint vide Ticket No.
PA312733480848 dated 07.11.2017 against it with Central
Monitoring System(CMS), SBI. After a complaint Branch
code 3127, ADB, Sonaili Bazar, Katihar Bihar replied
back against Ticket No. PA312733480848 that “Life
Certificate could not be uploaded for unavoidable
reason”. True copy of complaint against SBI Branch code
3127 vide Ticket No. PA312733480848 dated 08.11.2017 is
annexed herein as Annexure P-20 (Page from 83 to 83).
36. That the Petitioner no.02 again filed online
complaint vide Ticket No. 3456597084 and CS312733508596
and 3456749461 and CS312733503842 and 3457371823 dated
09.11.2017 against Branch code 3127, ADB, Sonaili Bazar,
Katihar Bihar with Central Monitoring System(CMS), SBI.
True copy of complaint against SBI Branch code 3127 vide
Ticket No. 3456597084 and CS312733508596 and 3456749461
and CS312733503842 and 3457371823 dated 09.11.2017 is
annexed herein as Annexure P-21 (Page from 84 to 87).
37. That Petitioner no.02 Smt. Asha Rani Devi
approached pulmonary and sleep disorder OPD of AIIMS at
New Delhi on 09.11.2017 for her normal COPD illness as
she was a follow-up case since 2010. Dr. Rajesh Sharma,
pulmonary and sleep disorder OPD of AIIMS at New Delhi
30. referred her to emergency and hospitalization.
Emergency, AIIMS at New Delhi refused to admit her
because of “no O2 beds available” at 11:30 am thereafter
doctors changed their mind and deleted “no O2 beds
available” from the prescription and kept her under red
area of emergency till 11:30 pm and forced her to sign
(LAMA) and sent her back home on 09.11.2017 at midnight.
38. In case of (LAMA) medical papers are not
returned back to the patient. Papers are kept with
hospital (AIIMS) authority. This material evidence was
collected by the petitioner no.01 due to misconduct or
suspicious activities of the doctors on 09.11.2017. True
copy of Emergency AIIMS, New Delhi medical sheet of
Petitioner No.02 dated 09.11.2017 is annexed herein as
Annexure P-22 (Page from 88 to 100).
39. That the movements of Petitioner no.02 at
AIIMS at New Delhi was tracked over her son’s mobile
(9968337815) by some big shots on 09.11.2017.
40. That the Petitioner no.02 was the last one
to submit her OPD card at 10:30 am on 09.11.2017 but
name was called at 11:00 am which was abnormal.
Normally, her turn comes at 12:30 pm or 1:00 pm in this
situation. More than 100 patients were waiting in queue
on 09.11.2017.
41. That son of Petitioner no.02 receives a
31. suspicious phone call through 011-25655602 by airport
authority of India, Government of India at 11:00 am
dated 09.11.2017 and asked to attend interview on
20.11.2017. Son of Petitioner no.02 Smt. Asha Rani Devi
herein Petitioner no.01 asked him to mark an email for
the same as he was in emergency of AIIMS at New Delhi.
However, he did not mark the email as on date.
42. The moment Petitioner no.02 entered the
emergency screening room at 11:30 am, doctor denied
access to the Petitioner no.02 to the emergency and
wrote “no o2 bed available.
43. At 2:00 pm doctors changed their mind and
deleted the “no 02 bed available” item from the
prescription and allowed access to Petitioner no.02 to
the emergency.
44. How oxygen beds became available all of
sudden at 14:00 pm? This act of Screening of Emergency
on 9/11 establishes that murder was planned and he was
acting under the influence of some big shots.
45. Petitioner no.02 was kept at red zone area at bed no.
R-9 till 23:30 pm and forced to sign LAMA and sent back
home at midnight with 47000 WBC
count, pO2 68.1 mmhg & pCo2 67.4 mmhg without x-ray
done.
32. 46. That Petitioner 02 with acute breathlessness and
acute expectoration was sent back home at midnight with
47000 WBC count, pO2 68.1 mmhg & pCo2 67.4 mmhg
without x-ray done and without ambulance. This act of
duty officer in night shift on 9/11 establishes that
murder was planned and he was acting under the influence
of some big shots.
47. That Petitioner No.02 refused to sign LAMA.
Petitioner NO.01 and 02 have not signed LAMA on her own
handwriting.
48. That Petitioner NO. 02 refused to go to Safdarjang
Hospital, New Delhi in writing because she had prior
bitter experience of Safdarjang Hospital in 2010. In
2010, Petitioner NO. 02 approached Geriatric Clinic of
AIIMS at New Delhi vide OPD registration no. 800/2010 on
10.11.2010. Senior Resident, Geriatric Clinic of AIIMS
at New Delhi referred her to emergency AIIMS at New
Delhi on 10.11.2010. Emergency AIIMS at New Delhi vide
registration no. CS-100603/2010 wrote, “CSF as advised
by SR Medicine, regret no bed, refer to Safdarjang
Hospital (SJH)” in the midnight of 10.11.2010. However,
Safdarjang Hospital (SJH) also refused to admit her due
to non-availability of Oxygen bed. Safdarjang Hospital
(SJH) vide registration no. 240057 dated 11.11.2010
refused to admit her. Again petitioner no.02 had to come
33. back to Geriatrics OPD of AIIMS at New Delhi on
15.11.2010. Dr. A.B. Dey, Professor, Geriatric Services,
AIIMS, New Delhi, DMC Regd. No. 10673 directed Dr.
Gurjeet Singh, SR Medicine II, Room No.27 for
hospitalization of petitioner no.02. Dr. Gurjeet Singh,
SR Medicine II admitted petitioner no.02 on 16.11.2010
vide CR.NO. 181877 and discharged her on 23.11.2010.
Thus the life of petitioner no.02 was saved in 2010.
However, Dr. A.B. Dey, Geriatric Services, AIIMS, New
Delhi separated the petitioner no.02 from Geriatric
Service of AIIMS at New Delhi on 10.05.2012 and referred
her to the pulmonary Medicine and sleep disorder OPD of
AIIMS at New Delhi for further follow up and treatment.
Pulmonary Medicine & Sleep Disorder, O.P.D AIIMS at New
Delhi registered the petitioner no.02 vide Pulmonary OPD
registration no. 1648/2012 and later computerized it
vide UHID No. 101893012 which remained till the death of
petitioner no.02 on 11/11/2017 at New Delhi.
49. That the duty officer in night shift on 9/11 at New
Emergency Medicine Ward AIIMS at New Delhi forced
Petitioner NO.01 and 02 to sign LAMA, yet Petitioner
NO.01 and 02 not signed LAMA with their own original
signatures. This act of duty officer in night shift on
9/11 establishes that murder was planned and he was
acting under the influence of some big shots.
50. As the conditions of Petitioner no.02
further deteriorated in the night of 10.11.2017 because

developed breathlessness and acute expectoration and
next day being Saturday and Sunday therefore she lodged
online complaint with ministry of health and family
welfare department, government of India on 10.11.2017 at
midnight for urgent help and filed online complaint no.
DHLTH/E/2017/07152 against AIIMS New Delhi. However,
health and family welfare department, government of
India did not take immediate action against the
complaint on 10.11.2017. True copy of complaint no.

Delhi with Ministry of Health and Family welfare,
Government of India is annexed herein as Annexure P-23
(Page from 101 to 101).
51. That the Petitioner no.02 again filed online
complaint vide Ticket No. 3462979186 dated 10.11.2017
against Branch code 3127, ADB, Sonaili Bazar, Katihar
Bihar with Central Monitoring System(CMS), SBI. True
copy of complaint against SBI Branch code 3127 vide
Ticket No. 3462979186 dated 10.11.2017 is annexed herein
as Annexure P-24 (Page from 102 to 103).
52. That the Petitioner no.02 escalated the same
complaint against SBI, Branch code 3127, ADB, Sonaili
Bazar, Katihar Bihar before State Bank of Bank of
India’s Regional Business Office (RBO), Purnia on
10.11.2017. True copy of complaint against SBI Branch
code 3127 before SBI, RBO Purnia, Bihar dated 10.11.2017
35. is annexed herein as Annexure P-25 (Page from 104 to 104
).
53. That the Petitioner no.01, son of Petitioner
no.02 has dialed 100 in the morning of 11.11.2017 and
registered complaint of planned murder by Rtd. Justice
S.B. Sinha from Supreme court of India and Praveen kumar
from Indian defense account service having nexus with
the doctors of AIIMS at new Delhi. PCR came and recorded
the message at wireless and handed over the case to the
ASI, Shyam Sunder, P.S. Palam Village, South West
district, New Delhi. ASI, Shyam Sunder, P.S. Palam
Village took the petitioner no.02 to Deen Dayal
Upadhayay Hospital, Hari Nagar, Ghanta Ghar at New
Delhi, where petitioner no.02 was declared dead. ASI,
Shyam Sunder, P.S. Palam Village did not record the
statement of son of petitioner no.02 according to him
and asked him to take the dead body without postmortem
done because it is a brought dead case and he declared
it a natural death. Son of petitioner no.02 strongly
protested against the act of police and loudly responded
to ASI, Shyam Sunder, P.S. Palam Village. Who are you to
decide whether the death is natural or not natural? It
is the court of Law to decide whether the death is
natural or not natural? Your job is to register F.I.R on
the ground of statement by the son of petitioner no.02
and on the ground of surrounding circumstances of death.
Son of petitioner no.02 reluctantly recorded his
statement on his own handwriting and firmly insisted for
36. postmortem. Hence, the postmortem of petitioner no.02
was conducted on 11/11/2017.
54. That the Postmortem of petitioner no.02
conducted on 11.11.2017 at Deen Dayal Upadhayay
Hospital, Hari Nagar, Ghanta Ghar at New Delhi. True
copy of postmortem report P.M. NO. 1904/2017 of
petitioner no.02 Smt. Asha Rani Devi dated 11.11.2017 is
annexed herein as Annexure P-26 (Page from 105 to 108
).
55. That ASI Shyam Sunder, P.S. Palam Village,
New Delhi handed over police report vide D.D.NO.12-B
dated 11.11.2017 to the petitioner no.01. True copy of
police report vide D.D.NO.12-B dated 11.11.2017 issued
by PS Palam Village, New Delhi is annexed herein as
Annexure P-27 (Page from 109 to 109).
56. That the petitioner no.01 and son of
petitioner no.02 recorded his police statement before
ASI Shyam Sunder, P.S. Palam Village, New Delhi on
11.11.2017 that Rtd. Justice S.B. Sinha from Supreme
Court of India and Shri Praveen Kumar from Indian
Defense Account Service both have murdered the
petitioner no.02 and his mother in a planned manner
because we have filed cases against them before Supreme
Court since 2012. True copy of police statement by

no.02 has been issued by South Delhi Municipal
Corporation, West Zone of N.C.T of Delhi vide
registration no. MCDOLIR-0218-004900595. True copy of

58. That the Central Monitoring System (CMS) of
SBI informed through Ticket No. 3462979186 that Life
Certificate has been uploaded on 13/11/2017 by SBI,
Branch code 3127, ADB, Sonaili Bazar, Katihar Bihar. SBI
Branch code 3127 uploaded Life Certificate of petitioner
no.02 after confirmation of death of petitioner no.02.

59. That health and family welfare department,
government of India did not take immediate action
against the petitioner no.02’s complaint no.
DHLTH/E/2017/07152 dated 10.11.2017 rather took action
on 29.11.2017 and forwarded the same to the deputy
director AIIMS.
38. 60. That Department of Justice, Government of
India forwarded the grievances of petitioner no.02 to
the Patna High Court on 30.11.2017 for appropriate

61. That reply of AIIMS came to the complainant
on 08.12.2017. The Grievances cell of AIIMS replied back
on 08.12.2017 against complaint no. DHLTH/E/2017/07152
dated 10.11.2017 to the Ministry of Health and Family
Welfare. However, Emergency medical prescription of
Petitioner no.02 Smt. Asha Rani Devi dated 09.11.2017
falsify the inquiry report of AIIMS at New Delhi dated.
08.12.2017. AIIMS inquiry report says, patient was
stabilized while emergency medical prescription of AIIMS
which was collected by the son of petitioner no.02 due
to suspicious activities of duty officer in the night
shift on 9/11, says patient condition was unstable. True

62. That the Chief of CIC, New Delhi passed an

68. That the petitioner no.01 again approached

18.12.2017 for registration of F.I.R against the planned
judicial murder of petitioner no.02. True copies of

GNCTD/E/2017/08915 dated 18.12.2017 are annexed herein
as Annexure P-38 (Page from 129 to 132).
69. That the Commissioner of Police, Delhi sent
acknowledgement letter dated 20.12.2017 against the
complaint vide D.NO.28337/E-mail dated 13.12.2017. True

D.NO.28337/E-mail dated 13.12.2017 by Commissioner of
Police, Delhi is annexed herein as Annexure P-39 (Page

70. That the Commissioner of Police, Delhi sent
acknowledgement letter dated 21.12.2017 against the
complaint vide D.NO.28566/E-mail dated 15.12.2017. True

71. That the Commissioner of Police, Delhi sent

72. That the Grievances cell of AIIMS replied
back on 29.12.2017 against complaint no.
DHLTH/E/2017/07838 and DHLTH/E/2017/07840 and
DHLTH/E/2017/07841 dated 18.12.2017 to the Ministry of
Health and Family Welfare. Ironically, Asst. Admin
officer, AIIMS replied back that the petitioners have
not attached the copy of Emergency case sheet, without
it, it is not possible to judge above the complaint of
the patient and advised to provide the case sheet for
any further reply. It is pertinent to mention here that
in case of LAMA not a single paper is handed over to the
patient, forget about the entire Emergency case sheet.

73. That the petitioner no.01 approached Hon’ble
Chief Justice of India, Supreme Court of India on

the planned judicial murder of petitioner no.02. True

75. That the Commissioner of Police, Delhi sent
acknowledgement letter on 01.01.2018 against the
complaint of planned murder of petitioner no.02 vide
D.NO.29834/E-mail dated 29.12.2017. True copy of

77. That the Chief of CIC, New Delhi passed an
order dated 16.01.2018 in Appeal No.
CIC/SCOFI/A/2017/122864 against CPIO, Addl. Registrar,
Supreme Court of India. Chief of CIC refused to
intervene into the matter of Supreme Court of India.
However, respondent CPIO, Addl. Registrar, Supreme Court
of India responded that issue of non-registration of
Writ Petition (Crl.) D.NO. 2188 of 2017 is judicial in

80. That Bihar State Legal Service Authority
(BSLSA) responded on 31.01.2018 against the email letter
of petitioners dated 30.12.2017 that since the cause of
action arose within the territorial jurisdiction of NCT
of Delhi, so Bihar State Legal Service Authority (BSLSA)
cannot provide any legal service in the matter. True

81. That the Chief of CIC, New Delhi again
passed an order dated 09.03.2018 in Appeal No.

82. That the petitioner no.01 approached Delhi
Medical Council with a complaint of medical
negligence/misconduct under Rule 32 of Delhi medical

against the President of India’s complaint no.

by Grievances cell of AIIMS, New Delhi are annexed

84. That the Chief of CIC, New Delhi passed an
adjunct order dated 16.04.2018 in Appeal No.
CIC/SCOFI/A/2017/139611 against CPIO, Addl. Registrar,
Supreme Court of India. Chief of CIC defended the
position of executives and refused to intervene into the
judicial matter. However, respondent, CPIO, Addl.
Registrar, Supreme Court of India responded that the
correctness of the ‘office report’ cannot be adjudicated
under the RTI Act 2005. True copy of order dated

85. That Delhi medical council disposed of the
complaint of petitioner dated 03.04.2018 on 17.04.2018
on the ground of cryptic and vague complaint, hence does
not merit any consideration. True copy of letter no.

86. That the Government of Bihar conducted
police inquiry against petitioner no.02’s online CPGRAMS
complaint NO. GOVBH/E/2017/02325 dated 26.09.2017
through S.P. Katihar. S.P. Katihar uploaded police
inquiry report dated 18.04.2018 against complaint NO.
GOVBH/E/2017/02325 at the website of CPGRAMS. True copy
of police inquiry report dated 18.04.2018 against
complaint NO. GOVBH/E/2017/02325 by S.P. Katihar is
annexed herein as Annexure P-54 (Page from 164 to 166).
87. That the petitioner no.02 followed up
for seeking urgent appointment with Hon’ble the Prime
Minister of India through email appt.pmo@gov.in w.e.f
16.09.2017 to 08.11.2017 to apprise against corrupt
organs of judiciary so that she could visit her own
house at Sonaili, Katihar, Bihar in the eve of Durga
Puja. However, Prime Minister of India office did not
pay any heed of the request of the petitioner no.02. The
same was filed as posthumous complaint vide registration
no. PMOPG/E/2018/0184337 dated 19.04.2018 by the
petitioner no.01. Prime Minister office forwarded it to
the Department of Law Justice & Legislative Affairs.

48. 88. That in response to email letter dated
15.04.2018, 18.04.2018 and 21.04.2018 sent by the
petitioner no.01 addressed to Hon’ble the Chief Justice
of India; Section X of Supreme Court of India sent a
letter D.NO.4293/2016/X dated 03.05.2018 to the
petitioner no.01 to comply with the mandatory provision
of order VIII Rule 5 & 6(i) of the Supreme Court Rules,
2013. True copy of letter from Section X SCI dated
03.05.2018 to the petitioner is annexed herein as
Annexure P-56 (Page from 168 to 169).
89. That the underground petitioner no.01 filed
RTI against Department of Justice, Government of India
dated 22.04.2018 to seek complete information as C.J.M
Cum-PIO and District & Session Judge-Cum-Appellate
Authority, Civil Courts, Begusarai under the judicature
of Patna High Court failed to supply information from
the date 07.02.2011 of institution of Criminal Case
Complaint(P)No. 5591 of 2013 at C.J.M division Begusarai
Court, Bihar. Information supplied by C.J.M Cum-PIO and
District & Session Judge-Cum-Appellate Authority, Civil
Courts, Begusarai is misleading, false and frivolous.
The said RTI is bearing registration number

against Department of Justice, Government of India vide
registration number JUSTC/R/2018/50723 dated 22.04.2018
by the petitioner is annexed herein as Annexure P-57
(Page from 170 to 170).
49. 90. That the petitioner no.01 responded the
letter from Section X of Supreme Court of India and
complied the mandatory provision of order VIII Rule 5 &
6(i) of the Supreme Court Rules, 2013 and filed the
posthumous letter addressed to Hon’ble the Chief Justice
of India vide D.NO.78087 dated 23.05.2018 in W.P.(Crl.)
136 of 2016 through party in person filing counter of
Supreme Court of India. True copy of filing index and
Index of Annexures P-1 to P-5 vide D.NO.78087 dated
23.05.2018 in W.P.(Crl.) 136 of 2016 filed by the
petitioner before Supreme Court of India is annexed
herein as Annexure P-58 (Page from 171 to 173).
91. That the petitioner no.01 replied back
against the Token No. 1534/2017 to Lokayukta Bihar under
the intimation of Hon’ble Governor and Chief Minister of
Bihar on 26.05.2018. The Hon’ble Chief Minister of Bihar
forwarded the same to the District Magistrate, Begusarai
and Secretary Law Bihar on 28.05.2018. True copy of
letter dated 28.05.2018 forwarded by Hon’ble Chief
Minister of Bihar to District Magistrate, Begusarai and
Secretary Law, Bihar is annexed herein as Annexure P-59
(Page from 174 to 177).
92. That even after posthumous letter D.NO.78087
dated 23.05.2018 in W.P.(Crl.) 136 of 2016 filed before
Hon’ble the Chief Justice of India; shielded SDJM, Ms.
50. Meena Kumari, Court no.16, Begusarai Court, Bihar dared
to extend next date of hearing on 28.06.2018 in non-
maintainable, false and frivolous 498-A Criminal Case
Complaint(P)No.5591 of 2013 and persisted N.B.W dated
08.09.2011 u/s 83 Cr.Pc. against the petitioners.
Aggrieved by this act of SDJM, underground petitioner
no.01 again filed detailed RTI with arguments against
Department of Justice, Government of India. The said RTI
is bearing registration number JUSTC/R/2018/51094 dated
31.05.2018. True copy of detailed RTI with arguments

93. That shielded SDJM, Ms. Meena Kumari, Court
no.16, Begusarai Court, Bihar under Supreme Court of
India dared to extend next date of hearing on 28.06.2018
in non-maintainable, false and frivolous 498-A Criminal
Case Complaint(P)No.5591 of 2013 and persisted N.B.W
dated 08.09.2011 u/s 83 Cr.Pc. against the petitioners
against which Writ Petition (Criminal) No…………..of
2017(D.NO. 2188), D.NO. 17748/SCI/PIL(E)/2017, D.NO.
16043/SCI/PIL(E)/2018 M.A. NO. 84/2017 in Writ Petition
(Criminal) D.NO. 3913 of 2017, Writ Petition (Criminal)
136 of 2016 have been filed before Supreme Court of
India. True copy of order for next date of hearing dated
28.06.2018 in Criminal Case Complaint(P)No.5591 of 2013
by the SDJM Court no.16, Begusarai Court, Bihar is
51. annexed herein as Annexure P-61 (Page from 197 to 198
).
94. Under the above circumstances, since the petitioner
no.01 strongly feels that there is some foul play
in her death, and that she did not die a
natural death, taking into consideration the
circumstances surrounding her death, Hon’ble the Chief
Justice of India should look into this matter. This is a
case fit for a probe by a special investigation team
“irrespective of its outcome at this point of
time.” There should be independent inquiry into the
suspicions raised by petitioner no.01. This matter
needs a thorough investigation Otherwise, the truth
will not come out. There is foul play in the death of
petitioner no.02 by the nexus of judges and doctors at
AIIMS at New Delhi.
95. That the death of Smt. Asha Rani Devi
petitioner no.02 has occurred in suspicious
circumstances which got revealed from petitioner
no.01 so, it requires to be further investigated
through independent commission. Not enquiring into the
allegations made by the petitioner no.01 would send a
very wrong signal.
96. That in the circumstances, it is just, proper,
necessary, convenient and in the interest of justice
that this Hon’ble Court be pleased to order
52. constitution of a Commission of Enquiry to investigate
the events and circumstances surrounding the death
of Late Smt. Asha Rani Devi in the light of police
statement dated 11/11/2017 by petitioner no.01, police
report dated 11/11/2017 and recap of 9/11/2017 events
recorded by the petitioner no.01 in the petition.
GROUNDS:
Petitioner is praying for registration of W.P. (Crl.)……..
of 2017 (D.NO. 2188) lodged on 28.01.2017 under Order XV
Rule 5 of Supreme Court Rule, 2013 and for independent
inquiry/investigation into the circumstances surrounding
the death of Late Smt. Asha Rani Devi herein petitioner
no.02 on the following amongst other grounds: -
A. BECAUSE Petitioner no.02 denied access to
justice under Article 32 of Constitution of India
violating Order XXXVIII of Supreme Court Rule, 2013.
B. BECAUSE Petitioner no.02 denied access to
justice abusing power under Order XV Rule 5 of Supreme
Court Rule, 2013.
C. BECAUSE there is breach of Article 21 of the
Constitution of India, to say in other words, this
Right was not protected by this Hon’ble Court.
53. D. BECAUSE grievance against non-registration

have been registered under Grievance Management System

intervene into the matter of Supreme Court of India by
his Order dated 16.01.2018 in Appeal No.
CIC/SCOFI/A/2017/122864 pertaining to registration of
Writ Petition (Criminal)No….. of 2017(D.NO. 2188).
G. BECAUSE N.B.W dated 08.09.2011 u/s 83 Cr.Pc.
in non-maintainable, false and frivolous 498A Criminal
Case Complaint (P) No. 5591 of 2013 at SDJM, Court
No.16 at Begusarai Court Bihar still exists against
the petitioners.
H. BECAUSE cause of suspicious death of Smt.
Asha Rani Devi Petitioner no.02 arose within the
territorial jurisdiction of NCT of Delhi and two
states jurisdiction involved into the same cause of

I. BECAUSE petitioner No.01 Shri Om Prakash has
been forced to become underground and delay in
registration of Writ Petition (Criminal)No….. of
2017(D.NO. 2188) would cause another planned judicial
murder of petitioner No.01 Shri Om Prakash who is only
survivor left in his family now.
J. BECAUSE the complaint against Rtd. Justice
S.B. Sinha has been made by the petitioners dated
31.12.2016 before Supreme Court of India and reply
through RTI Dy. No. 2191/RTI/16-17/SCI, appeal no. 44
of 2017 and order dated 08.12.2017 in Appeal No.
CIC/SCOFI/A/2017/113204 have been given by Supreme
Court of India that there is stay on disclosure of
information relating to complaints against Judges.
K. BECAUSE W.P.(Civil) 90 of 2016 against
illegal termination of service of the petitioner no.01
has been filed against Shri Praveen Kumar, Indian
Defense Account Service before Supreme Court of India
by the petitioner no.01 and Shri Praveen Kumar, Indian
Defense Account Service is also a respondent no.07 in
Writ Petition (Criminal)No….. of 2017(D.NO. 2188).
L. BECAUSE the petitioner no.02 had anticipated
apprehension of her planned judicial murder by the
nexus of Rtd. Justice S.B. Sinha of Supreme Court of
55. India and Shri Praveen Kumar from Indian Defense
Account Service therefore registered it online with
Prime Minister Office at the website of CPGRAMS vide
registration no. PMOPG/E/2016/0599866 on 22.12.2016.
M. BECAUSE Postmortem report reveals that cause
of death is cardiac shock due to cardiac temponade and
myocarditis.
N. BECAUSE Nexus of Judges with doctors at
AIIMS at New Delhi is responsible for the cardiac
shock as Smt. Asha Rani Devi was forced to Sign LAMA
and sent back home at midnight with 47000 WBC count;
low oxygen (O2) and high carbon-dioxide(Co2) as per
blood ABG report.
O. BECAUSE it was a planned murder by the nexus
of doctors at AIIMS at New Delhi and Rtd. Justice S.B.
Sinha of Supreme court of India & Praveen kumar from
Indian defense account service as petitioners had filed
10 cases, civil & criminal both before Supreme Court of
India against the Sinha lobby of Bihar since 2012 to
2017.
P. BECAUSE son of Smt. Asha Rani Devi, herein
petitioner no.01 has recorded the name of big shots,
Rtd. Justice S.B. Sinha of Supreme Court of India &
Praveen kumar from Indian defense account service in the
police statement with his own handwriting on 11.11.2017.
56. Q. BECAUSE police has not registered F.I.R
against the suspicious death of Smt. Asha Rani Devi
Petitioner no.02.
R. BECAUSE delightful/pernicious silence from
all authorities have been maintained on this issue
which has created serious doubt in the mind of
the public at large about safety and security of
petitioner no.01 who is only survivor left in his family
now.

1. That the present miscellaneous petition
criminal under Article 32 of the Constitution of India
is being filed to enforce the Rights under Article 21
of the Constitution of India along with/tagged with
Writ Petition (Criminal) No…………..of 2017(D.NO. 2188),
D.NO. 17748/SCI/PIL(E)/2017, D.NO.
16043/SCI/PIL(E)/2018 M.A. NO. 84/2017 in Writ
Petition (Criminal) D.NO. 3913 of 2017, Writ Petition
(Criminal) 136 of 2016 and Writ Petition (Civil) 90 of
2016; whereby all petitions have been either
dismissed violating Order XXXVIII of Supreme Court
Rules, 2013 without any speaking order or Lodged
abusing power under Order XV Rule 5 of the Supreme
Court Rules, 2013 which led to petitioner No.02 Smt.
Asha Rani Devi to succumb to planned judicial murder
on 11.11.2017 at New Delhi and forced petitioner No.01
Shri Om Prakash to become underground and delay in
registration of Writ Petition (Criminal)No….. of
2017(D.NO. 2188) would cause another planned judicial
murder of petitioner No.01 Shri Om Prakash, the
contents of which are requested to be read as part of
this application, as the same are not being repeated
here for the sake of brevity.
65. 2. That the corrected para 5 of the Performa
for first listing against Miscellaneous Petition
Criminal in the matter of the suspicious death of Smt.
Asha Rani Devi Petitioner No.02 and for registration
of W.P.(Crl.)No………of 2017(D.NO.2188) lodged under
Order XV Rule 5 of the Supreme Court Rules, 2013 has
been annexed herein as Annexure P-1 (Page from 09 to
10).
3. That the para 5 of the Performa for the first listing
has been corrected and hence M.P.(Crl.) No……..of 2018 NOT
TO BE LISTED BEFORE: Hon’ble Justice Navin Sinha; Hon’ble
Justice Ranjan Gagoi; Hon’ble Justice Prafulla Chandra
Pant; Hon’ble Justice Uday Umesh Lalit; Hon’ble Justice
A.K. Sikri and Hon’ble Justice Ashok Bhushan.
4. That there is likelihood of bias against Writ
Petition (Criminal) 136 of 2016 by the two judges’ bench
as laid down in the Yadav Vs. State of Haryana AIR 1987
SC 454.
