3. INTRODUCTION
• Non Constitutional Bodies are the agencies /organization/institutions that are
not defined in our Indian Constitution .
• These bodies derive their powers from the laws passed by the Indian Parliament.
• These do not derive it’s power from the Indian Constitution.
4. EXAMPLES FOR NON CONSTITUTIONAL BODIES
• National Human Rights Commission ( NHRC)
• National Company Law Tribunal (NCLT)
5. NATIONAL COMPANY LAW TRIBUNAL
• NCLT is a quasi judicial body that deals with the issues arising within companies in India
• It is of cheap and people approach this Tribunal for fast and fair judgements
• The central government constituted NCLT on 1 June 2016 under section 408 of The Companies
Act 2016
• Section 408: power of government to prevent from oppression and mismanagement
• It replaces CLB
• CLB was handled be High Court. Thus to reduce the pressure of High Court NCLT was
established
• The Tribunal has 16 bench .The bench in New Delhi is known as Principal bench
6. ISSUES DEALING WITH NCLT
• NCLT deals with issues like arbitration,compromise,winding up of
companies,reconstruction of companies etc
• Any person who works in company can file in NCLT to gain compensation or
remedy.Similarly an depositer can also file an suit
7. MEMBERS OF NCLT
• NCLT consists of
• A PRESIDENT ( Must worked as judge in HC for 5 years)
• 9 JUDICIAL MEMBERS ( Must worked as judge in HC or District Court for 5 years and also Must
have practiced as advocate for 10 year’s)
• 6 TECHNICAL MEMBERS (Must worked in Indian corporate law for 15 years and chartered
accountant and Must also have worked in Industry)
• The central government has the power to choose all the above
8. POWERS OF NCLT
• Has the power to
• convert public limited company to private limited company
• Freeze the assets of company
• To held a general meeting
• To look after the financial accounts of an company
9. CONCLUSION
• The NCLT has replaced the existence CLB and BIFR and its appellate authority.
Thus all matters previously handled by the aforesaid authority Will be now
handled by the NCLT.
