WHAT IS MEDIATION?
• Mediation is a voluntary process
• Mediators don’t take sides and treat everyone fairly
• Mediators will support everyone to find long lasting solutions that really work
• Mediators will help you focus on what happens in the future
• Mediation is a confidential process, however if we believe someone is in danger, or we have concerns
about someone’s safety then we may have to pass this information onto other relevant agencies.
WHY CHOOSE MEDIATION?
It’s a tried and tested way of getting a solution that works. The people taking part are actively involved in
coming up with their own agreements, which means the outcome is more likely to be successful. If you do
choose mediation then you can expect:
• Our mediators to contact you initially via the telephone to explain the mediation process, listen to your
point of view and discuss the issues that need to be addressed
• Our mediators to arrange a further individual visit and / or a meeting with everyone involved in the
dispute – this will all take place on one day
• Our mediators to work with everyone to help them reach an agreement that you all find acceptable
• To be kept up to date with progress
• Our mediators to contact you 8 weeks after an agreement has been reached to see how things are for
you
HOW DO AGREEMENTS REACHED AT MEDIATION WORK?
We ask everyone involved to contribute to any agreements reached, they are usually recorded in writing
and shared with the people involved in the mediation.
All agreements reached are not legally binding.
For commercial disputes there is the option of making them legally binding by means of a consent order.
Consent orders are a legal document that are usually drawn up by a solicitor and sets out what you have
agreed during the mediation. This is then sent to court and approved by a judge and then becomes legally
binding. You should obtain legal advice before signing a consent order.
