2. • When you get married, you commit to the connection of
two wholly separate lives
• You share your house, your car, your bank account
• For whatever reason, you decide to get divorced from your
spouse
• However, it’s not as easy as packing up your bags and leaving
• Your property and families have become enmeshed, and
most importantly - your finances
• If you live in New York, some recent changes in divorce law
might be helpful to you as you work your way through this
separation process
3. • In June, a bill passed the New York Assembly
and Senate in order to determine spousal
support (alimony), and are currently awaiting
Governor Cuomo’s approval
4. • There are two types of this support, or maintenance, in NewYork
• As specified by Divorcenet.com, the first is post-divorce
maintenance, which is awarded to the supported spouse after the
divorce action
• This support ends by the death of either spouse, the remarriage
of the supported spouse or if the supported spouse is habitually
living with someone
• The second type is temporary maintenance, which is paid while
the divorce case is pending in order to provide the supported
spouse with immediate financial need
• It ends when a final order of maintenance is made by a judge
5. • The upcoming changes in New York would
establish a two-track system for determining an
amount of tempor ar y post-divorce
maintenance
• The regulations of how spouses pay each
other
7. THE SECONDTRACK
• The spouse pays maintenance
• He/she receives child support from the other
party
8. • In the first track, the spouse paying
maintenance and child support would yield a
lower amount of child support
• In the second track, there is some flexibility
• The spouse may decide to pay only temporary
maintenance, with a current cap of $543,000
9. • The proposed changes would also require the court to
“consider and allocate, where appropriate” the
responsibility for each spouse to contribute to family
expenses while the case is pending
• Going through divorce isn’t easy
• However, the purpose of family law is to mediate some
of this emotional stress
• Hopefully the changes in New York will help more
families find more satisfaction in their lives post-divorce
