AFFIDAVIT OF: Arshad Mehmood S/o Mehdi Khan R/o Chak No. 71
South, Tehsil & District Sargodha.
I, the above named deponent do hereby solemnly affirm and declare
as under:-
1. That the addresses of the parties given in the head
note of instant Habeas Corpus Petition are correct and
sufficient for the purpose of summoning and issuance
of other process for effective service.
2. That the brief facts giving rise to the present petition
are that petitioner is respectable citizen of the locality
and the detenue is real brother of the petitioner.
3. That 10-days ago, the detenue came to District Chiniot
to attend the office of Revenue for getting Fard-e-
Malkiat (Revenue Record) and the respondent No.1
along with heavy police force came there and forcibly
2. lifted the detenue from the road when the detenue was
on his bike bearing No. SGH-7171 Honda CD-70 and
fled away since then, the detenue is in illegal and
improper custody of respondent No.1 and used to
change the position of the detenue by the handing over
to respondent No.2 at Chowki Setlite Town, Police
Station City, District Chiniot.
4. That it is pertinent to mention here that detenue
neither involved in any criminal case nor required to
the police in any criminal case and he is in illegal and
improper custody of respondents.
5. That the petitioner approached to the respondent No.1
and requested him to release the detenue and
handover the bike but he flatly refused to do so and
threatened to involve the detenue in false criminal
cases or to kill the detenue in fake encounter.
6. That the life of the detenue is in danger from the
hands of the respondent and dispite of repeated
requests, the respondents are not ready to release the
detenue from there illegal and improper custody,
hence this petition.
7. That the petitioner has no other remedy except to file
this petition in this Hon’ble Court for redressal of his
grievance.
