a. Homeowner submits a Notice of
Claim form to 2-10 Home Buyers
Warranty® (2-10 HBW) Warranty
Administration (WA).

a. WA reviews the claim and
verifies that there is a valid
structural warranty in place.
b. WA educates the homeowner
regarding the claims process and
attempts to screen out the claim
if it is clearly not covered by
the warranty.

c. If the homeowner wishes to move
forward with the claim, WA collects the
required $250 claim investigation fee
and transfers the file to the warranty
insurer, New Home Warranty Insurance
Company (NHWIC), for handling.

a. Upon receipt of the claim, NHWIC
sends acknowledgement letters to
the builder and the homeowner
and contacts the homeowner and
builder within 24 hours to begin
the investigation.

b. NHWIC dispatches an engineer to
perform an inspection and prepare a
distress inventory report. This report
provides a detailed inventory of all
visible damages or signs of structural
distress and includes photographs,
measurements, elevation surveys and
diagrams for analysis.

a. Upon receipt of the distress
inventory report, NHWIC conducts
an internal review of the report and
completes an assessment, including
a Technical Coverage Review
prepared by a professional
engineer, if necessary.

b. The claim is submitted for final
review and a recommendation is
made to accept or deny. During the
final review it is determined if there
is actual physical damage to a load-
bearing element caused by the failure
of the load-bearing element that
affect the load-bearing functions
to the extent that the home has
become unsafe, unsanitary or
otherwise unlivable*
.
*Definition of structural failure differs in Texas and New Jersey.
Refer to warranty booklet for structural failure definition.
5. claim decision
a. If the claim is accepted, NHWIC
develops a plan of repair, secures
the appropriate contractors, manages
the repair process to completion
and obtains a final inspection by an
engineer or NHWIC settles the claim
for cash. When repairs are complete
and/or the claim is settled, NHWIC
secures a signed release from the
homeowner and the claim is closed.

b. If the homeowner does not accept
NHWIC’s offer to repair or settle for cash,
the homeowner is advised of their right
to submit the claim to Arbitration. Or, if
the claim is denied, a letter is sent to
the homeowner and builder providing
a summary of the investigation and
the conditions that were considered in
making the claims decision. The homeowner
is advised of their right to submit the
claim to Arbitration, if they disagree
with the denial.
6. arbitration
a. If the homeowner does not
accept the final claim decision,
the homeowner must submit the
matter to arbitration.
b. The Arbitrator’s decision is
legally binding upon all parties,
and is enforceable in a court
of law.

Structural claims process from start to finish.
