WILL
I, Mary G. Cass, of Chicago, Illinois, revoke all prior wills and codicils and make this my will.
SECTION ONE
I give all of my personal effects, household goods, and automobiles, and furnishings, and my
condominium, a two-story residential building located at 7241 N. Pratt, Chicago, Illinois to my
husband, Eugene L. Cass, of Chicago, Illinois. To my son Alvin C. Cass and to my daughter
Rose B. Cass, I leave nothing and only ask that the world take notice that I remember I have this
son and this daughter, and I have decided not to include him or her in any way in the bounty of
my estate.
SECTION TWO
I give the rest residue and remainder of my estate to my husband, Eugene F. Cass, of Chicago,
Illinois. If my husband does not survive me, I give all of my personal effects, household goods,
and automobiles, and furnishings, and the above residential building, along with a specific cash
bequest of $50,000 to my granddaughter Leah M. Taft of Chicago Illinois, and the rest residue
and remainder of my estate to my son Eugene R. Cass, per stripes.
SECTION THREE
No person herein above named or described in this will shall be deemed to have survived me
unless he or she is still living on the thirtieth day succeeding the day of my death.
SECTION FOUR
I name my granddaughter, Leah M. Taft, of Chicago, Illinois, as the executor of this will. If for
any reason my granddaughter Leah M. Taft fails or ceases to act as executor, I name my
2
daughter-in-law, Cecilia Cass, of Chicago Illinois, as executor of this will. I direct that no
security on the executor’s bond be required, and allow for them to enjoy independent
administration of my estate.
1. I direct the executor to pay out of my estate passing hereunder, after satisfaction of the
gifts made in section(s) one and two of this will, all expenses of administration of my
estate and all estate inheritance, transfer, and succession taxes other than any tax on a
generation skipping transfer which is not a liability of my estate which becomes due by
reason of my death. I waive on behalf of my estate any right to recover from any person,
including any beneficiary of insurance upon my life, any part of such taxes.
2. I give my executor the following powers and discretion, in each case to be exercisable
without court order:
(a) To sell at public or private sale, to retain, to lease, to borrow money and for that
purpose to mortgage or pledge, all or part of the real or personal property of my
estate;
(b) To settle claims for or against my estate;
(c) To exercise or not exercise any election or option granted to executors by the Internal
Revenue Code in force at the time of my death, even though such exercise or non-
exercise increases or decreases estate principal or income, without adjustment to
principal or income;
(d) To distribute the residue of my estate in cash or kind, or part in each, and for this
purpose the determination of the executor shall be conclusive;
(e) To execute and deliver any deeds, contracts, mortgages, bills of sale or other
instruments necessary or desirable for the exercise of their discretion as executor.
3
SECTION FIVE
If any beneficiary of mine has not attained the age of 25 at the time any property of mine
becomes distributable hereunder to him or her; the executor shall distribute this property to
themselves as trustee, against her written receipt and upon her written undertaking to distribute
said property to the beneficiary per the provisions contained in this paragraph and this will.
I, Mary G. Cass, being of sound mind and body, hereby execute this instrument as my last will
and testament.
