It’s now more than twenty five years since we founded Peninsula Business
Services Ltd. From small beginnings, we’ve grown to become the market

and procedures. Back in 1983, we started out with 12 employees and
50 clients. Today we represent over 26,000 clients with more than 850

The reason for Peninsula’s success is that we identified a real need

A review of the organisation’s Health & Safety performance measured against the
general requirements of current health & safety legislation and accepted best practice.
This is a review of how effective the organisation is at managing and implementing the
law and best practice requirements with safe working procedures.
Food Safety
Food Safety Management Review
A review of the organisation’s Food Safety performance provided via an independent
visit, assessment of food safety management, standards and implementation of the
legislative requirements followed by a report identifying areas of non-compliance with
food safety legislation and good food business practice.
Food Premises Evaluation
A site evaluation for food safety compliance, including a review of documentation,
food production practices, storage and handling of food. We will provide appropriate
supporting documentation, and should it be necessary, liaison with the Enforcing
Authority EHO. Access to legal support and indemnity (as defined right) for the Health

24 Hour Health & Safety Advice
Your management team have access to the 24 Hour Advice Service to guide them

How does it work?
hronline is a fully functional employee management tool allowing you to manage
your employee data in an efficient and modern way. We use the concept of ‘cloud
computing’ as can be deduced from the logo, meaning it can be operated by our
clients from anywhere in the world with all their data being securely stored in our data
centre.
hronline helps you to efficiently manage your employee’s absences, career
development, training and holidays and it has a unique ability within its document
library to securely hold all the documentation normally associated with an employee’s
personnel file. The hronline document library also contains electronic versions of all
the documentation we have supplied to you including management handbooks, the
Employment Reference Manual and all bespoke documentation such as contracts of
employment.
hronline has employee ‘self-service’ functionality allowing employees to individually
be registered with the system and then to request, monitor and operate all their holiday
and other absence requests. This is a paperless process that seeks approval from the
employee’s manager for authorisation with the database being updated in real time
online. This system allows for the segmentation of a business into sites/departments
and for individual managers to be given sufficient rights of usage to manage their own
departments.
Reporting and data editing is built around the concept of organisational units and the
inbuilt security allows for proper data protection. hronline allows for a manager to plan
their departmental staffing, based on all the upcoming absences that it knows about.
hronline also integrates directly with our employment law advice system. This makes
it easy for you to request and view advice about a particular employee from within
hronline. Our employment law advisors share some employee data elements with
you allowing our advisors to give the best and most pertinent advice at all times.
The security model ensures that advice records for employees are not visible or even
detectable should that employee be using hronline’s self-service facilities. This

What you can expect from us:
In the event that you are presented with tribunal papers or you are faced with a health
& safety prosecution from a current or former employee, you should notify our
Legal Services Case Preparation Department for employment or our Health & Safety
Department for safety issues as soon as possible. Upon such notification, we will see
the case through from inception to conclusion by undertaking the following activities:-
Employment
Tribunal Contact
We will contact the relevant Employment Tribunal Office and place ourselves ‘on
file’ with them to let them know we are acting on your behalf and to ensure that all
correspondence in relation to your case will be sent direct to ourselves. We will then
submit the response on your behalf.
Preparation of the Case
Your case will then be allocated to a Legal Services Consultant. The Legal Services
Consultant will take away any relevant documentation to create a bundle of documents
to be used as evidence at the hearing. Preparation also includes continual liaison with
the tribunal and the claimant’s representatives to deal with all orders for discovery or
inspection of documents as appropriate.
Research
Your Legal Services Consultant will take advantage of the wide-ranging library of legal
resources available to them to research all applicable legislation and established case
law to aid in defending your case.
Conciliation
Depending on the progress of your case, either the Legal Services Case Preparation
Department or your Legal Services Consultant will liaise with ACAS (Advisory,
Conciliation and Arbitration Service) for England, Scotland and Wales, or the Labour
Relations Agency for Northern Ireland, in relation to possible conciliation for ‘nuisance
value’ or ‘damage limitation’ purposes or where you wish to take a commercial view
regarding settlement of the case prior to the hearing.
Attendance at Employment Tribunal Hearing
It will be, in most circumstances, the Legal Services Consultant who prepared the
case who will attend the tribunal to conduct the hearing. This will entail making
submissions on the facts of the case and the relevant law, and cross-examining the
claimant and their witnesses.
Case Resolution
On conclusion of the case your Legal Services Consultant will discuss the tribunal’s
decision with you, and, if appropriate, address any matters with regard to compensation
or possible grounds for review or appeal.
Health & Safety
Accident Investigation
We will advise you on the steps that need to be taken
following on from an accident/incident. This could
involve a personal visit from one of our Consultants
to assist you with investigation of the event and advise
you on any subsequent changes that may be required
to working practices. You will also be provided with
legal advice and assistance from a Health and Safety
Solicitor should that be required.
Interviews under Caution
You will be provided with legal advice and assistance
in connection with investigations undertaken by
any one of the relevant Statutory Authorities. This
will involve advising you in relation to requests for
interviews under caution, and accompanying you to
any such interviews that are arranged.
Prohibition and Improvement Notices
Our Advisors are on hand to guide you through the
implications arising from any enforcement action
taken against you by one of the relevant Statutory
Authorities. Legal advice and assistance can also be
provided on compliance with, or appeal of, the service
of Enforcement Notices.
Court Proceedings
In the event that you are prosecuted, you will be
provided with legal representation throughout the
entire process. This will involve providing you with
advice in relation to the charges, liaising, and where
appropriate, negotiating with the prosecutor advising
you on plea, obtaining your detailed instructions,
collating all relevant information and representing you
up to and including your subsequent attendance at
court, whether at a trial or for sentencing.
Case Conclusion
At the conclusion of a case, you will be advised on
what additional remedial steps should be taken, so
as to help you better manage your health & safety
obligations.

Employment Indemnity Scheme
We take out an insurance indemnity policy on your behalf, with an insurer authorised
and regulated by the FSA. This cover will pay for the legal costs in defending claims
which arise out of Employment Tribunal claims including all proceedings brought
under collective and individual employment legislation.
This will involve the fees for Peninsula Business Services Ltd, to handle Employment
Tribunal cases on your behalf, being paid for you by the insurance company.
Employment Tribunal Award and Compensation Cover
This cover will pay basic awards (other than redundancy payments) and compensatory
awards (subject to the maximum limit) determined by an Employment Tribunal in
circumstances of:
Health & Safety Indemnity Scheme
We take out an insurance indemnity policy on your behalf, with an insurer authorised
and regulated by the FSA, which provides payment of legal costs in attending
interviews under caution and defending criminal prosecutions, which can be very
costly. Principally, this would relate to summonses under the Health & Safety at
Work Act etc 1974 but will also fund the legal cost of undertaking appeals against
Improvement or Prohibition Notices.

i.	 Unfair Dismissal
Cover extends to awards (subject to the maximum limit) for findings of unfair
dismissal for a potentially fair reason for dismissal; these being conduct, capability
& qualifications, redundancy, statutory ban (contravention of a duty or restriction
imposed under an enactment) and some other substantial reason.
ii.	Unlawful Discrimination
Cover extends to awards (subject to the maximum limit) for findings of unlawful
discrimination on the grounds of race, colour, ethnic or national origin and religion
or belief, sex, marriage and civil partnership, pregnancy and maternity, sexual
orientation, gender reassignment, disability or age. In addition, this cover allows
funding for any economic settlements reached in such cases, if this is felt to be viable
prior to attending a merits hearing, or to minimise compensation instead of attending
a remedies hearing.

Telephone Assistance programmes to Assured Absence Management, combining

What is an Employee Assistance Programme?
An Employee Assistance Programme is provided by employers for employees, to
help them deal with personal problems that effect their workplace performance,
productivity, health and wellbeing.
A confidential telephone helpline is provided and dependent on the nature of the
employee’s issues telephone and face-to-face counselling is provided by fully
qualified professionals.
Why should I offer this service to my employees?
Within any workplace environment individuals may have problems or issues they
are dealing with. Different people cope and manage these issues in different ways,
often these will be brought to your attention and result in you spending your time
dealing with them as best you can. The effect of these issues could result in short or
long term absence or a decline in workplace performance. By providing an Employee
Assistance Programme you will be demonstrating a “duty of care” to your employees
and ensuring that if they pick up the telephone they will receive immediate help and
advice at anytime day or night, 7 days a week.
For a modest cost you will be providing a benefit to your employees that has real value.
The cost of one day’s SSP (Statutory Sick Pay) is more than the premium payable for
each employee per annum.
How will my employees benefit?
By having unlimited access to telephone helplines 24 hours a day, 365 days a year
your employees have immediate access to counsellors who will be able to assist with
any personal problems or issues they may have. Counsellors will provide practical
support, guidance and recommend appropriate solutions to address the difficulties

Employees can receive telephone or up to eight face-to-face counselling sessions to

What you can expect from us: In the event that you are presented with tribunal papers or you are faced with a health & safety prosecution from a current or former employee, you should notify our Legal Services Case Preparation Department for employment or our Health & Safety Department for safety issues as soon as possible. Upon such notification, we will see the case through from inception to conclusion by undertaking the following activities:- Employment Tribunal Contact We will contact the relevant Employment Tribunal Office and place ourselves ‘on file’ with them to let them know we are acting on your behalf and to ensure that all correspondence in relation to your case will be sent direct to ourselves. We will then submit the response on your behalf. Preparation of the Case Your case will then be allocated to a Legal Services Consultant. The Legal Services Consultant will take away any relevant documentation to create a bundle of documents to be used as evidence at the hearing. Preparation also includes continual liaison with the tribunal and the claimant’s representatives to deal with all orders for discovery or inspection of documents as appropriate. Research Your Legal Services Consultant will take advantage of the wide-ranging library of legal resources available to them to research all applicable legislation and established case law to aid in defending your case. Conciliation Depending on the progress of your case, either the Legal Services Case Preparation Department or your Legal Services Consultant will liaise with ACAS (Advisory, Conciliation and Arbitration Service) for England, Scotland and Wales, or the Labour Relations Agency for Northern Ireland, in relation to possible conciliation for ‘nuisance value’ or ‘damage limitation’ purposes or where you wish to take a commercial view regarding settlement of the case prior to the hearing. Attendance at Employment Tribunal Hearing It will be, in most circumstances, the Legal Services Consultant who prepared the case who will attend the tribunal to conduct the hearing. This will entail making submissions on the facts of the case and the relevant law, and cross-examining the claimant and their witnesses. Case Resolution On conclusion of the case your Legal Services Consultant will discuss the tribunal’s decision with you, and, if appropriate, address any matters with regard to compensation or possible grounds for review or appeal. Health & Safety Accident Investigation We will advise you on the steps that need to be taken following on from an accident/incident. This could involve a personal visit from one of our Consultants to assist you with investigation of the event and advise you on any subsequent changes that may be required to working practices. You will also be provided with legal advice and assistance from a Health and Safety Solicitor should that be required. Interviews under Caution You will be provided with legal advice and assistance in connection with investigations undertaken by any one of the relevant Statutory Authorities. This will involve advising you in relation to requests for interviews under caution, and accompanying you to any such interviews that are arranged. Prohibition and Improvement Notices Our Advisors are on hand to guide you through the implications arising from any enforcement action taken against you by one of the relevant Statutory Authorities. Legal advice and assistance can also be provided on compliance with, or appeal of, the service of Enforcement Notices. Court Proceedings In the event that you are prosecuted, you will be provided with legal representation throughout the entire process. This will involve providing you with advice in relation to the charges, liaising, and where appropriate, negotiating with the prosecutor advising you on plea, obtaining your detailed instructions, collating all relevant information and representing you up to and including your subsequent attendance at court, whether at a trial or for sentencing.
