AGREEMENT TO SELL TWO COMMERCIAL PLOTS (BIANA)
COMMERCIAL PLOTS NO. 129 & 130, MIDDLE RING ROAD, BOULEVARD-2,
SECTOR-B, DEFENCE HOUSING AUTHORITY PHASE-3, ISLAMABAD.
By this deed of agreement made on 4th day of March 2022.
BETWEEN
Mr. Shahid Pervaiz Chaudhry Son of Chaudhry Muhammad Shafi, Resident of House# 141
Street no. 9, Sector B-1, Defence Housing Authority Phase-1, Islamabad, holding CNIC no.
61101-2026080-9 hereinafter called the Seller of the one part.
AND
Mr. Muhammad Salim Raza Son of Muhammad Farooq, Resident of House # 14-A, Street no.
15, Sector-H, Defence Housing Authority Phase-2, Islamabad, holding CNIC no. 35201-
7708340-1, hereinafter called Purchaser of the other part.
That the Seller affirms and confirms that he is the absolute owner of the COMMERCIAL PLOTS
no. 129 & 130, measuring 07.11 Marla, (40 Feet x 40 Feet) each plot, situated on Middle
Ring Road, Boulevard-2, Sector-B, DEFENCE HOUSING AUTHORITY PHASE-3, ISLAMABAD.
That the Seller further affirms and confirms that the said PLOTS are free from all sorts of
encumbrances, charges, dues, lien, mortgage and litigation; and there is no loan against the
said property.
NOW THIS AGREEMENT TO SELL WITNESSES AS FOLLOWS:
1. That the Seller is selling and the Purchaser is purchasing the above said PLOTS at price of
Rs. 4,20,00,000/- (Rupees Four Corer and Twenty Lac Only) each plot and total Price
of both the plots is Rs. 8,40,00,000/- (Rupees Eight Corer and Forty Lac Only). Out of
which Rs. 98,00,000/- (Rupees Ninety Eight Lac Only) has been paid through Pay
Order/DD/Cheque no. _______________________________dated____________ drawn on
____________________________________________________________and Rs. 200,000/- (Rupees
Two Lac Only) in cash to the Seller by the Purchaser (which is hereby acknowledged).
Remaining amount of Rs. 7,40,00,000/- (Rupees Seven Corer and Forty Lac Only) shall
be paid at the time of transfer of said PLOTS on or before 16th April 2022.

2. That the Seller will make himself available and sign all the documents which he is called
upon to sign by the Purchaser in concerned with the transfer of above said PLOT S in favour
of the Purchaser or any of his nominee(s).
3. That the Seller will be responsible to clear all the dues of the said property i.e. Cost of
Land, Development Charges / Additional Development Charges, Security Charges, Non
Utilization Charges, Derbies Charges, Land Charges, Corner Charges, Gain Tax and
Surcharge imposed by the Authority, if any, and other surcharges etc. of the said
PLOTS on or before due date of transfer. If the above said charges are cleared by the
Purchaser on behalf of the Seller then this amount shall be deducted from the balance
amount.
4. In the Case the Purchaser fails to pay the balance amount within stipulated period his Biana
(Earnest Money) will be considered as forfeited likewise if the Seller refuses or denies to the
transfer of PLOTS, the Purchaser will have the rights to get double of the paid Biana
(Earnest Money) or get execution of the said PLOTS in his favour thorough court of law on
the expense of the Seller.
5. That the Purchaser shall be entitled to enter into an agreement to sell with any other party
he likes on the prevalent market value or at any other consideration he deems fit and the
Seller will have no objection to sign the papers for such party during Biana period.
6. That the Seller and the Purchaser hereinbefore used shall include their respective heirs,
legal representatives, successors, assignees and nominees.
7. That 1% Commission of Total Cost will be paid by the Seller to the respective Property
Dealer and 1% Commission of Total Cost will be paid by the Purchaser to the respective
Property Dealer.
8. If the transfer fee or taxes are increased before the transfer of plots, the Seller and the
Purchaser are bound to pay these accordingly.

  • 1. AGREEMENT TO SELL TWO COMMERCIAL PLOTS (BIANA) COMMERCIAL PLOTS NO. 129 & 130, MIDDLE RING ROAD, BOULEVARD-2, SECTOR-B, DEFENCE HOUSING AUTHORITY PHASE-3, ISLAMABAD. By this deed of agreement made on 4th day of March 2022. BETWEEN Mr. Shahid Pervaiz Chaudhry Son of Chaudhry Muhammad Shafi, Resident of House# 141 Street no. 9, Sector B-1, Defence Housing Authority Phase-1, Islamabad, holding CNIC no. 61101-2026080-9 hereinafter called the Seller of the one part. AND Mr. Muhammad Salim Raza Son of Muhammad Farooq, Resident of House # 14-A, Street no. 15, Sector-H, Defence Housing Authority Phase-2, Islamabad, holding CNIC no. 35201- 7708340-1, hereinafter called Purchaser of the other part. That the Seller affirms and confirms that he is the absolute owner of the COMMERCIAL PLOTS no. 129 & 130, measuring 07.11 Marla, (40 Feet x 40 Feet) each plot, situated on Middle Ring Road, Boulevard-2, Sector-B, DEFENCE HOUSING AUTHORITY PHASE-3, ISLAMABAD. That the Seller further affirms and confirms that the said PLOTS are free from all sorts of encumbrances, charges, dues, lien, mortgage and litigation; and there is no loan against the said property. NOW THIS AGREEMENT TO SELL WITNESSES AS FOLLOWS: 1. That the Seller is selling and the Purchaser is purchasing the above said PLOTS at price of Rs. 4,20,00,000/- (Rupees Four Corer and Twenty Lac Only) each plot and total Price of both the plots is Rs. 8,40,00,000/- (Rupees Eight Corer and Forty Lac Only). Out of which Rs. 98,00,000/- (Rupees Ninety Eight Lac Only) has been paid through Pay Order/DD/Cheque no. _______________________________dated____________ drawn on ____________________________________________________________and Rs. 200,000/- (Rupees Two Lac Only) in cash to the Seller by the Purchaser (which is hereby acknowledged). Remaining amount of Rs. 7,40,00,000/- (Rupees Seven Corer and Forty Lac Only) shall be paid at the time of transfer of said PLOTS on or before 16th April 2022. That the Seller will make himself available and sign all the documents which he is called upon to sign by the Purchaser in concerned with the transfer of above said PLOT S in favour of the Purchaser or any of his nominee(s). 3. That the Seller will be responsible to clear all the dues of the said property i.e. Cost of Land, Development Charges / Additional Development Charges, Security Charges, Non Utilization Charges, Derbies Charges, Land Charges, Corner Charges, Gain Tax and Surcharge imposed by the Authority, if any, and other surcharges etc. of the said PLOTS on or before due date of transfer. If the above said charges are cleared by the Purchaser on behalf of the Seller then this amount shall be deducted from the balance amount. 4. In the Case the Purchaser fails to pay the balance amount within stipulated period his Biana (Earnest Money) will be considered as forfeited likewise if the Seller refuses or denies to the transfer of PLOTS, the Purchaser will have the rights to get double of the paid Biana (Earnest Money) or get execution of the said PLOTS in his favour thorough court of law on the expense of the Seller. 5. That the Purchaser shall be entitled to enter into an agreement to sell with any other party he likes on the prevalent market value or at any other consideration he deems fit and the Seller will have no objection to sign the papers for such party during Biana period. 6. That the Seller and the Purchaser hereinbefore used shall include their respective heirs, legal representatives, successors, assignees and nominees. 7. That 1% Commission of Total Cost will be paid by the Seller to the respective Property Dealer and 1% Commission of Total Cost will be paid by the Purchaser to the respective Property Dealer. 8.
